لم تعد الأموال المتحصلة عن جريمة الفساد مبلغا صغيرا يأخذه موظف في رشوة، أو مبلغا صغيرا يختلسه أمين الصندوق لقضاء حاجة يومية، بل تعدت إلى الأموال المتسربة من الدول النامية إلى الدول المتقدمة التي قدرتها مبادرة ستار Star التي أنشئت في: 2007م بين الأمم المتحدة والبنك الدولي من: 20 إلى 40 بليون دولار سنويا. 1- لذا فأهمية موضوع استرجاعها تكمن في: كونه وسيلة من سياسة الردع الخاص، بتفويت الفرصة على مرتكبها من الاستمتاع بثمرة جرمه، ومنه تقليل الحافز الذي يدفعه لارتكابها. 2- والردع العام: بإيصال فكرة إلى عموم الناس تتمثل في ملاحقة الجاني بمصادرة هذه الأموال، زيادة على عقوبة السجن وجبر الضرر الذي تسببت فيه.
