La delimitación de la figura de “alto cargo\" no es una cuestión sin consecuencias jurídicas. Muy al contrario, la inserción de un sujeto como alto cargo en la esfera organizativa de la Administración conlleva el establecimiento de un específico poder de organización y control de la actuación y del propio comportamiento de los altos cargos. Así, y en base a esa consideración, se regulan las singularidades respecto de las condiciones de nombramiento (idoneidad y honorabilidad). Se impone el ejercicio de la función del alto cargo sujeto a unos principios de actuación. Se incluyen obligaciones específicas como la de formación, la de desempeñar sus funciones con integridad, absteniéndose, por lo tanto, de incurrir en conflictos de intereses y se contemplan situaciones de incompatibilidad respecto de su actuación en su esfera privada. Se establecen obligaciones de objetividad, transparencia y austeridad. Se regula un régimen retributivo y de protección social específico y se articula un régimen específico de limitaciones al ejercicio de actividades económicas tras su cese, o el uso de medios de pago para los gastos de representación, etc. En fin, y por señalar una última cuestión, se delimita un régimen sancionador específico derivado de las exigencias anteriores que es finalmente objeto de análisis en el presente estudio…

This book considers the phenomenon of soft law employed by domestic public authorities. Lawyers have long understood that public authorities are able to issue certain communications in a way that causes them to be treated like law, even though these are neither legislation nor subordinate legislation. Importantly for soft law as a regulatory tool, people tend to treat soft law as binding even though public authorities know that it is not. It follows that soft law’s ‘binding’ effects do not apply equally between the public authority and those to whom it is directed. Consequently, soft law is both highly effective as a means of regulation, and inherently risky for those who are regulated by it. Rather than considering soft law as a form of regulation, this book examines the possible remedies when a public authority breaches its own soft law upon which people have relied, thereby suffering loss. It considers judicial review remedies, modes of compensation which are not based upon a finding of invalidity, namely tort and equity, and ‘soft’ challenges outside the scope of the courts, such as through the Ombudsman or by seeking an ex gratia payment. The term transnational governance designates untraditional types of international and regional collaboration among both public and private actors. These legally-structured or less formal arrangements link economic, scientific and technological spheres with political and legal processes. They are challenging the type of governance which constitutional states were supposed to represent and ensure. They also provoke old questions: Who bears the responsibility for governance without a government? Can accountability be ensured? The term ‘constitutionalism’ is still widely identified with statal form of democratic governance. The book refers to this term as a yardstick to which then contributors feel committed even where they plead for a reconceptualisation of constitutionalism or a discussion of its functional equivalents. ‘Transnational governance’ is neither public nor private, nor purely international, supranational nor totally denationalised. It is neither arbitrary nor accidental that we present our inquiries into this phenomenon in the series of International Studies on Private Law Theory.
