Cet article vise à étudier le monde du travail migrant à travers l’analyse des sources judiciaires produites par la section du bâtiment du conseil de prud’hommes du département de la Seine dans l’entre-deux-guerres. L’objectif est de comprendre si les étrangers revendiquaient les droits sociaux progressivement introduits dans la législation française à cette époque. Qui étaient les travailleurs italiens qui se tournent alors vers les prud’hommes ? Quelles étaient les revendications à la base de leur action judiciaire ? Pour répondre à ces questions, les sources judiciaires sont ici étudiées à travers des méthodologies quantitatives utilisées très rarement jusqu’à maintenant dans les recherches sur la justice civile et commerciale.

Prava koja pridonose zdravlju i dobrobiti pomoraca
Radno pravni (i socijalno pravni) status pomoraca je, u svemu, specifičan (poseban) radni odnos, uređen heteronomnim i autonomnim pravnim normama, odnosno propisima različitog imena (naziva), adresanata (donosioca propisa), univerzalnog, regionalnog i nacionalnog karaktera, različitog sadržaja, postupka donošenja, prostornog i vremenskog važenja. U ovom radu piše se o prehrani, smještaju, posteljini, udobnosti i drugim pravima pomoraca kako ih uređuje Konvencija o radu pomoraca (prihvaćena na Glavnoj konferenciji (skupštini) Međunarodne organizacije rada, održanoj 23. veljače 2006. godine i kako je dopunjena 2014., 2016. i 2018. godine) te Kolektivnim ugovorom za hrvatske pomorce na brodovima u međunarodnoj plovidbi (2023. - 2024.); (N.N., br. 21/2023. od 22. veljače 2023.). Sva propisana prava čine uvjete rada pomoraca i sadržaj sigurnosti i zaštite zdravlja na radu te dobrobiti pomoraca. L’extension de la négociation collective pendant la première moitié du xxe siècle accompagne la généralisation des grilles de salaires suivant la qualification du travail. Ces dernières représentent un acquis ambigu pour les ouvrières. L’élaboration des grilles rend visible la variété et la qualification des tâches exécutées par les femmes. Elle coïncide avec une politique de revalorisation salariale qui permet de réduire l’écart avec les salaires masculins. Mais elle entérine également les frontières sexuelles de la division du travail. L’examen des négociations entreprises laisse voir le jeu complexe des stratégies déployées par les acteurs impliqués dans la définition et l’évaluation de la qualification. L’État et les syndicats ouvriers ne s’engagent que tardivement dans la promotion de la qualification féminine. Gender, Collective Agreements and Skill in Early xxth-century French IndustryThe development of collective bargaining during the first half of the twentieth century led to the generalization of wage grids based on the qualification of work. This represented an equivocal gain for women. The elaboration of grids revealed the diversity and the value of jobs occupied by women. They coincided with an economic policy focused on raising low wages, which led to a reduced wage differential with men. But classification grids also institutionalized job segregation by gender. Close examination of the negotiations reveals the complex strategies developed by actors involved in the definition and the evaluation of skill. The state and the unions provided tardy support to the recognition of women’s skills.
