يتناول الكتاب الأصول الإجرامية في الدعاوي والأحكام الإدارية حيث يتحدث عن أن تبرز خصوصية المرافعات الإدارية بالنظر لطبيعتها الخاصة من كونها غير منظمة بقانون مقنن يحكمها حيث لم يصدر بعد قانون يحدد إجراءات التقاضى أمام محاكم مجلس الدولة وتفاديا لهذا القصور بالجانب الإجرائي في المنازعات الإدارية ولحين صدور قانون جديد مستقل ينظم إجراءاتها فإن القانون الواجب التطبيق فيما يخص إجراءات تلك المنازعات هو قانون المرافعات المدنية والتجارية وقانون الإجراءات الجنائية فيما لم يرد بشأنه نص بقانون مجلس الدولة بشرط عدم تعارض ذلك مع طبيعة المنازعة الإدارية وروابط القانون العام.
