Educative Teachings Internal Inclinations Islamic Jurisprudence and its Strategic Role on the International Communities
Education based on Islamic nature is one of the different types of education, especially for children. In fact, this type of education may be more stable and more effective than other kinds of itself and caused little attention to its analysis. Nature that is the same homology of God inclinations of individuals is as an initial program to launch their behavior in interaction with others. It has been entrusted in same form the God for all the people. Modern schools and ideologies that have arisen due to the needs and reactions of political, social view, cause to appear a collision and opposition with this divine principle. Moral pluralism and Moral relativism both considered as one of the challengeable matters. In this paper, the intended theory (Title of paper), reveals another value and importance of this tendency of education for us. We have pointed to samples and examples of this type of education to be presented a picture of the practical form of it before entering the design the theory. Then mentioned challenge raised that is the same ethical pluralism and moral relativism papillae thoughts and we have adopted two theories of the martyr Motahhari and universal statement about ethics for its solution. So that mentioned challenges are not only overcome with these two theories but also this kind of education will cause a unifying the global ethics procedure and In fact, a strategic version is for all international gatherings and conventions.
Citing Testimony in Proceedings
Allegation of testimony has always been one of the reasons in the legal system for proving litigation. However, in countries where there is no need to make the witness to provide allegation of testimony on the one hand and considering the fact that the original principle is the innocence of the denier, testimony has largely lost its performance as a proof. Under the circumstances considered, allegation of testimony is accepted by the Muslims and its persuation as a great sin. Contrary to Islamic jurisprudence, the Iranian law does not accept the allegation of testimony; however, Western and Arab laws in accordance with Islamic jurisprudence consider testimony refusal as a crime and consider punishments for it.
Iran’s Legislative Policy in dealing with Fraud During COVID-19 Pandemic
The fear of the coronavirus has led to various types of scams related to the virus on the internet and in people’s homes, including in Iran. Scams include fraud through corona vaccine cards, fake coronavirus tests, counterfeit drugs, phishing fraud, and sites selling masks at exorbitant prices. Criminals have also been visiting homes for corona testing or disinfection, and using the pretext of livelihood loans or pre-sale advertisements of tourist tours with corona vaccine injections. As the COVID-19 virus spreads, Iran’s legislative policy has been to punish criminals to maintain the psychological safety of society. However, implementing legal principles in emergencies like this can be challenging, especially when ensuring the right to health and compliance with the basic human rights of criminals or their rehabilitation is necessary. Therefore, criminal policymakers should identify technological punishments and penal policies that are suitable for emergencies. They should create suitable grounds for achieving the goals of criminal justice in these circumstances. This article uses the descriptive-analytical method to explain Iran’s legal criminal policy towards criminals in the coronavirus era. It examines the principles of human rights and criminal principles that lead to appropriate legislative policies in upcoming events like COVID-19. The paper concludes that Iran’s legislative policy in emergencies like Corona is severe punishment of criminals to maintain the psychological safety of society. However, it also seeks to rehabilitate the criminals.
Addressing Inheritance, Testament and its Inhibition in Natural, Laboratory and Illegitimate Embryos Relative to other Heirs with Regard to Iran's Jurisprudential and Legal Principles
With the death of any person, his property shall be inherited by his heirs in accordance with the provisions of civil law. In the discussion of the legal validity of natural inheritance, the fetus is said to have an unstable legal personality that can enjoy its rights after birth and according to the famous verse of the Qur'an and the fatwa, there are conditions for it that are applied with his birth alive. Otherwise, nothing will be given to him and the sentence on his lack of existence is declared at the time of his death. Besides, one of the issues that give rise to doubts about the inheritance is the existence of a fetus among the heirs that these cases as well as the heir of the laboratory fetus are discussed.
