مع المشروعية يتعين أن تصدره الإدارة من خلال شخص ولكى يكون القرار الإدارى متوافقا لأحكامه وأن خوله القانون تلك الرخصة، وأن يصدره فى الشكل الذى قد يحدده القانون محترما لأى من يبنى القرار على أسباب قانونية أو واقعية قائمة ومشروعة، فإذا صدر القرار مخالفا الضوابط السابقة كان القضاء الإدارى له بالمرصاد لينزل به جزاء البطلان أو الإنعدام بحسب مدى قضى ببطلان القرار مما يعنى محوه خروجه على مبدأ المشروعية فإذا كان هذا الخروج يسيرا . أما إذا تنصل القرار من مبدأ المشروعية بشكل من الحياة الإدارية واعتباره كما لو لم يصدر أصلا ، بحيث لا يتصور أن يوصف معه القرار بأنه قرار إدارى يكون دور جسيما تام وخرج عليه خروجا القضاء هنا تقرير إنعدام القرار.
