الحماية الجزائية للملكية العقارية على ضوء أحكام المادة 386 عقوبات جزائري
نتج عن اختلاف الترجمة من النص الفرنسي للمادة 386 عقوبات إلى العربية إلى تضارب في الاجتهاد القضائي بخصوص العبارة الواردة في النص المتمثلة في: انتزاع عقار مملوك للغير خلسة أو بطريق التدليس. فقد اشترطت المحكمة العليا في الاجتهادات الأولى ضرورة صدور حكم مدني نهائي يقضي بالإخلاء مع ضرورة تنفيذ هذا الحكم ثم معاودة الاستيلاء على الأماكن من نفس المعتدي حتى تتوافر العناصر المكونة للجريمة، إلا أن المحكمة العليا تراجعت مؤخرا عن هذا الاجتهاد ولم تعد تشترط ضرورة صدور حكم مدني. وفي غياب تعريف ثابت لمفهوم الخلسة والتدليس أدى إلى وجود تضارب في الأحكام والقرارات القضائية مدة طويلة قبل صدور اجتهاد المحكمة العليا الذي وحد الاجتهاد القضائي.

The Reality of Application of Corporate Governance in Algerian SMEs
The study aimed to determine the adoption's level of corporate governance in the small and medium enterprises in Algeria, as one of the new management systems that have proved effective in many international experiences. To reach this goal, the study included the explanations for each of the corporate governance and the SME's, and the analysis of the results of 150 questionnaires distributed to a sample of 150 SMEs that operate in various fields and in all regions of Algeria, focusing on the owners and cadres of these enterprises. The study found that the majority of SMEs in Algeria has clearly accepted to adopt corporate governance, but it requires providing an appropriate environment for it and foremost training and awareness of the importance and benefits of corporate governance.
