يتناول المؤلف (محمد أبو زهرة) في كتابه ويقول : إن ابن حزم فقيه ظاهري، أحيا فقه داود الأصبهاني وسلك به مسلكا اتسم بسمته فوسع رحابه وأيد فروعه بالأدلة وناقض مخالفيه في أقوال صارمة وجدل غلب فيه الإفحام والإلزام وصال وجال وعاضد أقوال الظاهرية بأقوال بعض الأئمة إن وجد فيها نصيرا وأفاض في شرح فقه الصحابة والتابعين وأخرج من ذلك كنوزا نافعة وكشف عن معين لا ينضب ماؤه ولا ينقطع وراده واستخرج من ذلك الخضم الزخار من الآثار السلفية نفائس انفرد باستخراجها وكشفها. فكان لابد بعد أن تكلمنا في فقه الأئمة الأربعة ومن قاربهم أن نتجه إليه ؛ لنعرف ما جاء به ولنبين الذي أمد به ينابيع الفقه الإسلامي واللون الذي اختص به من بين جمهورهم.
