هو كتاب ينطلق من فكرة أن المحكمة الجنائية لا تحال إليها جرائم محددة وإنما أوضاع ووقائع حصلت على إقليم معين وتقوم دولة طرف في النظام الأساسي بالمحكمة أو مجلس الأمن التابع للأمم المتحدة بإحالة هذه الأوضاع إلى المدعي العام للمحكمة ومن هذا الأخير إلى الدائرة التمهيدية بالمحكمة أو يقوم المدعي العام للمحكمة بإحالة أوضاع معينة بناء على مبادرة فردية منه وبشكل مباشر إلى هذه الدائرة التمهيدية بالمحكمة الجنائية الدولية وفي جميع الأحوال وأيا كان مصدر هذه الإحالة فإن الدائرة التمهيدية بالمحكمة يقع واجبا عليها فحص المعلومات والأوضاع موضوع الإحالة.
