Revisiting the punitiveness of deportation
Immigration measures such as deportation are currently not regarded as punitive and there has been little exploration of this from a legal perspective. This paper will consider this issue in depth, covering little discussed case law from the European Court of Human Rights. It will also explore how this legal position on deportation does not reflect the findings of other disciplines such as criminology and sociology on how immigration measures are used and experienced as punitive. This paper will build on existing literature by demonstrating the significance of a recent development in UK law to this debate. Section 47 of the Nationality and Borders Act 2022 (NBA 2022) introduced a ‘stop the clock’ provision into the Early Removal Scheme for foreign national prisoners. This new provision may prompt the judiciary to revisit the question of whether deportation is punitive in some contexts.
The Eternal Paddy
In The Eternal Paddy , Michael de Nie examines anti-Irish prejudice, Anglo-Irish relations, and the construction of Irish and British identities in nineteenth-century Britain. This book provides a new, more inclusive approach to the study of Irish identity as perceived by Britons and demonstrates that ideas of race were inextricably connected with class concerns and religious prejudice in popular views of both peoples. De Nie suggests that while traditional anti-Irish stereotypes were fundamental to British views of Ireland, equally important were a collection of sympathetic discourses and a self-awareness of British prejudice. In the pages of the British newspaper press, this dialogue created a deep ambivalence about the Irish people, an ambivalence that allowed most Britons to assume that the root of Ireland’s difficulties lay in its Irishness. Drawing on more than ninety newspapers published in England, Scotland, and Wales, The Eternal Paddy offers the first major detailed analysis of British press coverage of Ireland over the course of the nineteenth century. This book traces the evolution of popular understandings and proposed solutions to the \"Irish question,\" focusing particularly on the interrelationship between the press, the public, and the politicians. The work also engages with ongoing studies of imperialism and British identity, exploring the role of Catholic Ireland in British perceptions of their own identity and their empire.
Distance Education for Dutch Citizens Detained Abroad: A Mixed-Methods Case Study of the Foundation ‘Education behind Foreign Bars’
Foreign national prisoners have less educational opportunities than national prisoners. Therefore, the Dutch foundation ‘Education behind Foreign Bars’ (Eabt) provides distance education to Dutch nationals detained abroad. A mixed-methods case study is carried out to gain insight into the perspective of professionals and volunteers who are involved with Eabt and of the students taking a course from Eabt. This study consists of individual interviews with volunteers and professionals and pre- and post-surveys among students. The qualitative results show that following a course from Eabt happens in three steps: (1) Informing, (2) applying for the course, and (3) starting with the course, doing homework, and being assessed. During the course, students receive motivational and content-related support from the Netherlands and, depending on the local prison context, also from the detaining country. The professionals and volunteers identify various success factors and challenges of Eabt. The quantitative results demonstrate that students are primarily motivated to participate by their wish to acquire knowledge and skills and to prepare for life after detention. The students are satisfied about the support received and they seem to have more confidence in the future due to the course. Overall, Eabt is highly valued by both students, professionals, and volunteers.
Internationalisation and migrant academics
Internationalisation is a dominant policy discourse in the field of higher education today, driven by an assemblage of economic, social and educational concerns. It is often presented as an ideologically neutral, coherent, disembodied, knowledge-driven policy intervention-an unconditional good. Mobility is one of the key mechanisms through which internationalisation occurs, and is perceived as a major form of professional and identity capital in the academic labour market. Yet, questions remain about whether opportunity structures for mobility are unevenly distributed among different social groups and geopolitical spaces. While research studies and statistical data are freely available about the flows of international students, there is far less critical attention paid to the mobility of academics. Drawing on semi-structured interviews with 14 migrant academics from diverse ethnic backgrounds, including Roma and Latin American communities, and the theoretical framings of the new mobility paradigm and cognitive and epistemic justice, this article explores some of the hidden narratives of migrant academics' engagements with mobility in the global knowledge economy. It concludes that there is a complex coagulation of opportunities and constraints. While there are many gains including transcultural learning, enhanced employability and inter-cultural competencies, there are also less romantic aspects to mobility including 'otherness', affective considerations such as isolation, and epistemic exclusions, raising questions about whose knowledge is circulating in the global academy. How do international faculty at Japanese universities view their integration?
The purpose of the study is to explore how international faculty at Japanese universities view their integration. An exploratory study of semi-structural interviews with 40 full-time international faculty hired in Japanese universities with various backgrounds was conducted. The key findings indicate that international faculty perceived their integration as a beneficial longstanding two-way process of acquiring equality, developing engagement, and forming a feeling of attachment towards Japan. Meanwhile, their actual practices towards their integration appear to be diverse, which can be summarized into three broad categories, namely, preventive, occasional, and promotional. The study suggests a disjunction between international faculty’s attitudes and their actual practices towards their integration, which is influenced by the overall host environment from a macro perspective, work role from a meso perspective, and personal intention, origin of country, and previous experience in Japan from a micro perspective. Theoretical and practical implications drawn from the key findings are provided to not only better understand the integration of international faculty at Japanese universities, but also to better serve and support them in practice.
Faculty research productivity: differences between foreign and local doctoral degree holders in Pakistan
The presence of foreign doctoral degree holders has significantly been increasing in Pakistani public universities. Despite their increasing presence and significance in universities, they have been ignored in higher education literature, notably the absence of empirical studies exploring their research productivity. This study aimed to explore research productivity differences between foreign and local doctoral degree holders and determine the factors (demographic, individual, and institutional) that contribute to their research productivity. Data were collected from 14 Pakistani public universities through a self-administered questionnaire using a systematic random sampling method. A total of 241 questionnaires were returned, among which 232 well-filled and completed questionnaires (foreign (119) and local (113), respectively) were used for analysis. The findings showed that foreign doctoral degree holders were not more productive in terms of total refereed journal articles and book chapters than local doctoral degree holders. However, foreign doctoral degree holders had published statistically significant research articles in international journals with impact factors and published more research articles with international colleagues than their local doctoral counterparts. Moreover, the findings showed that unlike the institutional factors, demographic and individual factors had significantly contributed to faculty research productivity in Pakistani public universities. Further implications are discussed, and suggestions for future research are outlined.
Intercultural adjustment of internationally mobile academics working in Thailand
Non-nationals constitute up to a quarter of the academic staff workforce of Higher Education Institutions (HEIs) worldwide. Their motivations to ‘work abroad’, and their experiences of doing so, are, however, under-researched, especially where migration is to or within the global South. We report a study conducted among internationally mobile academics from a variety of countries working in Thailand. At policy level, Thailand aspires to increase the numbers of international staff and students in its HEIs, but with mixed success in terms of recruitment levels and the reported quality of the experience among these migrants. Conceptually, our study drew on a framework of intercultural adjustment defined as a multidimensional construct comprising psychological, sociocultural and professional/work aspects of the experience. Semi-structured focus groups were conducted to explore experiences of working in Thailand. Thematic analysis of findings showed that reported experiences mainly fell under the category of professional/work aspects of intercultural adjustment, although sociocultural issues were also important. The reported quality of experiences was mixed and generally more negative than positive in the key areas of professional and work adjustment. Specific challenges highlighted by participants related to issues with the work environment, most especially lingual-cultural problems and, crucially, a lack of secure status. We detail and discuss these findings and present recommendations for policy makers and HEIs, aspirant academic migrants, and for future research into global academic migration, particular as it relates to Thailand and other destinations for academic migration.
Towards an actor-centered typology of internationalization: a study of junior international faculty in Japanese universities
This paper offers new qualitative insights into ongoing internationalization processes in Japanese higher education. Drawing on ideas from migration studies and informed by analysis of junior international faculty members’ (JIFs) experiences in Japanese universities, we posit a novel, actor-centered typology of internationalization that delineates between integration, assimilation, and marginalization of mobile actors, and considers their implications in practice. Twenty-three interviews were conducted with JIFs from a variety of disciplines and institutions across Japan. Findings indicated a pattern of disillusionment with their role in internationalization, as many perceived themselves to be tokenized symbols of internationalization rather than valued actors within it. Participants identified various barriers which prevented them from participating in the academic “mainstream” and confined them to peripheral roles. We argue that their experiences are indicative of assimilative and marginalizing forms of internationalization, which pose persistent barriers to reform in Japanese universities despite decades of state-sponsored internationalization.
Reverse flow in academic mobility from core to periphery: motivations of international faculty working in Kazakhstan
Through expanding flows of labor and knowledge on a global scale, academics are increasingly mobile as higher education institutions compete for talent that transcends borders. However, talent often flows from the periphery to the core as scholars seek out employment in recognized institutions of higher learning in developed economies. This study examines faculty mobility in a reverse direction: from the core to Kazakhstan, the largest country in Central Asia. What factors persuade faculty members to relocate to Kazakhstan for full-time employment? What types of individuals pursue this relocation? Through interviews with international faculty members based in Kazakhstan, the study identifies push factors that trigger departure from one's previous country of residence: job market, unsatisfactory work conditions, age, and marital status. Alternatively, Kazakhstan attracts scholars via pull factors that include salary, sense of adventure, and the opportunity to build new institutions and programs as well as conduct research. Unlike previous studies that highlight boundaryless mobility and individual agency, this study reveals constraints that mediate international faculty mobility. Furthermore, salary plays a limited role as a pull factor particularly among early career academics who are seeking research opportunities and meaningful contributions in building new academic programs and institutions.
