يلفت المؤلف أنه قرر الإسلام للمرأة أهلية تخول لها حق التملك الشخصي، سواء عن طيق الميراث أو العمل كالرجل. ويتطرق الحداد، أمور عديدة ترتبط بمسائل الزواج، وقال بجملة أفكار هذا الخصوص، استوعبها المجتمع التونسي ما بعد، ومنها : حية الاختيار بالنسبة للزوجين، اعتبار الزواج دون البلوغ جيمة، وعن تعدد الزوجات، بين أنها عادة منذ قبل الإسلام. وأما حالة تعذر الزوجية، فأباح الإسلام \"الطلاق\"، وهو أبغض الحلال عند الله، ويحث الإسلام ع اجتنابه بغير مبرر.
