The main area of interest of this paper focuses on the rector’s area of competence in disciplinary procedures in the case of academic teachers. This paper is an attempt to characterize and assess the rector’s competence as far as disciplinary responsibility of an academic teacher is concerned. The attempt to evaluate the controlling mechanism of the rector’s legal decisions was also undertaken. The legal range of the rector’s disciplinary competence is relevant from the point of view of the correct and effective decision making with regards to public higher education institution duties.

Odnos kaznenog i disciplinskog postupka

Situacije u kojima određena osoba istom radnjom ostvari obilježjakaznenog i disciplinskog djela nisu rijetke i donose sa sobom cijeli nizinteresantnih i važnih proceduralnih pitanja. U radu se stoga analiziraniz pitanja, od različite svrhe i vođenja usporednih postupaka, eventualneobveze disciplinskog suda da zastane s postupanjem do okončanjakaznenog postupka ili odluku donese na temelju činjenica utvrđenihu kaznenom postupku, različitih prava osoba i pravila po kojimase ti postupci vode, pa sve do pitanja korištenja dokaza iz kaznenogpostupka u disciplinskom postupku te utjecaja kaznene osude na radnopravnistatus zaposlenika mimo disciplinskog postupka. Iznimno jezanimljivo i pitanje mogućnosti primjene načela kaznenog postupkau disciplinskom postupku, odnosno primjene konvencijskih odredabao pravičnom postupku u tim postupcima. Rad se bavi samo pitanjemdisciplinskih postupka prema državnim službenicima i pravosudnimdužnosnicima, dok je vođenje postupaka prema ostalim kategorijamaosoba izostavljeno zbog ograničenja opsega rada. U radu se analizirasudska praksa hrvatskih sudova i Europskog suda za ljudska prava testajališta pravne doktrine. Sadržan je i kratak prikaz komparativnogzakonodavstva, s posebnim osvrtom na pravna rješenja u Saveznoj RepubliciNjemačkoj, iz kojih je razvidan i donekle različit pristup tompitanju u različitim pravnim sustavima, koji baštine i različitu tradiciju. Situations in which a certain person commits the same act as a criminal and disciplinaryoffence are not rare and bring with them a whole series of interesting and important proceduralissues. The paper therefore analyses a number of these issues, starting from the differentpurposes and conduct of parallel proceedings, the possible obligation of the disciplinary courtto stay proceedings until the criminal proceedings are concluded, or to make a decision basedon the facts established in the criminal proceedings. Furthermore, the subject of the analysisis also the various rights of persons and the rules according to which these proceedings areconducted, then the issue of using evidence from the criminal proceedings in the disciplinaryproceedings, and the impact of a criminal conviction on the employment status of employeesoutside the disciplinary proceedings. The question of the possibility of applying the principlesof criminal proceedings in disciplinary proceedings, or the application of the Convention provisionson a fair trial in these proceedings, is also extremely interesting. The paper deals onlywith the issue of disciplinary proceedings against civil servants and judicial officials, while theconduct of proceedings against other categories of persons is omitted due to the limitations ofthe scope of the paper. The paper analyses the case law of Croatian courts and the EuropeanCourt of Human Rights and the positions of legal doctrine. A brief presentation of comparativelegislation is also included, with a special focus on legal solutions in the Federal Republic ofGermany, where a somewhat different approach to this issue is evident.
