First peoples in a new world

It would seem unlikely that one could discover tolerant religious attitudes in Spain, Portugal, and the New World colonies during the era of the Inquisition, when enforcement of Catholic orthodoxy was widespread and brutal. Yet this groundbreaking book does exactly that. Drawing on an enormous body of historical evidence-including records of the Inquisition itself-the historian Stuart Schwartz investigates the idea of religious tolerance and its evolution in the Hispanic world from 1500 to 1820. Focusing on the attitudes and beliefs of common people rather than those of intellectual elites, the author finds that no small segment of the population believed in freedom of conscience and rejected the exclusive validity of the Church.
The book explores various sources of tolerant attitudes, the challenges that the New World presented to religious orthodoxy, the complex relations between \"popular\" and \"learned\" culture, and many related topics. The volume concludes with a discussion of the relativist ideas that were taking hold elsewhere in Europe during this era.

In March 1812, while Napoleon’s brother Joseph sat on the throne of Spain and the armies of France occupied much of the country, legislators elected from Spain and its overseas territories met in the Andalusian city of Cádiz. There, as the cornerstone of a government in exile, they drafted and adopted the first liberal constitution in the Hispanic world, a document that became known as the Cádiz Constitution of 1812.
The 1812 Constitution was extremely influential in and beyond Europe, and this collection of essays explores how its enduring legacy not only shaped the history of state-building, elections, and municipal governance in Iberian America, but also affected national identities and citizenship as well as the development of race and gender in the region.
A bold blueprint for governing a global, heterogeneous monarchy, the Constitution represented a rupture with Spain’s Antiguo Régimen (Old Regime) in numerous ways—in the limits it placed on the previously autocratic Bourbon monarchs, in the admission to its governing bodies of deputies from Spain’s American viceroyalties as equals, and in its framers’ vociferous debate over the status of castas (those of mixed ancestry) and slaves. The Rise of Constitutional Government in the Iberian Atlantic World covers these issues and adopts a transatlantic perspective that recovers the voices of those who created a vibrant political culture accessible to commoners and elite alike.
The bicentenary of the Constitution of 1812 offered scholars an excellent moment to reexamine the form and role of constitutions across the Spanish-speaking world. Constitutionalism remains a topic of intense debate in Latin America, while contemporary Spain itself continues to seek ways to balance a strong central government with centripetal forces in its regions, notably the Basque and Catalan provinces. The Slave Trade and the Origins of International Human Rights Law

There is a broad consensus among scholars that the idea of human rights was a product of the Enlightenment but that a self-conscious and broad-based human rights movement focused on international law only began after World War II. In this book, the nineteenth century's absence is conspicuous—few have considered that era seriously, much less written books on it. But as this author shows, the foundation of the movement that we know today was a product of one of the nineteenth century's central moral causes: the movement to ban the international slave trade. Originating in England in the late eighteenth century, abolitionism achieved remarkable success over the course of the nineteenth century. The author focuses in particular on the international admiralty courts, which tried the crews of captured slave ships. The courts, which were based in the Caribbean, West Africa, Cape Town, and Brazil, helped free at least 80,000 Africans from captured slavers between 1807 and 1871. Here then, buried in the dusty archives of admiralty courts, ships' logs, and the British foreign office, are the foundations of contemporary human rights law: international courts targeting states and non-state transnational actors while working on behalf the world's most persecuted peoples—captured West Africans bound for the slave plantations of the Americas.

Africans to Spanish America expands the Diaspora framework that has shaped much of the recent scholarship on Africans in the Americas to include Mexico, Peru, Ecuador, and Cuba, exploring the connections and disjunctures between colonial Latin America and the African Diaspora in the Spanish empires. While a majority of the research on the colonial Diaspora focuses on the Caribbean and Brazil, analysis of the regions of Mexico and the Andes opens up new questions of community formation that incorporated Spanish legal strategies in secular and ecclesiastical institutions as well as articulations of multiple African identities. Editors Sherwin K. Bryant, Rachel Sarah O'Toole, and Ben Vinson III arrange the volume around three themes: identity construction in the Americas; the struggle by enslaved and free people to present themselves as civilized, Christian, and resistant to slavery; and issues of cultural exclusion and inclusion. Bringing together the work of literary critics, social scientists, activists, and creative writers, this edited collection explores the complex relationships between environmental change, political struggle, and cultural production in the Caribbean. It ranges across the archipelago, with essays covering such topics as the literary representation of tropical storms and hurricanes, the cultural fallout from the Haitian earthquake of 2010, struggles over the rainforest in Guyana, and the role of colonial travel narratives in the reorganization of landscapes. The collection marks an important contribution to the fields of Caribbean studies, postcolonial studies, and ecocriticism. Through its deployment of the concept of ‘world-ecology’, it offers up a new angle of vision on the interconnections between aesthetics, ecology, and politics. The volume seeks to grasp these categories not as discrete (if overlapping) entities, but rather as differentiated moments within a single historical process. The ‘social’ changes through which the Caribbean has developed have always involved changes in the relationship between humans and the rest of nature; and these changes have long been entangled with the emergence of new kinds of cultural production. The contributors to this collection provide a series of unique insights into the relationship between aesthetic practice and specific ecological processes and pressure-points in the region. Being Together in Placeexplores the landscapes that convene Native and non-Native people into sustained and difficult negotiations over their radically different interests and concerns. Grounded in three sites-the Cheslatta-Carrier traditional territory in British Columbia; the Wakarusa Wetlands in northeastern Kansas; and the Waitangi Treaty Grounds in Aotearoa/New Zealand-this book highlights the challenging, tentative, and provisional work of coexistence around such contested spaces as wetlands, treaty grounds, fishing spots, recreation areas, cemeteries, heritage trails, and traditional village sites. At these sites, activists learn how to articulate and defend their intrinsic and life-supportive ways of being, particularly to those who are intent on damaging or destroying these places.
Using ethnographic research and a geographic perspective, Soren C. Larsen and Jay T. Johnson show how the communities in these regions challenge the power relations that structure the ongoing (post)colonial encounter in liberal democratic settler-states. Emerging from their conversations with activists was a distinctive sense that the places for which they cared had agency, a \"call\" that pulled them into dialogue, relationships, and action with human and nonhuman others. This being-together-in-place, they find, speaks in a powerful way to the vitalities of coexistence: where humans and nonhumans are working to decolonize their relationships; where reciprocal guardianship is being stitched back together in new and unanticipated ways; and where a new kind of \"place thinking\" is emerging on the borders of colonial power.
