Since 2013, the debates on lethal autonomous weapons systems (LAWS) and approach to them from the point of view of international legislation have been taking place within the framework of the Convention on Certain Conventional Weapons (CCW) and later, since 2017, on the platform Group of Governmental Experts under CCW. Following the ongoing debates and the importance of the topic, in her article, the author aims to summarise the results achieved in the discussions under the CCW, especially the main steps, successfully handled challenges and shifts in the countries’ positions since 2013, as well as open issues in regulating LAWS under this international convention. Part of the article is dedicated to the identification of existing similar features of countries sharing a common position on LAWS at CCW conferences, as well as the challenges and possible implications of China’s status, which supports a ban on the deployment of LAWS, but not on their research and production.

Atomic Aversion: Experimental Evidence on Taboos, Traditions, and the Non-Use of Nuclear Weapons

How strong are normative prohibitions on state behavior? We examine this question by analyzing anti-nuclear norms, sometimes called the “nuclear taboo,” using an original survey experiment to evaluate American attitudes regarding nuclear use. We find that the public has only a weak aversion to using nuclear weapons and that this aversion has few characteristics of an “unthinkable” behavior or taboo. Instead, public attitudes about whether to use nuclear weapons are driven largely by consequentialist considerations of military utility. Americans’ willingness to use nuclear weapons increases dramatically when nuclear weapons provide advantages over conventional weapons in destroying critical targets. Americans who oppose the use of nuclear weapons seem to do so primarily for fear of setting a negative precedent that could lead to the use of nuclear weapons by other states against the United States or its allies in the future.

Deflective Cooperation: Social Pressure and Forum Management in Cold War Conventional Arms Control

Why do states create weak international institutions? Frustrated with proliferating but disappointing international environmental institutions, scholars increasingly bemoan agreements which, rather than solving problems, appear to exist “for show.” This article offers an explanation of this phenomenon. I theorize a dynamic of deflective cooperation to explain the creation of compromise face-saving institutions. I argue that when international social pressure to create an institution clashes with enduring disagreements among states about the merits of creating it, states may adopt cooperative arrangements that are ill-designed to produce their purported practical effects. Rather than negotiation failures or empty gestures, I contend that face-saving institutions represent interstate efforts to manage intractable disagreement through suboptimal institutionalized cooperation. I formulate this argument inductively through a new multi-archival study of conventional weapons regulation during the Cold War, which resulted in the oft-maligned 1980 UN Convention on Certain Conventional Weapons. A careful reconsideration of the negotiation process extends and nuances existing IR theorizing and retrieves its historical significance as a critical juncture and complex product of contesting diplomatic practices.

Nuclear strategy in the modern era

The world is in a second nuclear age in which regional powers play an increasingly prominent role. These states have small nuclear arsenals, often face multiple active conflicts, and sometimes have weak institutions. How do these nuclear states-and potential future ones-manage their nuclear forces and influence international conflict? Examining the reasoning and deterrence consequences of regional power nuclear strategies, this book demonstrates that these strategies matter greatly to international stability and it provides new insights into conflict dynamics across important areas of the world such as the Middle East, East Asia, and South Asia.
Vipin Narang identifies the diversity of regional power nuclear strategies and describes in detail the posture each regional power has adopted over time. Developing a theory for the sources of regional power nuclear strategies, he offers the first systematic explanation of why states choose the postures they do and under what conditions they might shift strategies. Narang then analyzes the effects of these choices on a state's ability to deter conflict. Using both quantitative and qualitative analysis, he shows that, contrary to a bedrock article of faith in the canon of nuclear deterrence, the acquisition of nuclear weapons does not produce a uniform deterrent effect against opponents. Rather, some postures deter conflict more successfully than others.

Stepping back from the brink: Why multilateral regulation of autonomy in weapons systems is difficult, yet imperative and feasible
This article explains why regulating autonomy in weapons systems, entailing the codification of a legally binding obligation to retain meaningful human control over the use of force, is such a challenging task within the framework of the United Nations Convention on Certain Conventional Weapons. It is difficult because it requires new diplomatic language, and because the military value of weapon autonomy is hard to forego in the current arms control winter. The article argues that regulation is nevertheless imperative, because the strategic as well as ethical risks outweigh the military benefits of unshackled weapon autonomy. To this end, it offers some thoughts on how the implementation of regulation can be expedited.

Inadvertent escalation in the age of intelligence machines: A new model for nuclear risk in the digital age

Will AI-enabled capabilities increase inadvertent escalation risk? This article revisits Cold War-era thinking about inadvertent escalation to consider how Artificial Intelligence (AI) technology (especially AI augmentation of advanced conventional weapons) through various mechanisms and pathways could affect inadvertent escalation risk between nuclear-armed adversaries during a conventional crisis or conflict. How might AI be incorporated into nuclear and conventional operations in ways that affect escalation risk? It unpacks the psychological and cognitive features of escalation theorising (the security dilemma, the ‘fog of war’, and military doctrine and strategy) to examine whether and how the characteristics of AI technology, against the backdrop of a broader political-societal dynamic of the digital information ecosystem, might increase inadvertent escalation risk. Are existing notions of inadvertent escalation still relevant in the digital age? The article speaks to the broader scholarship in International Relations – notably ‘bargaining theories of war’ – that argues that the impact of technology on the cause of war occurs through its political effects, rather than tactical or operational battlefield alterations. In this way, it addresses a gap in the literature about the strategic and theoretical implications of the AI-nuclear dilemma.

Regulating Weapons: An Aristotelian Account

Regulating war has long been a concern of the international community. From the Hague Conventions to the Geneva Conventions and the multiple treaties and related institutions that have emerged in the twentieth and twenty-first centuries, efforts to mitigate the horrors of war have focused on regulating weapons, defining combatants, and ensuring access to the battlefield for humanitarians. But regulation and legal codes alone cannot be the end point of an engaged ethical response to new weapons developments. This short essay reviews some of the existing ethical works on lethal autonomous weapon systems (LAWS), highlighting how rule- and consequence-based accounts fail to provide adequate guidance for how to deal with them. I propose a virtue-based account, which I link up with an Aristotelian framework, for how the international community might better address these weapons systems.

Mapping the Lethal Autonomous Weapons Debate: An Introduction

The UN Convention on Certain Conventional Weapons (CCW) can, on the one hand, be considered vital for the global governance process—in the sense of urging international cooperation on the ethical, developmental, and standards aspects of lethal autonomous weapon systems (LAWS). On the other hand, the CCW may also embody a global trend that does not augur well for international solidarity, namely the lack of credible and comprehensive collaboration to advance global objectives of peace and security. In 2022, a majority of the 125 nations that belong to the CCW requested limits on a specific type of lethal autonomous weapons: “killer robots.” Yet, most of the major global powers—namely the United States, Russia, and China—opposed not only a ban on LAWS but also on any restrictions on the development of these weapons, not least because the United States, Russia, and China are actively developing this weapons technology. While there is currently much focus on the technological evolution of LAWS, less has been written about how ethical values can exert influence on a growing global consciousness around factors such as power, technology, human judgment, accountability, autonomy, dehumanization, and the use of force. This introduction lays the groundwork for dealing with these issues. It does so by showing that all these factors warrant a pluralist approach to the global governance of LAWS, based on multiple grounds, including the military, tech, law, and distinctive theoretical-ethical orientations; the rationale being to combine this expertise into a collection for publication. Reflecting the contributing authors’ firsthand experiences of the ethics surrounding the management of LAWS to address decisive and critical questions at an expert level, it provides a framing for the collection, showing that the use of international legal mechanisms like the CCW are crucial to considering both the potential and the limits of LAWS, as well as what it can contribute to areas such as international law, human rights, and national security.
