As corporations continue to increase their online presence and reliance on information technology in their day-to-day businesses, the scope and limits of these activities continue to be tested in the courts. The first section of this survey provides an example of the law being applied to online advertising activities in a similar way as it would apply to traditional publishing or broadcasting. The second section deals with attempts to extend copyright protection to automated processes; the latest cases illustrate that copyright law can sometimes apply inflexibly to new technological concepts and business practices. As the digitization of businesses and use of social forums increase, traditional legal principles and regulations are being tested. While the laws in some areas, such as consumer protection, may organically extend to business activities on different technological mediums and platforms, the laws in other areas, such as copyright, do not automatically extend to protect information that is now prepared, organized, and held by automated processes.

Jun. 1--Building your brand encompasses a range of activities that are focused on a common goal: creating strategic positioning for your company. Many elements go into brand development including your copy style, layouts and colors, and core messaging. But perhaps nothing is quite as compelling, or can have as significant an effect, as your logo. Once you've designed your logo, your work has just begun; you need to creatively use it to ensure maximum exposure to your target market. The consistent use of your logo on everything that emanates from your company is an important way to brand your company that shouldn't be overlooked. At its highest level, a well-branded logo can stand on its own to represent a company (e.g., McDonald's golden arches). That familiarity certainly doesn't happen overnight, but is a byproduct of the frequent, repetitive and often creative use of the logo. 4. Incorporate your logo into your packaging and/or collateral. If your company offers a product, be sure your logo is prominently represented on the packaging. Definitely think outside the box; if you use tissue paper, for instance, order some imprinted with your logo. If your company provides a service, be sure your logo is prominently placed on all your collateral pieces and everything else you leave with potential customers, including business cards.

Copyright confers exclusive ownership of limited scope and duration on the author of a work who is permitted to control the exploitation of the creation. The concept of copyright is fairly familiar in regard to novels, plays, and other products of the mind. A direct mailer's lists also are copyrightable. All that is required is that the list be original and in a fixed form. A copyright will then protect the expression of the direct mailer's ideas, though not the ideas themselves.
