هذه المقالة تحاول توضيح علاقة القانون الجنائي عابر الحدود بالقانون الدولي الجنائي، وهو أحد فروع القانون الدولي العام الذي تشكل عقب الحرب العالمية الثانية، إن لم يكن من قبل. فالهدف الأساس لهذه المقالة هو البحث فيما إذا كان القانون الجنائي عابر الحدود هو أحد فروع القانون الدولي الجنائي أم أنه مستقل عنه، ومن ثم فإنه من الممكن توصيفه باعتباره فرعا مستقلا وحديثا للقانون الدولي العام. يميل الباحث في هذه المقالة إلى الاتجاه الثاني؛ نظرا للاختلافات بين القانون الجنائي عابر الحدود وبين القانون الدولي الجنائي، القائمة على أساس المفهوم القانوني وموضوع القانون ومصادر القانون والمسؤولية الجنائية والاختصاص.

ترجع أهمية دراسة الجريمة المنظمة عبر الوطنية إلى تزايد خطرها على دول العالم كافة خاصة مع ظهور النظام العالمي الجديد (العولمة) بكل ما تحمله من تقدم علمي وتكنولوجي وخاصة الشركات عابرة القارات والتي تخفي ورائها أحيان جرائم منظمة عبر وطنية، فالعديد من الدول عانى من ويلات الإجرام المنظم فهو بمثابة عصابة داخلية داخل الدول تمتد بيدها في الدول الأخرى.

Analyzing the Effects of Illegal Migration Influx on the Host Nations' National Security
Purpose: The purpose of the research is to analyze the impact of illegal migration influx on the national security strategies of the host nations. It attempts to examine the challenges of illegal migration to the national security of the host nations. The research tackles the difficulty of controlling the illegal immigrants influx and introduces a set of policies to create a balance between security needs and humanitarian concerns. Methodology: The research applies system analysis approach providing a structured approach for gaining a full understanding of the complex systems by examining system boundaries, components. interactions, inputs, outputs, feedback mechanisms, and dynamics of the system involved in illegal migration influx with the possible outcomes of policy interventions and changes in migration patterns. Findings The increase in illegal migration influx poses serious threats to national security in every country worldwide. The research examines the complex effects of migration influx on the security structures and socioeconomic environments of the host countries, with particular attention on how border control, law enforcement, and social stability may be affected. Value: The research aims to provide a unique contribution, symbolizing the inherent relationship between illegal migration and national security. Furthermore, it has to be acknowledged that the host and source nations elaborate their economic, migration, and security concerns without consultation with each other at the policy level which is damaging to the credibility of the immigration policy in most informal negotiations.

أنشطة المافيا الإيطالية في طنجة
يستعرض المقال الراهن دور مدينة طنجة خلال سنوات ما بعد الحرب العالمية الثانية (1939-١٩٤٥) كمركز مهم لنشاط المافيا الإيطالية وقد استثمرنا في إنجازها مجموعة من الوثائق الفرنسية والإسبانية والإيطالية بهدف فهم مدى تأثير عصابات الجريمة المنظمة على الأوضاع الأمنية والاقتصادية والاجتماعية على المغرب وجواره القريب خلال السنوات الأخيرة من عمر الحماية. تحاول هذه الدراسة أن تبرز السياقات المحلية والدولية التي ساعدت على امتداد أنشطة العصابات الإيطالية إلى طنجة، كالفوضى التي أعقبت الحرب العالمية الثانية وغياب الرقابة، والتواطؤ بين شبكات الجريمة وبعض العناصر الأمنية والجمركية. كما تلقي الضوء على العلاقة بين نشاط عصابات الجريمة المنظمة وتطور حركات التحرر الوطني في المغرب والجزائر، وفي نفس تناقش البنية التنظيمية لتلك العصابات ووسائلها اللوجستية التي شملت استخدام السفن، السيارات، والطائرات المائية. كما تبرز هذه الدراسة أهمية مدينة طنجة ومدى انفتاحها على ما كان يحدث في العالم آنذاك، وتدعو الباحثين الالتفات أكثر إلى أرشيفات الأجنبية خصوصا الفرنسية والإسبانية والإيطالية لما لها من أهمية في دراسة مغرب القرن العشرين، بقي أن نشير إلى أننا نقصد بـ: \"المافيا\" عصابة الكوزا نوسترا دون غيرها من العصابات الإيطالية.

The Consequences of Organized Crime at the Social Level in Algeria
This research paper aims to highlight and give a clear picture of the effects and repercussions of organized crime on the social level in Algeria, Where the international community suffers from a dangerous and worrying phenomenon, which is the increasing growth of transnational organized crime gangs, which have developed terribly, and have benefited from the successive technological developments and the great changes produced by the global political, economic and cultural conditions, thus, the advanced international security agencies have been unable to pursue them and limit their authority. Therefore, we will try through this article to shed light on the most important negative effects of organized crime in our country at the social level. This study has recorded the extent of the organized crime's seriousness, given the risks it poses to life in general, especially on the social side. Moreover, it seems that peoples and societies in the world, including the Algerian society, are not far from sensing the immense imminent dangers they face as a result of the increasing spread of organized crime gangs.
