Observations of badgers in the Burren, Co. Clare
Camera traps were employed to survey and monitor badger setts in the Burren region. A total of six setts were discovered and documented, with camera traps strategically positioned near four of them. In one case, a camera trap was placed between two setts. However, it was observed that badger occupancy was sporadic and infrequent at these setts. In addition to badgers, the camera traps also recorded the presence of red foxes, pine martens, and various small mammals. The process of locating these setts proved challenging due to the absence of clear paths and the presence of substantial spoil heaps, which are accumulations of discarded earth or debris. These difficulties in pinpointing badger setts may pose a hindrance to the capture of badgers for vaccination purposes, potentially impacting efforts to eradicate bovine tuberculosis in the region.

Prin acţiunea înregistrată la Curtea de Arbitraj Comercial Internaţional de pe lângă Camera de Comerţ şi Industrie a României sub nr. [...], Reclamanta [...] a solicitat admiterea cererii de arbitrare şi pe cale de consecinţă prelungirea duratei de execuţie de la data de [...] (data iniţială de finalizare a lucrărilor) până la data de [...] (data Recepţiei la Terminarea Lucrărilor), precum şi obligarea Pârâtei la plata cheltuielilor ocazionate cu demararea prezentului litigiu. Reclamanta-Pârâtă solicită prelungirea Duratei de execuţie de la data de [...] (data iniţială de finalizare a lucrărilor) până la data de [...] (data Recepţiei la Terminarea Lucrărilor), argumentând că finalizarea lucrărilor a fost întârziată de Evenimente de Risc ale Beneficiarului. Evenimentele de risc disputate de părţi ca reprezentând evenimente de risc ale Beneficiarului sau ale Antreprenorului sunt următoarele: (i) emiterea Avizelor Tehnice de Racordare cu impunerea condiţiei de execuţie a unor lucrări suplimentare de întărire a reţelei electrice, care nu erau prevăzute iniţial în Contract (condiţie impusă de deţinătorul de utilităţi care este obligatorie pentru Antreprenor); (ii) modificarea legislativă care a suspendat la nivel naţional activitatea de încheiere a Contractelor de Racordare; (iii) durata suplimentară necesară pentru execuţia efectivă a lucrărilor suplimentare de întărire a reţelei electrice. 5 [Notificarea de dezacord] în cazul în care, în conformitate cu prevederile Contractului, Supervizorul a emis o Decizie cu privire la Durata de execuţie fără ca o Revendicare a Antreprenorului să fi fost notificată, Antreprenorul va fi îndreptăţit la o prelungire a Duratei de execuţie dacă şi în măsura în care terminarea Lucrărilor este sau va fi întârziată datorită uneia din următoarele cauze:[...] ii) autorităţi publice, personalul lor sau agenţii lor întârzie activitatea Antreprenorului din motive care nu se datorează culpei Antreprenorului şi într-un mod pe care un antreprenor diligent nu îl putea prevede la data depunerii Ofertei sau preveni în mod rezonabil. \" * Sub-Clauza 68.1. Caracterul excepţional al acestui eveniment rezultă inclusiv din faptul că întărirea reţelei nu a fost necesară nici pentru cele 13 SPAU-ri aferente DAT [...], şi nici pentru 3 SPAU-ri din UAT [...], ci doar pentru un număr de 4 staţii, fiind imposibil de prevăzut care sunt capacităţile tehnice ale reţelelor DEER pentru fiecare amplasament viitor al fiecărui SPAU ce urma a fi executat în cadrul contractului de lucrări.
