Global large herbivore conservation and international law
Large wild herbivore species are important to ecosystems and human societies, but many of them are threatened and in decline. International wildlife treaties have a role to play in arresting and reversing these declines. This paper provides a global overview and analysis of relevant legal instruments and their roles regarding the conservation of the 73 largest terrestrial herbivores, i.e., those with a body mass of ≥ 100 kg. Outcomes reveal both significant positive contributions and shortcomings of the Ramsar Wetlands Convention, the World Heritage Convention, the Convention on International Trade in Endangered Species, the Convention on Migratory Species and its subsidiary instruments, the Convention on Biological Diversity, and a range of regional and bilateral treaties. Maximizing the potential of these treaties, and attaining their objectives regarding the conservation and restoration of large herbivores, requires substantial increases in funding and political will. Even before such game-changing increases occur, however, it remains worthwhile to seek and use the many opportunities that exist within the current international legal framework for enhancing the conservation of the world’s largest herbivores.
Protect the Integrity of CITES: Lessons From Japan's IWC Withdrawal to Keep Polarization From Tearing CITES Apart
Unsustainable wildlife trade is a major driver of global biodiversity loss. Effective wildlife trade governance is critical for conservation and requires international cooperation and coordination to regulate an industry valued at hundreds of billions of dollars a year. Yet, due to increasing polarization over consumptive wildlife use, certain countries have become disenfranchised by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), the primary mechanism for regulating international wildlife trade. Tensions within CITES are rising over the elephant ivory and rhino horn trade, where polarization has pushed ten Southern African Development Community countries to suggest an outright withdrawal from CITES. The denunciation of CITES by such a large and ecologically significant bloc would substantially weaken the integrity, credibility, and stature of the Convention. There is a contemporary precedent to reference: Japan left the International Whaling Commission (IWC) in 2019 due to polarization over commercial whaling. Here, we examine the common threads between these two cases: changing organizational ethos, polarization amongst members, influence of non‐state actors, and loss of decidability for dissenting nations. Taking critical lessons from Japan's IWC withdrawal, we propose various options for structural reforms in CITES to restore decidability, enable equitability, and implement inclusive decision‐making.
International law and lions (Panthera leo): understanding and improving the contribution of wildlife treaties to the conservation and sustainable use of an iconic carnivore
The lion (Panthera leo ) is featuring ever more prominently on the agendas of international wildlife treaties like the Convention on International Trade in Endangered Species (CITES) and the Convention on the Conservation of Migratory Species of Wild Animals (CMS). Lion range and numbers have declined markedly over the last two decades. In this review we assess the present role of international wildlife treaties with a view to improving their combined contribution to the conservation and sustainable use of lions. Our analysis identifies a substantial body of relevant international wildlife law and, moreover, a significant potential for enhancing the contribution to lion conservation of these global and regional treaties. The time is right to invest in such improvements, and our review renders a range of general and treaty-specific recommendations for doing so, including making full use of the Ramsar Wetlands Convention, World Heritage Convention and transboundary conservation area (TFCA) treaties for lion conservation. The CMS holds particular potential in this regard and our analysis provides strong support for listing the lion in its Appendices. Legal analysis of the CITES convention in terms of Turkish administrative and judicial processes
The main purpose of this article is to understand and measure the successful implementation of the CITES Convention by the responsible institutions and its impact on Turkish domestic law. Based on the liabilities in the CITES Convention, criteria were determined and the competence of Turkish legislation was examined. The Convention's compliance with national legislation was statistically assessed. Turkish legislation was found to be 75% compliant with the Convention. According to the court decisions of the Council of State reviewed within the scope of the study, the number of decisions directly referring to the CITES Convention was 6%, and all of these were in favor of the ecosystem. The Turkish jurisdiction does not make effective use of international conventions in environmental cases, which is a significant problem. The administrative analysis of the CITES Convention was conducted by questionnaireing 314 experts working in the national institutions implementing the Convention. Experts in the authorized institutions were divided into four groups: General Directorate of Nature Conservation and National Parks, General Directorate of Forestry, University and Other. According to the questions asked to the experts in 8 topics, the overall success level of the administrative structure is below 50%. In terms of scientific authority, this assessment concluded that the Scientific and Technological Research Council of Türkiye requires to be more active in CITES implementation procedures, strengthen its communication with institutions and continuously produce scientific data.
Global large carnivore conservation and international law
International cooperation, including through international legal instruments, appears important for the conservation of large carnivores worldwide. This is due to, inter alia, the worrying conservation status and population trends of many large carnivore species; the importance of large carnivores for biodiversity conservation at large; their occurrence at low densities, with many populations extending across various countries; and the international nature of particular threats. For the 31 heaviest species in the order Carnivora, this study (i) documents to what extent existing international legal instruments contribute to large carnivore conservation, and (ii) identifies ways of optimizing their contribution in this regard. From this dual perspective, it reviews all global wildlife conservation treaties—Ramsar Wetlands Convention, World Heritage Convention, Convention on Trade in Endangered Species, Convention on Migratory Species (CMS), Convention on Biological Diversity (CBD)—and selected regional instruments, using standard international law research methodology. Results indicate that a substantial body of relevant international law already exists, whereas simultaneously there is clear potential for enhancing the contribution of international law to large carnivore conservation. Avenues for pursuing this include promotion of instruments’ effective implementation; clarification of their precise implications for large carnivore conservation; development of formal guidance; expansion of instruments’ scope in terms of species, sites and countries; and creation of new instruments. The CMS and CBD hold particular potential in some of these respects. The experiences being gained under European legal instruments constitute an interesting ‘laboratory’ regarding human coexistence with expanding large carnivore populations and transboundary cooperation at the (sub)population level.
Global Trade in Exotic Pets 2006-2012
International trade in exotic pets is an important and increasing driver of biodiversity loss and often compromises the standards required for good animal welfare. We systematically reviewed the scientific and gray literature and used the United Nations Environment Programme - World Conservation Monitoring Centre (UNEP-WCMC) Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) trade database to establish temporal and geographical trade patterns of live exotic birds, mammals, and reptiles and to describe trends in research, taxonomic representation, and level of threat and legal protection of species traded. Birds were the most species-rich and abundant class reported in trade; reptiles were second most abundant but unusually the most studied in this context; and mammals were least abundant in trade. Mammalian and reptilian species traded as pets were more likely to be threatened than expected by random. There have been a substantial number of Appendix 1 listed captive-bred mammals and birds and wild-caught birds and reptiles reported in trade to CITES. We identified the Middle East's emerging role as a driver of demand for exotic pets of all taxa alongside the well-established and increasing role of South America and Southeast Asia in the market. Europe, North America, and the Middle East featured most heavily in trade reports to CITES, whereas trade involving South America and Southeast Asia were given most emphasis in the literature. For effective monitoring of and appropriate response to the international exotic pet trade, it is imperative that the reliability and detail of CITES trade reports improve and that scientific research be directed toward those taxa and locations that are most vulnerable. El mercado internacional de mascotas exóticas es un factor importante y creciente de pérdida de la biodiversidad y continuamente compromete los estándares requeridos para un buen bienestar animal. Sistemáticamente revisamos la literatura cientifica y gris y usamos la base de datos de mercados de UNEPWCMC CITES para establecer patrones temporales y geográficos del mercado de aves, mamíferos y reptiles exóticos vivos y describir las tendencias en la investigación, la representación taxonómica y el nivel de amenaza y la protección legal de las especies comercializadas. Las aves fueron la clase con mayor riqueza de especies y la más abundante; los reptiles fueron la segunda más abundante pero inusualmente la más estudiada en este contexto; los mamíferos fueron los menos abundantes en el mercado. Las especies de mamíferos y reptiles comercializadas como mascotas tuvieron mayor probabilidad de estar amenazadas que lo esperado por el azar. Ha babido un número sustancial de especies de mamíferos y aves criados en cautiverio y listados en el Apéndice-I de aves y reptiles capturados en vida silvestre reportados en el mercado a CITES. Identificamos el papel emergente del Oriente Medio como conductor de la demanda de mascotas exóticas de todos los taxones junto con el bien establecido y creciente papel de América del Sur y el Sureste Asiático en el mercado. Europa, América del Norte y el Oriente Medio figuraron más en los reportes de mercado bechos a CITES, mientras que al mercado en América del Sur y el Sureste Asiático se le dio más énfasis en la literatura. Para un monitoreo efectivo de y una respuesta apropiada al mercado internacional de mascotas exóticas, es imperativo que la confiabilidad y el detalle de los reportes de mercado de CITES mejoren y que la investigación científica sea dirigida hacia esos taxones y las localidades que sean más vulnerables.
Comparative transcriptome analysis identified important genes and regulatory pathways for flower color variation in Paphiopedilum hirsutissimum
Background Paphiopedilum hirsutissimum is a member of Orchidaceae family that is famous for its ornamental value around the globe, it is vulnerable due to over-exploitation and was listed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, which prevents its trade across borders. Variation in flower color that gives rise to different flower patterns is a major trait contributing to its high ornamental value. However, the molecular mechanism underlying color formation in P. hirsutissimum still remains unexplored. In the present study, we exploited natural variation in petal and labellum color of Paphiopedilum plants and used comparative transcriptome analysis as well as pigment measurements to explore the important genes, metabolites and regulatory pathways linked to flower color variation in P. hirsutissimum . Result We observed that reduced anthocyanin and flavonoid contents along with slightly higher carotenoids are responsible for albino flower phenotype. Comparative transcriptome analysis identified 3287 differentially expressed genes (DEGs) among normal and albino labellum, and 3634 DEGs between normal and albino petals. Two genes encoding for flavanone 3-hydroxylase (F3H) and one gene encoding for chalcone synthase (CHS) were strongly downregulated in albino labellum and petals compared to normal flowers. As both F3H and CHS catalyze essentially important steps in anthocyanin biosynthesis pathway, downregulation of these genes is probably leading to albino flower phenotype via down-accumulation of anthocyanins. However, we observed the downregulation of major carotenoid biosynthesis genes including VDE, NCED and ABA2 which was inconsistent with the increased carotenoid accumulation in albino flowers, suggesting that carotenoid accumulation was probably controlled at post-transcriptional or translational level. In addition, we identified several key transcription factors (MYB73, MYB61, bHLH14, bHLH106, MADS-SOC1, AP2/ERF1, ERF26 and ERF87) that may regulate structural genes involved in flower color formation in P. hirsutissimum. Importantly, over-expression of some of these candidate TFs increased anthocyanin accumulation in tobacco leaves which provided important evidence for the role of these TFs in flower color formation probably via regulating key structural genes of the anthocyanin pathway. Conclusion The genes identified here could be potential targets for breeding P. hirsutissimum with different flower color patterns by manipulating the anthocyanin and carotenoid biosynthesis pathways.
An overview of international wildlife trade from Southeast Asia
Wildlife trade is the very heart of biodiversity conservation and sustainable development providing an income for some of the least economically affluent people and it generates considerable revenue nationally. In Asia the unsustainable trade in wildlife has been identified as one of the main conservation challenges. Internationally, wildlife trade is regulated through the Convention on International Trade in Endangered Species of wild fauna and flora (CITES) to which all Southeast Asian nations are signatory. I obtained data on international trade in CITES-listed animals in the period 1998–2007. In all >35 million animals (0.3 million butterflies; 16.0 million seahorses; 0.1 million other fish; 17.4 million reptiles; 0.4 million mammals; 1.0 million birds) were exported in this period, 30 million (~300 species) of them being wild-caught. In addition 18 million pieces and 2 million kg of live corals were exported. Malaysia, Vietnam, Indonesia and China are the major exporters of wild-caught animals and the European Union and Japan are the most significant importers. Over this period exports in birds significantly decreased, trade in the other taxa either increased or remained stable. For all taxa but butterflies the vast majority of individuals represent wild-caught individuals. Records of illegal or undeclared international trade are scant but can be significantly larger than levels of official exports. It is concluded that there is an urgent need for better assessments of what levels of exploitation are sustainable (including exploring appropriate proxies for Non Detriment Findings), for initiatives to make regulatory mechanisms more effective (including the introduction of minimum mandatory standards and monitoring selected wildlife trade hubs), and for better licensing and registration. Funding for at least some of these initiatives can be obtained by imposing small levies on exports of CITES-listed wildlife.
Lions in the modern arena of CITES
Lions have often been discussed under the Convention on International Trade in Endangered Species of wild flora and fauna (CITES). While CITES decisions on species trade regimes are ostensibly based on science, species data are often inconclusive and political considerations inevitably determine outcomes. We present the context of lion conservation and the technical and political processes of CITES to illuminate how a failed uplisting proposal nonetheless resulted in an unprecedented trade restriction as well as conservation initiatives beyond the CITES trade function. We conclude on the limitations of science to guide future directions of CITES debates, leaving politics and ethics to shape decision making.
CITES‐listed sharks remain among the top species in the contemporary fin trade
Trade‐driven overexploitation threatens many sharks. Twelve of the world's most vulnerable shark species have been listed on the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) to regulate internationally traded products such as meat and dried fins. CITES records indicate that Hong Kong was the world's top legal importer of dried fins from listed sharks in 2015 (N = 8 species at that time), but traded a relatively small volume, with a few partners, in a small number of shipments (16). In contrast two CITES Appendix II listed hammerheads were consistently the fourth and fifth most common species (out of >80) in processed fin trimmings (N = 9,200) collected randomly from the Hong Kong retail dried fin market from February 2014 to December 2016 and were found in 100% of sampling events and in 66% of sampled retail vendors. This difference, and the fact that exporting nations previously known to land these species were not among those to report trade to CITES, suggest that listed species were often imported without CITES documentation in 2015. There are a number of incentives for trade hubs to meet their obligations to this treaty, which they could achieve by scaling up monitoring capacity and increasing inspection efficiency.
