يعتبر تنازع الاختصاص من الموضوعات الدقيقة التي تثير عدة مشكلات عملية هامة متنوعة وكثيرة، بعضها فصل فيه القضاء طبقا لأوضاع معينة لحقها مع الوقت كثير من التغيير والتعديل، وبعضها الآخر تناولته النصوص الحالية بحلول صريحة. ونظرا لخطورة هذه المشكلات وتلك فقط اخترنا ثلاثة منها، ذات طابع عملي في المقام الأول، لنعالجها في الباب الحالي في ضوء تطور القضاء بشأنها، ناهيك بتطور النصوص وظهور بعض الجهات القضائية المستحدثة في نظامنا القضائي، وسنخصص لكل مشكلة منها فصلا على حدة على النحو الآتي : الفصل الأول : تطور تنازع الاختصاص بين محكمة الجنايات والمحكمة الجزئية، الفصل الثاني : تنازع الاختصاص بينهما في ظل نظام التجنيح (الذي كان قائما سنة 1962)، الفصل الثالث : تنازع الاختصاص بوجه عام في ظل التشريع القائم.
