يتناول هذا الكتاب شرحا لقانون إقامة الأجانب رقم 76 لسنة 2017، من خلال قراءة قانونية نقدية عملية لأغلب ما تناوله المشرع العراقي من مواد وبنود وفقرات وبيان مدى تعارضها مع الواقع العملي من حيث التطبيق والحاجة الفعلية إلى التعديل أو الإضافة بل وحتى الحذف أحيانا في بعض مواده من أجل الوصول إلى القانون الأمثل الذي يتناسب مع مركز الأجانب في العراق وما للأجنبي من حقوق وما عليه من التزامات بصورة سلسة متناغمة مع الواقع العملي تسهل على العاملين في السلطة المختصة تنفيذه بشكل واضح ومحدد ابتداء من دخول الأجانب إلى الأراضي العراقي وما يتطلب دخولهم من شروط وشرعية الإقامة فيه وإجراءاتها ومن ثم مغادرتهم من خلال المنافذ الرسمية لجمهورية العراق وإلا تعرضوا لتلك الجزاءات المنصوص عليها في هذا القانون.

دور التشريعات الوطنية في التصدي لظاهرة الهجرة غير الشرعية
تعد الهجرة غير الشرعية في أساسها قضية -إنسانية اجتماعية وسياسية وقانونية، وأنها تمثل جزءا جوهريا من قضايا الوجود الاجتماعي والسياسي للإنسان، وأنها تعد قضية أمنية، لكون مفهوم الأمن نسبي ومتغير ومركب، وهو ذو أبعاد عدة ومستويات متنوعة، يتعرض لتحديات وتهديدات مباشرة وغير مباشرة من مصادر مختلفة، فالدولة أصبحت الآن تواجه أنماطا عدة من مصادر التهديد، والتي ليست بالضرورة مصادر عسكرية، ومنها قضية الهجرة غير الشرعية التي تعد من مصادر تهديد أمن الدول، وتصدت الكثير من تشريعات الدول لظاهرة الهجرة غير الشرعية، وأن عددا من الدول لم تكن لديها الخطط الكفيلة لإدارة الملفات بصورة ناجحة، مما أدى إلى فشلها السياسي أو الاقتصادي أو الأمني مما دفع الأفراد إلى الهجرة غير الشرعية.

It is known that there is an exodus of Iraqi scientific competencies outside the country, which began since the days of the former regime and intensified after the events of 2003 until it became like a bleeding wound that can't heal. The loss of the country by the great migration of scientific talent is big because it is difficult to compensate or replace them with others, for they are elite and exclusive community leaders in development and prosperity. In off this dangerous phenomenon, the state must stands a courageous stand, and find out the causes and work seriously on defusing them, and thus prepares the way for the return of competencies scientific .

The migration of brains carries political, economic, social, cultural dimensions, and aims, amongst other aims, to stop the wheel of construction, progress and development of the state that expels the minds and competencies of its people , and the development of the state that foster them. the effects of the brain drain in Iraq are highlighted and clear,and there is an urgent need for these talented , because Iraq at the current stage passes a very difficult and complicated era that witnesses an explosion in the development of information,because the basic supplier is the human resources and all other important remains linked to its composition.
