Flush Times and Fever Dreams
In 1834 Virgil Stewart rode from western Tennessee to a territory known as the \"Arkansas morass\" in pursuit of John Murrell, a thief accused of stealing two slaves. Stewart's adventure led to a sensational trial and a wildly popular published account that would ultimately help trigger widespread violence during the summer of 1835, when five men accused of being professional gamblers were hanged in Vicksburg, nearly a score of others implicated with a gang of supposed slave thieves were executed in plantation districts, and even those who tried to stop the bloodshed found themselves targeted as dangerous and subversive. Using Stewart's story as his point of entry, Joshua D. Rothman details why these events, which engulfed much of central and western Mississippi, came to pass. He also explains how the events revealed the fears, insecurities, and anxieties underpinning the cotton boom that made Mississippi the most seductive and exciting frontier in the Age of Jackson. As investors, settlers, slaves, brigands, and fortune-hunters converged in what was then America's Southwest, they created a tumultuous landscape that promised boundless opportunity and spectacular wealth. Predicated on ruthless competition, unsustainable debt, brutal exploitation, and speculative financial practices that looked a lot like gambling, this landscape also produced such profound disillusionment and conflict that it contained the seeds of its own potential destruction. Rothman sheds light on the intertwining of slavery and capitalism in the period leading up to the Panic of 1837, highlighting the deeply American impulses underpinning the evolution of the slave South and the dizzying yet unstable frenzy wrought by economic flush times. Local matters : race, crime, and justice in the nineteenth-century South
Much of the current reassessment of race, culture, and criminal justice in the nineteenth-century South has been based on intensive community studies. Drawing on previously untapped sources, the nine original papers collected here represent some of the best new work on how racial justice can be shaped by the particulars of time and place. Although each essay is anchored in the local, several important larger themes emerge across the volume--such as the importance of personality and place, the movement of former slaves from the capriciousness of "plantation justice" to the (theoretically) more evenhanded processes of the courts, and the increased presence of government in daily aspects of American life. Local Matters cites a wide range of examples to support these themes. One essay considers the case of a quasi-free slave in Natchez, Mississippi--himself a slaveowner--who was "reined in" by his master through the courts, while another shows how federal aims were subverted during trials held in the aftermath of the 1876 race riots in Ellenton, South Carolina. Other topics covered include the fear of black criminality as a motivation of Klan activity; the career of Thomas Ruffin, slaveowner and North Carolina Supreme Court Justice; blacks and the ballot in Washington County, Texas; the overturned murder conviction of a North Carolina slave who had killed a white man; the formation of a powerful white bloc in Vicksburg, Mississippi; agitation by black and white North Carolina women for greater protections from abusive white male elites; and slaves, crime, and the common law in New Orleans. Together, these studies offer new insights into the nature of law and the fate of due process at different stages of a highly racialized society.
Freebooters and Smugglers
In 1891 a young W. E. B. DuBois addressed the annual American Historical Association on the enforcement of slave trade laws: \"Northern greed joined to Southern credulity was a combination calculated to circumvent any law, human or divine.\" One law in particular he was referring to was the Abolition Act of 1808. It was specifically passed to end the foreign slave trade. However, as Ernest Obadele-Starks shows, thanks to profiteering smugglers like the Lafitte brothers and the Bowie brothers, the slave trade persisted throughout the south for a number of years after the law was passed. Freebooters and Smugglers examines the tactics and strategies that the adherents of the foreign slave trade used to challenge the law. It reassesses the role that Americans played in the continuation of foreign slave transshipments into the country right up to the Civil War, shedding light on an important topic that has been largely overlooked in the historiography of the slave trade.
