Digitized Rights as an Electronic and Virtual Fiction for the Legal Support for the Turnover of Subjective Claims
Introduction: the paper examines the legal nature of such new categories as “digital rights”, “utilitarian digital rights”, “digital financial assets” and “digital currency”. The correlation of these phenomena with each other is clarified from the standpoint of modern civil turnover. The purpose of the study is to analyze the legally significant features of the above phenomena. Methods: the methodological framework for the study is a set of methods of scientific knowledge, among which the main ones are analysis, synthesis, generalization and comparative law. Results: the author’s position justified in the work is based on the legislation and the opinions of the competent scientists on the issues of clarifying the legal essence of the above-mentioned categories from the standpoint of civil law. Conclusions: the author suggests considering “digital rights”, “utilitarian digital rights”, “digital financial assets” not only from the standpoint of objects of civil rights, but also from the standpoint of the original digital form of fixing property rights. It is proposed to introduce the category “digitized rights” into the legal lexicon as a kind of fiction used to ensure the operability of the legal mechanism that mediates the turnover of subjective claims in the electronic and virtual environment.
Enabling mechanisms in business venturing of maritime autonomous technologies
Enabling factors for the commercialization of maritime autonomous technologies (MAT) have previously been identified in the literature: Digitalization, environmental requirements, changes in regulations and crew shortage, amongst others. We utilize a recently developed theoretical framework, the External Enabler Framework (EEF) from Per Davidsson, for clarifying enabling factors, enabling mechanisms, and their characteristics, and how they affect business venturing related to MAT. This paper relates to the Norwegian capacity-building project MIDAS, funded by the Norwegian Research Council. The data is from a survey with a hundred respondents from the Norwegian maritime industries, conducted in September 2023. When comparing the EEF framework with our survey data, we identify four out of eight enabling factors and three out of nine mechanisms to be relevant for MAT. Comments are given on the applicability of EEF to such a complex industry sector as the maritime sector.
From Dust to Digital
\"Much of worldâ s documentary heritage rests in vulnerable, little-known and often inaccessible archives. Many of these archives preserve information that may cast new light on historical phenomena and lead to their reinterpretation. But such rich collections are often at risk of being lost before the history they capture is recorded. This volume celebrates the tenth anniversary of the Endangered Archives Programme at the British Library, established to document and publish online formerly inaccessible and neglected archives from across the globe. From Dust to Digital showcases the historical significance of the collections identified, catalogued and digitised through the Programme, bringing together articles on 19 of the 244 projects supported since its inception. These contributions demonstrate the range of materials documented â including rock inscriptions, manuscripts, archival records, newspapers, photographs and sound archives â and the wide geographical scope of the Programme. Many of the documents are published here for the first time, illustrating the potential these collections have to further our understanding of history.\"
Enterprise digital transformation and production efficiency: mechanism analysis and empirical research
In the post-industrial period, traditional Chinese enterprises are facing the awkward situation of being 'big but not strong', with their core technologies being controlled by others. The digital transformation of enterprises has not only reshaped business models and industrial boundaries, but also boosted the high-quality development of China's economy. This paper reviews the existing literature and discovers that digital technology promotes enterprise production efficiency through cost reduction, efficiency improvement, and innovation. Based on the data of listed manufacturing companies in the Shanghai and Shenzhen stock exchanges from 2009 to 2017, this paper constructs a differences in differences (DID) model to empirically study the relationship between digital transformation and production efficiency. The results revealed that the implementation of digital transformation plays a significant role in promoting economic benefits and the results of the lag regression method are still robust. Based on this, combined with the actual situation of Chinese enterprises, this paper proposes countermeasures and suggestions to promote the development of enterprise digital transformation. The conclusion is of great significance for Chinese enterprises to occupy a dominant position in the new wave of global industrial revolution.
Digitisation of franchising supply chain impact on franchisor performance: a longitudinal case study of a coffee retail chain
PurposeFranchising contributes significantly to national economies but is overlooked in supply chain literature. This study aims to contribute to the franchising and supply chain literature by examining how the digitisation of the franchising supply chain improves firm performance.Design/methodology/approachA single longitudinal case study approach was selected to investigate how a leading coffee brand digitised its franchising supply chain. Resource constraints theory and agency theory provide the theoretical framework. Data collection included both qualitative and quantitative data. Over two years, chronological, supply chain and thematic analyses and interpretation uncovered important findings and developed four research propositions.FindingsFindings show that digitisation can impact performance in eight areas: Resource management, Resource constraints, Efficiency, Business-to-Business (B2B)/Business-To-Customer (B2C) links, Rapid expansion, Risk mitigation, Information asymmetries and Faster supply chain responses. Four digital technologies (advanced analytics, Internet of Things, Autonomous Mobile Robots and B2B e-shop) impacted three franchisor functions (Machine maintenance, Inventory management, Franchisee and end-customer relations). The study develops four research propositions on how digitisation impacts performance in terms of (1) resource monitoring and control, (2) learning and knowledge creation, (3) coordination and collaboration and (4) competition.Originality/valueFranchising supply chains have been overlooked in the literature; this study provides insights into using resource constraints theory and agency theory complementarily to explain supply chain digitisation and provides actionable practical implications for selecting, implementing and continuously improving Industry 4.0 technologies in franchising supply chains.
Digitisation of Cadastral Procedures in Burkina Faso: Land Issues and Rationalisation Tensions
This study examines the digitalisation of cadastral procedures in Burkina Faso, focusing on the municipalities of Ouagadougou and Bobo-Dioulasso where these initiatives are currently implemented. Using the concept of rationalisation tension within a qualitative methodological framework, we analyse the concrete actions undertaken and the tensions generated by this digitalisation process. Our findings reveal that cadastral digitalisation encompasses surveying documentation, parcel mapping, building records, archival materials, and the deployment of socio-technical management systems. The analysis identifies key rationalisation tensions, particularly the disconnect between digitalisation objectives and available resources, as well as coordination challenges amongst state technical services. Whilst digitalisation holds transformative potential for cadastral management, our research demonstrates that technological solutions alone cannot address underlying structural issues or resolve conflicts arising from stakeholder strategies.
