La littérature scientifique indexée dans la base de données Scopus de 1993 à 2022 a été utilisée pour l'analyse scientométrique sur la propriété intellectuelle, révélant la distribution quantitative par année, par langue et par type de publication de 4489 documents ; Aussi la contribution des pays arabes a été étudiée, l'analyse de la collaboration des auteurs arabes et l'analyse de la cooccurrence des mots-clés sont analysées via le logiciel VOSviewer. Les résultats montrent que les publications sur la propriété intellectuelle ont connu une croissance soutenue jusqu'en 2011 et des fluctuations de 2012 à 2022; que les États-Unis, le Royaume-Uni et la Chine sont les pays les plus actifs ; la contribution des pays arabes est très minimale (2%) par rapport à la production mondiale, l'Egypte, les Emirats Arabes et l'Arabie Saoudite sont les mieux classés.

The topic of the Creative Commons licenses is very important nowadays because this license is new and different from the traditional licenses. The aim of this research article is to address the legal aspects of a licensee's obligations according to the Creative Commons licenses and their relationship to copyright. The Creative Commons licenses raise several questions that this study will focus on answering, namely: the concept of the Creative Commons licenses, the characteristics of the Creative Commons licenses, the licensee's obligations under the Creative Commons licenses, and the relationship between the Creative Commons licenses and copyrights. The importance of this research article comes from the fact that Creative Commons licenses are a new mechanism and an unconventional type of license over copyright. The problem of this study lies in the author's fear of infringement of his exclusive rights after granting the Creative Commons licenses to others. Finally, in this study, an analytical and descriptive research methodology was used to clarify the ambiguities in the legal aspects of the licensee's obligations under the Creative Commons licenses and their relationship to copyright. In the conclusion of this study many important results and recommendations are communicated.

تركز هذه الدراسة على رؤية القائمين بالاتصال في البوابات الصحفية الإلكترونية وثقافتهم حول موضوع الملكية الفكرية وعلاقتها بأدائهم المهني في إطار تأثرية الشخص الثالث، علاوة على أنها تلقى الضوء على قضية الملكية الفكرية الرقمية في ظل وجود مشاكل حماية الأعمال الفكرية والفنية على الإنترنت واتساع نطاق ثورة النشر الإلكتروني وما أبرزته من مشاكل جديدة على مجتمعاتنا ووجوب حماية ما ينشر على هذه الشبكة من خطر القرصنة والانتحال، وصعوبة تمييز الأعمال الأصلية عن غيرها من بين الفيض المعلوماتي الكبير، تتمثل عينة الدراسة في عينه قوامها 100 مفردة من مستخدمي الإنترنت موزعة كالاتي (25 مفردة من القائمين بالاتصال في الصحف الإلكترونية -25 مفردة من المدونين وأصحاب الأعمال الأدبية الخاضعة للنشر الإلكتروني -25 مفردة من أساتذة الجامعة في التخصصات المختلفة وخاصة الإعلام والقانون -25 متخصصين في البرمجيات والتكنولوجيا). وتوصلت الدراسة إلى أنه لا يوجد اختلاف كبير بين الذكور والإناث فيما يتعلق بطبيعة العمل الصحفي ومدي المعرفة بحقوق الملكية الفكرية ويمكن أن يرجع ذلك لتواجد المرأة في كافة المجالات بالإضافة للعمل الصحفي والإعلامي سواء التقليدي أو الإلكتروني وعلاقتها بمختلف القضايا التي ترتبط بهذه المجالات مثل قضية الملكية الفكرية، علاوة على اختلاف التخصصات لأفراد العينة مما يعكس اختلاف الرؤي في تناول موضوع الملكية الفكرية وخاصة الانتهاكات المختلفة التي قد يتعرض لها معظم العاملون على اختلاف ثقافتهم وتخصصاتهم.

يهدف البحث العلمي إلى اكتشاف الحقائق أو المساهمة في حل مشكل مطروح متعلق بظاهرة اقتصادية محددة، باستخدام منهج علمي معين، وعادة ما تنشر نتائج هذه الأبحاث في شكل ورقة علمية (مقال)، ويعتبر النشر وسيلة فعالة لتبادل إبداعات الباحثين، فهو وسيلة تواصل ما بين الباحثين، حول نتائج أبحاثهم، وهو بمثابة مرجع ببليوغرافي للدراسات المستقبلية، وهو جزء لا يتجزأ من عمل الباحث، إلا أن بعض الباحثين يفتقد إلى الخبرة في اختيار مجلة النشر، وفي تقديم مقال علمي لائق للنشر، بسبب عدم التمييز بين الكتابة البيداغوجية الموجهة للتدريس وبين الكتابة العلمية الموجهة للنشر العلمي، وعلى هذا الأساس كان الغرض من المقال، معرفة كيفية اختيار المجلة، وكيفية تقديم مقال بحث للنشر وفقا لهيكل الــ IMRaD في مجلة تشترط ذلك، اعتمادا على إحصائيات وتجارب من مختلف العلوم؛ وتبين استنباطا من مختلف الدراسات أن تطبيق هذا الهيكل في العلوم التي تستند على دراسة الحالة، هو الأكثر استخداما ووضوحا، لأنه يتيح للباحث سهولة في التحرير، ويسمح للقارئ والمراجع على حد سواء، سلاسة في الفهم والمراجعة.
