Counsel for [Cory Daniel Dumais] said Dumais was travelling from one private property to another, but had to cross the highway. Judge J.A. Hunter ordered Dumais to pay a $1,000 fine, plus a surcharge. Dumais was also sentenced to a two year driving prohibition, consecutive to the current prohibition.

Cory Daniel Smearer, 22, formerly of Belledune and now living in Moncton, faces a host of charges, the most serious being impaired driving causing death, following an incident in Balmoral on the afternoon of Sept. 4. He is alleged to have been impaired and the driver of a car that left the road and crashed into a utility pole. That accident killed Nadine Bujold, 36, a teacher at Academie Notre Dame in Dalhousie and also injured another female passenger as well as Smearer.

Cory Daniel Smearer, 22, appeared in Campbellton Provincial Court for the third time since the accident in Balmoral on Sept. 2 that sent the three people, in the car Smearer is alleged to have been driving, to hospital. He escaped with minor injuries, as did a 22-year-old back seat passenger. After hearing the evidence, [Steven Hutchinson] put over his decision until that afternoon, where he told Smearer he was rejecting his application for bail. The next morning, Sept. 19, Smearer elected trial by judge alone in Court of Queen's Bench and pleaded not guilty to all eight charges.
