Best Evidence: The Role of Information in Domestic Judicial Enforcement of International Human Rights Agreements
Independent domestic courts play important roles in enforcing international human rights agreements, thereby providing a mechanism by which international institutions can affect government policy. Yet this enforcement power is constrained not only by independence but also by the courts' ability to overcome information problems. Domestic courts' enforcement power depends on information in two ways: the costs of producing legally admissible evidence of abuses and the applicable legal standards of proof. When countries ratify international agreements, judicial enforcement can improve government practices when evidence-production costs and standards of proof are low, but not otherwise. With respect to personal integrity rights violations, evidence is especially difficult to obtain, and standards of proof are high, meaning that the courts will not be able to constrain government practices. By contrast, evidence-production costs and standards of proof are lower for other civil rights violations, so courts will be able to prosecute offenders and bring governments into line with their international commitments. Consistent with this theory, I find that commitments to the International Covenant on Civil and Political Rights (ICCPR) have significantly improved governments' respect for the freedoms of speech, association, assembly, and religion. With respect to personal integrity rights, however, I find that commitments to the ICCPR have not improved government practices.
The online competition between pro- and anti-vaccination views
Distrust in scientific expertise 1 – 14 is dangerous. Opposition to vaccination with a future vaccine against SARS-CoV-2, the causal agent of COVID-19, for example, could amplify outbreaks 2 – 4 , as happened for measles in 2019 5 , 6 . Homemade remedies 7 , 8 and falsehoods are being shared widely on the Internet, as well as dismissals of expert advice 9 – 11 . There is a lack of understanding about how this distrust evolves at the system level 13 , 14 . Here we provide a map of the contention surrounding vaccines that has emerged from the global pool of around three billion Facebook users. Its core reveals a multi-sided landscape of unprecedented intricacy that involves nearly 100 million individuals partitioned into highly dynamic, interconnected clusters across cities, countries, continents and languages. Although smaller in overall size, anti-vaccination clusters manage to become highly entangled with undecided clusters in the main online network, whereas pro-vaccination clusters are more peripheral. Our theoretical framework reproduces the recent explosive growth in anti-vaccination views, and predicts that these views will dominate in a decade. Insights provided by this framework can inform new policies and approaches to interrupt this shift to negative views. Our results challenge the conventional thinking about undecided individuals in issues of contention surrounding health, shed light on other issues of contention such as climate change 11 , and highlight the key role of network cluster dynamics in multi-species ecologies 15 . Insights into the interactions between pro- and anti-vaccination clusters on Facebook can enable policies and approaches that attempt to interrupt the shift to anti-vaccination views and persuade undecided individuals to adopt a pro-vaccination stance.
Precedent in International Courts: A Network Analysis of Case Citations by the European Court of Human Rights
Why and how do international courts justify decisions with citations to their own case law? We argue that, like domestic review courts, international courts use precedent at least in part to convince ‘lower’ (domestic) courts of the legitimacy of judgements. Several empirical observations are consistent with this view, which are examined through a network analysis of European Court of Human Rights (ECtHR) citations. First, the Court cites precedent based on the legal issues in the case, not the country of origin. Second, the Court is more careful to embed judgements in its existing case law when the expected value of persuading domestic judges is highest. These findings contribute to a developing literature that suggests international and domestic review courts develop their authority in similar ways.
Violence, Nonviolence, and the Effects of International Human Rights Law
Under what conditions are individuals more likely to approve of human rights abuses by their governments? While various theoretical expectations have been offered about public approval of repression, many of them have not been directly tested. We analyze the effects of differing opposition tactics, differing government tactics, and legal constraints on approval of repression through a series of survey experiments in India, Israel, and Argentina. Our results indicate that violent action by opposition groups consistently increases support for government repression. In the context of contentious politics, we find that the effects of international law vary by national context. While our respondents in India were less likely to approve of their government when told the government violated international law, the same information likely increased approval of the government in our Israel experiment. The findings provide insights into the microfoundations of existing theories and suggest areas for theory refinement.
Clubs of Clubs: Fragmentation in the Network of Intergovernmental Organizations
Abstract Has international cooperation become fragmented in recent decades? We focus on a specific form of potential fragmentation in the international system: the extent to which the network of intergovernmental organizations (IGOs) consists of distinct clusters of closely cooperating states. IR scholars—including those with an interest in the causes and consequences of membership in IGOs—pay relatively little attention to the structure of the larger IGO network. At the same time, scholars concerned with fragmentation often assume that it has increased without clear measures of this phenomenon. We use the network analytic technique of modularity maximization to show that throughout the post–World War II period, the structure of the IGO network can generally be divided into distinct groups of states on the basis of their shared IGO memberships. Yet we also show that temporal trends indicate that the IGO network has become less fragmented in recent decades, suggesting that cooperation via these organizations has become more global and less regional. Our findings indicate that, at least as far as cooperation through formal organizations is concerned, fragmentation has decreased in recent decades.
Offline events and online hate
Online hate speech is a critical and worsening problem, with extremists using social media platforms to radicalize recruits and coordinate offline violent events. While much progress has been made in analyzing online hate speech, no study to date has classified multiple types of hate speech across both mainstream and fringe platforms. We conduct a supervised machine learning analysis of 7 types of online hate speech on 6 interconnected online platforms. We find that offline trigger events, such as protests and elections, are often followed by increases in types of online hate speech that bear seemingly little connection to the underlying event. This occurs on both mainstream and fringe platforms, despite moderation efforts, raising new research questions about the relationship between offline events and online speech, as well as implications for online content moderation.
Legislative Veto Players and the Effects of International Human Rights Agreements
Do national legislatures constitute a mechanism by which commitments to international human rights treaties can be made credible? Treaty ratification can activate domestic mechanisms that make repression more costly, and the legislative opposition can enhance these mechanisms. Legislative veto players raise the cost of formalistic repressive strategies by declining to consent to legislation. Executives can still choose to rely on more costly, extralegal strategies, but these could result in severe penalties for the leader and require the leader to expend resources to hide. Especially in treaty member-states, legislatures can use other powers to also increase the cost of extralegal violations, which can further reduce repression. By using an empirical strategy that attempts to address the selection effects in treaty commitment decisions, I show that positive effects of human rights treaties increase when there are more legislative veto players.
Digital Authoritarianism and the Future of Human Rights
How will advances in digital technology affect the future of human rights and authoritarian rule? Media figures, public intellectuals, and scholars have debated this relationship for decades, with some arguing that new technologies facilitate mobilization against the state and others countering that the same technologies allow authoritarians to strengthen their grip on power. We address this issue by analyzing the first game-theoretic model that accounts for the dual effects of technology within the strategic context of preventive repression. Our game-theoretical analysis suggests that technological developments may not be detrimental to authoritarian control and may, in fact, strengthen authoritarian control by facilitating a wide range of human rights abuses. We show that technological innovation leads to greater levels of abuses to prevent opposition groups from mobilizing and increases the likelihood that authoritarians will succeed in preventing such mobilization. These results have broad implications for the human rights regime, democratization efforts, and the interpretation of recent declines in violent human rights abuses.
The Informative Power of Treaty Commitment: Using the Spatial Model to Address Selection Effects
The effects of international institutions on state behavior make up a key research agenda in international-relations scholarship. Because states self-select into treaties, we cannot infer that these commitments have causal effects unless we address this selection effect. I explain the significant limitations of the methods used thus far to overcome this problem and argue that a more effective approach must take into account states' treaty preferences. I describe a novel combination of ideal-point estimation and propensity-score matching that can estimate the probabilities of treaty commitment and use them to test hypotheses. I use this procedure to test the effects of three key international human-rights treaties. My results provide significant new findings regarding the effects of these important agreements. I show that the Convention on the Elimination of All Forms of Discrimination against Women has significantly improved respect for women's rights, but that the Convention against Torture and the International Covenant on Civil and Political Rights have not had significant effects on human rights.
Trading on Preconceptions: Why World War I Was Not a Failure of Economic Interdependence
World War I is generally viewed by both advocates and critics of commercial liberal theory as the quintessential example of a failure of economic integration to maintain peace. Yet this consensus relies on both methodologically flawed inference and an incomplete accounting of the antecedents to the war. Crucially, World War I began in a weakly integrated portion of Europe with which highly integrated powers were entangled through the alliance system. Crises among the highly interdependent European powers in the decades leading up to the war were generally resolved without bloodshed. Among the less interdependent powers in Eastern Europe, however, crises regularly escalated to militarized violence. Moreover, the crises leading to the war created increased incentives for the integrated powers to strengthen commitments to their less interdependent partners. In attempting to make these alliances more credible, Western powers shifted foreign policy discretion to the very states that lacked strong economic disincentives to fight. Had globalization pervaded Eastern Europe, or if the rest of Europe had been less locked into events in the east, Europe might have avoided a \"Great War.\"
