Overview
يتناول التقنين في جانب دقيق جدا وهو الجانب الإجرائي، وهذا الجانب في القانون الإداري ينقسم إلى قسمين، القسم الأول : يتعلق بالإجراءات الإدارية القضائية، أي الإجراءات التي ينبغي أن تتخذ أمام محاكم جهة القضاء الإداري. أما القسم الثاني : فإنه يتعلق بالإجراءات الإدارية غير القضائية، وهي محل بحثنا هذا، وهذه إجراءات إدارية متعددة تقوم بها جهة الإدارة للقيام بأعمالها اللازمة، وهي إجراءات لا تقع تحت حصر، تتناسب تماما مع مرونة القانون الإداري وسرعة تطوره، ولكنها ترجع إلى أصول إجرائية تم تقنين بعضها ومن ثم فإنه يمكن الاستناد لهذه الأصول لتقنين ما يمكن تقنينه من قواعد إجرائية في مجال الإجراءات الإدارية غير القضائية.
