Governance and its Role in Reducing Corruption in Commercial Companies
Adopting corporate governance is an important requirement as a mechanism to reduce corruption affecting commercial companies, as the advancement of the business sector necessarily requires the effective implementation of accountability, transparency, justice, and equality. The adoption of governance ensures the regulation of corporate crimes through internal and external oversight. Undoubtedly, the adoption of governance protects the rights and interests of minorities in commercial companies from the tyranny of the majority, all to achieve the objectives for which the company as a legal entity was established.

استهدف هذا البحث الخلوص إلى سبل مقترحة لمكافحة الفساد الإداري في مؤسسات التعليم، وبخاصة في الإدارات التعليمية الموجودة على المستويين الإقليمي والمحلي بدول العالم التي تعاني من الفساد الإداري، وقد استخدم البحث المنهج الاستنباطي التحليلي لمعالجة مشكلته والوصول لأهدافه، وكان من أبرز نتائجه تقديم عديد من السبل المقترحة التي يمكن تنفيذها والإفادة منها في مكافحة الفساد الإداري في الإدارات التعليمية، ومما أوصى به البحث ضرورة تبني خطط وتطبيق برامج عملية مستمرة للإصلاح المؤسسي والتطوير التنظيمي للإدارات التعليمية مع التوسع التكنولوجي في جميع أعمالها وأنشطتها، مع تحسين الوضع المادي للهيئة العاملة مع الردع القانوني والقضائي للفاسدين، وإلزامها بإعداد تقارير سنوية عن حالة النزاهة والشفافية في ضوء مؤشرات وطنية ودولية.

Constitutional and Legal Approaches for Combating Corruption in Algeria
Corruption, a pervasive phenomenon, manifests globally across nations, transcending boundaries of integrity and developmental stages. The prevalence and manifestation of corruption vary markedly among countries, influenced primarily by the robustness of their respective anticorruption frameworks and the efficacy of regulatory mechanisms. In recognition of this, international law significantly prioritizes the combat against corrupt practices. In alignment with global directives, Algeria has embarked on an anti-corruption crusade, epitomized by the enactment of Law 06-01, which underwent substantial revisions under Law 22-08. This pivotal amendment heralded the establishment of the Supreme Authority for Transparency, Prevention, and Combating Corruption, marking a significant stride in Algeria's legal arsenal against corruption.

تعتبر ظاهرة الفساد الإداري ظاهرة عالمية واسعة الhنتشار وذات جذور عريقة وقديمة مدى التاريخ ومن ذلك العمق التاريخي وحتى يومنا هذا استمرت الدراسات لتقديم النصيحة لاجتناب أسلوب الفساد الإداري وهذه الظاهرة حظيت بالاهتمام من قبل الباحثين في مختلف التخصصات الاقتصادية والقانونية والسياسية والاجتماعية ولدراسة هذه الظاهرة رأينا التعرض لمفهوم الفساد بصورة عامة ومن بعد ذلك الدخول في مفهوم الفساد الإداري وأسبابه ثم علاجه.
