يتناول الكتاب التعريف بالقانون الجنائي وجرائم التعزيز في الشريعة الإسلامية ويتحدث الكتاب عن ماهية جريمة الرشوة وأركانها وجريمة عرض الرشوة وجريمة المكافأة الملاحقة وجريمة استغلال النفوذ ويتناول الكتاب أيضا ماهية جريمة اختلاس المال العام في صورتها غير المشدد وماهية جريمة التزوير وماهية جريمة استعمال المحرر المزور وماهية نزييف العملة وجريمة إدخال نقود مزيفة وإخراجها والتعامل بها وترويجها.

الزيادة في التعزيز على الحد
Islam had set estimated punishments for certain crimes,
Muslims cannot exceed or decrease them.
But the merci of Allah made some of the judgments by the
human beings, in which they shall judge according to Islamic Law
(Sharia), this is callea the reinforcement. But some of the Muslim
legists have different opinions in the extent of this reinforcement,
some of them restricted it below the limits, those are the Hanafi and
Shafi'i doctrines, based on the prophet's saying: they didn't
reach the limits, but they made the reinforcement below it.
Some of them limited it to ten whips, those are Hanbali
doctrine and they quoted this prophet's saying as an evidence: <
nobody whips more than ten unless it is one of Allah limits>. They
applied the external meaning of it, so they didn't exceed more than ten
whips.
Some of them imitated the prophets companions, those are Maliki
doctrine, who didn't find a limited extent for the reinforcement, but
they referred it to the ruler pursuant to the interest.
The details of these quotes and doctrines will be explained
through this research.
حدد الإسلام عقوبات مقدرة لجرائم و جنايات م، لا يجوز لمسم أن ينقص عنها. ِ و لكنــه ســبحانه و تعــالى مــن رحمتــه أن جعــل بعــض الأَحكــام فــيَ نطـاق البشـر، يحكموا فيها ضـمن الإطـار العـام للشـريعة الإسـلامية ؛ ذلك هو التعزيز، و لكن بعض علماء المسلمين اختلفوا في مقدار التعزيز، فمنهم من قيادة بمقدار معين استنادا إلى أحاديث صحية، وهم الحنيفة و الشافعية، استنادا إلى حديث : من بلغ حد فهو من المعتمدين. فلم يبلغوا الحدود بل جعلوا التعزيز فيما دونها. و أما الحنابلة، فقد استدلوا بحديث : \"لا يجلد فوق عشر جلدات إلا في حد من حدود الله فأخذوا بظاهر الحديث، و لم يزيدوا على عشرة أسواط. أما المالكية، فإنهم أخذوا بفعل الصحابة، و لم يجعلوا للتعزيز مقدارا بل جعلوا أمره إلى الحاكم، كيفما تقتضيه المصلحة كما سيأتي بيانه في هذا البحث بإذن الله تعالى.
