The state and civil society : regulating interest groups, parties, and public benefit organizations in contemporary democracies
\"State regulation of civil society is expanding yet widely contested, often portrayed as illegitimate intrusion. Despite ongoing debates about the nature of state-voluntary relations in various disciplines, we know surprisingly little about why long-lived democracies adopt more or less constraining legal approaches in this sphere, in which state intervention is generally considered contentious. Drawing on insights from political science, sociology, comparative law as well as public administration research, this book addresses this important question, conceptually, theoretically, and empirically. It addresses the conceptual and methodological challenges related to developing systematic, comparative insights into the nature of complex legal environments affecting voluntary membership organizations, when simultaneously covering a wide range of democracies and the regulation applicable to different types of voluntary organizations. Proposing the analytical tools to tackle those challenges, it studies in-depth the intertwining and overlapping legal environments of political parties, interest groups, and public benefit organizations across 19 long-lived democracies. After presenting an innovative interdisciplinary theoretical framework theorizing democratic states' legal disposition towards, or their disinclination against, regulating voluntary membership organizations in a constraining or permissive fashion, this framework is empirically tested. Applying Qualitative Comparative Analysis (QCA), the comparative analysis identifies three main 'paths' accounting for the relative constraints in the legal environments democracies have created for organized civil society, defined by different configurations of political systems' democratic history, their legal family, and voluntary sector traditions\"-- Provided by publisher.
Testing Theories of American Politics: Elites, Interest Groups, and Average Citizens
Each of four theoretical traditions in the study of American politics—which can be characterized as theories of Majoritarian Electoral Democracy, Economic-Elite Domination, and two types of interest-group pluralism, Majoritarian Pluralism and Biased Pluralism—offers different predictions about which sets of actors have how much influence over public policy: average citizens; economic elites; and organized interest groups, mass-based or business-oriented. A great deal of empirical research speaks to the policy influence of one or another set of actors, but until recently it has not been possible to test these contrasting theoretical predictions against each other within a single statistical model. We report on an effort to do so, using a unique data set that includes measures of the key variables for 1,779 policy issues. Multivariate analysis indicates that economic elites and organized groups representing business interests have substantial independent impacts on U.S. government policy, while average citizens and mass-based interest groups have little or no independent influence. The results provide substantial support for theories of Economic-Elite Domination and for theories of Biased Pluralism, but not for theories of Majoritarian Electoral Democracy or Majoritarian Pluralism.
Legislative Staff and Representation in Congress
Legislative staff link Members of Congress and their constituents, theoretically facilitating democratic representation. Yet, little research has examined whether Congressional staff actually recognize the preferences of their Members’ constituents. Using an original survey of senior US Congressional staffers, we show that staff systematically mis-estimate constituent opinions. We then evaluate the sources of these misperceptions, using observational analyses and two survey experiments. Staffers who rely more heavily on conservative and business interest groups for policy information have more skewed perceptions of constituent opinion. Egocentric biases also shape staff perceptions. Our findings complicate assumptions that Congress represents constituent opinion, and help to explain why Congress often appears so unresponsive to ordinary citizens. We conclude that scholars should focus more closely on legislative aides as key actors in the policymaking process, both in the United States and across other advanced democracies.

Is It Whom You Know or What You Know? An Empirical Assessment of the Lobbying Process
Do lobbyists provide issue-specific information to members of Congress? Ordo they provide special interests access to politicians? We present evidence to assess the role of issue expertise versus connections in the US Federal lobbying process and illustrate how both are at work. In support of the connections view, we show that lobbyists follow politicians they were initially connected to when those politicians switch to new committee assignments. In support of the expertise view, we show that there is a group of experts that even politicians of opposite political affiliation listen to. However, we find a more consistent monetary premium for connections than expertise.
Coalitional Lobbying and Intersectional Representation in American Rulemaking
Interest groups representing the marginalized regularly neglect advocacy on behalf of their most vulnerable constituents—those with intersectional disadvantage. Yet, they claim that such advocacy is central to their missions. I argue that interest groups representing women, people of color, Native nations, and the poor strategically conduct intersectional advocacy through coalitional lobbying. I test this claim using a new dataset of cosignature patterns within public comments on proposed federal agency rules submitted by a set of such groups between 2004 and 2014. I find that these groups are significantly more likely to pursue intersectional advocacy in coalitions but that coalition work, alone, does not relate to influential intersectional advocacy. Rather, it is particular coalition characteristics, including organizational diversity and financial capacity, that predict such influence. I conclude that collaborative lobbying is an effective tactic for mediating representational bias in interest group advocacy and promoting more pluralistic administrative policy making.
Polarized Pluralism: Organizational Preferences and Biases in the American Pressure System
For decades, critics of pluralism have argued that the American interest group system exhibits a significantly biased distribution of policy preferences. We evaluate this argument by measuring groups’ revealed preferences directly, developing a set of ideal point estimates, IGscores, for over 2,600 interest groups and 950 members of Congress on a common scale. We generate the scores by jointly scaling a large dataset of interest groups’ positions on congressional bills with roll-call votes on those same bills. Analyses of the scores uncover significant heterogeneity in the interest group system, with little conservative skew and notable inter-party differences in preference correspondence between legislators and ideologically similar groups. Conservative bias and homogeneity reappear, however, when weighting IGscores by groups’ PAC contributions and lobbying expenditures. These findings suggest that bias among interest groups depends on the extent to which activities like PAC contributions and lobbying influence policymakers’ perceptions about the preferences of organized interests.
The Democratic Deficit in the States
We study how well states translate public opinion into policy. Using national surveys and advances in subnational opinion estimation, we estimate state-level support for 39 policies across eight issue areas, including abortion, law enforcement, health care, and education. We show that policy is highly responsive to policy-specific opinion, even controlling for other influences. But we also uncover a striking \"democratic deficit\": policy is congruent with majority will only half the time. The analysis considers the influence of institutions, salience, partisan control of government, and interest groups on the magnitude and ideological direction of this democratic deficit. We find the largest influences to be legislative professionalization, term limits, and issue salience. Partisanship and interest groups affect the ideological balance of incongruence more than the aggregate degree thereof. Finally, policy is overresponsive to ideology and party—leading policy to be polarized relative to state electorates.
Ending Discrimination Against People with Mental and Substance Use Disorders
Estimates indicate that as many as 1 in 4 Americans will experience a mental health problem or will misuse alcohol or drugs in their lifetimes. These disorders are among the most highly stigmatized health conditions in the United States, and they remain barriers to full participation in society in areas as basic as education, housing, and employment. Improving the lives of people with mental health and substance abuse disorders has been a priority in the United States for more than 50 years. The Community Mental Health Act of 1963 is considered a major turning point in America's efforts to improve behavioral healthcare. It ushered in an era of optimism and hope and laid the groundwork for the consumer movement and new models of recovery. The consumer movement gave voice to people with mental and substance use disorders and brought their perspectives and experience into national discussions about mental health. However over the same 50-year period, positive change in American public attitudes and beliefs about mental and substance use disorders has lagged behind these advances. Stigma is a complex social phenomenon based on a relationship between an attribute and a stereotype that assigns undesirable labels, qualities, and behaviors to a person with that attribute. Labeled individuals are then socially devalued, which leads to inequality and discrimination. This report contributes to national efforts to understand and change attitudes, beliefs and behaviors that can lead to stigma and discrimination. Changing stigma in a lasting way will require coordinated efforts, which are based on the best possible evidence, supported at the national level with multiyear funding, and planned and implemented by an effective coalition of representative stakeholders. Ending Discrimination Against People with Mental and Substance Use Disorders: The Evidence for Stigma Change explores stigma and discrimination faced by individuals with mental or substance use disorders and recommends effective strategies for reducing stigma and encouraging people to seek treatment and other supportive services. It offers a set of conclusions and recommendations about successful stigma change strategies and the research needed to inform and evaluate these efforts in the United States.
A Theory of Political Parties: Groups, Policy Demands and Nominations in American Politics
We propose a theory of political parties in which interest groups and activists are the key actors, and coalitions of groups develop common agendas and screen candidates for party nominations based on loyalty to their agendas. This theoretical stance contrasts with currently dominant theories, which view parties as controlled by election-minded politicians. The difference is normatively important because parties dominated by interest groups and activists are less responsive to voter preferences, even to the point of taking advantage of lapses in voter attention to politics. Our view is consistent with evidence from the formation of national parties in the 1790s, party position change on civil rights and abortion, patterns of polarization in Congress, policy design and nominations for state legislatures, Congress, and the presidency.
