Declaration of the unconstitutionality of the Article 164 (1) Civil Code provisions has determined the adoption, with an unjustified delay, of the Law No 140/2022 on some protection measures for people with intellectual and psychosocial disabilities and the modification and completion of some normative acts, which establish assistance for the conclusion of legal acts, judicial counseling and special guardianship, as well as a clear and flexible procedure for the establishment of these protection measures. As by Article 24 of the Law No 140/2022 the legislator imposed on the National Authority for the Protection of the Rights of Persons with Disabilities and the Superior Council of the Magistracy obligations aimed at assessing the impact of this normative act, accompanied by possible proposals for its improvement, it is obvious that the legislator itself did not exclude that his legislative work does not constitute the masterpiece in the field. In this context, the present approach is intended to continue to emphasize, by the doctrine, some shortcomings of the Law No 140/2022 and to already propose a genuine reform in the matter. In the spirit of respecting the right to dignity of the persons with severe intellectual and psychosocial disabilities, a right that requires that a person who has acquired by law a full capacity of exercise should not be subjected to the degrading treatment of losing, totally or partially, this capacity, in the following we propose to be introduced, in the matter of capacity of exercise, the institutions of assisted capacity of exercise and of supervised capacity of exercise. Consequently, it required either the replacement of the institution of guardianship with the existing one, that of the personal assistant, as the case may be, of the professional personal assistant, or a specialization in the matter of guardianship, for such persons, of the sort of administrative guardianship.

One of the measures employed to protect an individual is guardianship. Legal norms treat guardianship aimed at protecting a person with full capacity of exercise in certain special situations in a different way than they do guardianship for minors or persons placed under interdiction. While guardianship for capable persons is governed by the rules of mandate, guardianship for minors and persons placed under judicial interdiction are subject to rules applicable to custody for minors (art. 171 of the New Civil Code). As follows, we shall analyse the legal provisions established by the New Civil Code in the case of guardianship for capable persons, emphasising novelty elements as compared to the previous regulation.

Exploring the Identities and Educational Experiences of Children Under Special Guardianship Orders (Sgos)

Special Guardianship Orders (SGOs) were introduced in 2005 as an alternative form of permanent placement for children requiring out-of-home care. To date the majority of SGOs go to family or friends, thus it is a type of formalised and regulated kinship care. Despite the increasing need and reliance on kinship care, the potential protective and risk factors of kinship care, the similarity of needs between children under SGO and other care experienced children and the support they may require during their educational journey, there is a dearth of research exploring this population of children and young people. This study aimed to explore the views of young people under SGO, special guardians and the wider professional network in relation to the identity and educational experiences of children under SGO. This included an exploration of supportive factors, challenges and how they could be better supported across the different eco-systems. This qualitative design used semi-structured interviews with young people under SGO (n=2), special guardians (n= 3) and wider professional networks (n= 10). Data was analysed using reflective thematic analysis. Thematic analysis from interviews elicited six themes: conflicted identities; stigmatisation of the SGO family; unsupportive systems; attachment friendly schools; sense of belonging and characteristics of the SGO. Implications include raising the profile of SGO families by increasing awareness and recognition about the unique challenges faced by these young people and their guardians in schools and among professionals, and how they could be supported to have positive educational experiences. It is hoped that by sharing awareness and understanding of children under SGO and their families, outcomes for these children and young people can be improved.

BUILDING A STRATEGIC PARTNERSHIP: TURNING CHALLENGES INTO OPPORTUNITIES

Abstract
The University of North Georgia’s Institute for Healthy Aging (IHA) and the Georgia Department of Human Services, Division of Aging Services (DAS), have partnered to address critical workforce needs in the program areas of Elder Abuse, Neglect and Exploitation and Public Guardianship. Working together they have aligned requirements a new University System of Georgia degree, the Nexus degree, with the educational and experiential requirements of employment in these DAS program areas. The University System of Georgia’s Nexus Degree, a new academic credential and the first new degree program in the United States since the 1890s when the associate’s degree was added, was designed to help more Georgians access careers in high demand areas. Creation of this degree is in direct response to talent demand analysis with employers in high demand career areas. The Division of Aging Services faces many challenges that hamper finding and retaining the right workers for the difficult but rewarding roles in Adult Protective Services and Public Guardianship. This presentation will outline the DAS needs and UNG academic program, and how working together to meet the needs of at-risk elders, a direct pipeline to employment has been developed. This paper will discuss and provide insight into this unique collaboration and newly created training approach.
