The Passenger Cases and the Commerce Clause

In 1849 Chief Justice Taney's Court delivered a 5-4 decision on the legal status of immigrants and free blacks under the federal commerce power. The closely divided decision, further emphasized by the fact there were eight opinions, played a part in the increasingly contested politics over growing immigration, and the controversies about fugitive slaves and the western expansion of slavery that resulted in the Compromise of 1850.In the decades after the Civil War federal regulation of immigration almost entirely displaced the role of the states. Yet, over a century later, Justice Scalia inArizona v. USappealed to the era when states exercised greater control over who they allowed to cross their borders; a dissent which has returned the Passenger Cases to the contemporary relevance. The Passenger Cases provide a counter-history that allowed the Court to affirm federal supremacy and state-federal cooperation inArizona I(2011) andII(2012).InThe Passenger Cases and the Commerce ClauseTony Allan Freyer focuses on the antebellum Supreme Court's role prescribing state-federal regulation of immigrants, the movement of free blacks within the United States and on the origins, state court decisions, federal precedents, appellate arguments, and opinion-making that culminated in the Court's decision of thePassenger Cases. The Court's split decision provided political legitimacy for the 1850 Compromise: enactment of a stronger fugitive slave law, admission of slavery in western territories based on popular vote of residents (popular sovereignty), and the abolition of the slave trade in Washington D.C. The divided opinions in thePassenger Casesalso influenced the immigrant and slavery crises which disrupted the balance between free and slave-labor states, culminating in the Civil War. The states did indeed enact laws enabling exclusion of undesirable white immigrants and free blacks.The 5-4 division of the Court anticipated the better known, but even more divisive, views of the Justices in theDred Scottcase (1857). And in considering the post-Reconstruction evolution of new standards by which to judge immigration issues, the Passenger Cases revealed the continuing controversy over how to treat those who wish to come to our country, even as federal law came to dominate the regulation of immigration. These issues continued to complicate immigration law as much today as they did more than a century and a half ago. The persistence of these problems suggested that a \"decent respect to the opinions of mankind\" continued to demand a coherent, humane, and more consistent immigration policy.
Expelling the poor : Atlantic Seaboard states and the nineteenth-century origins of American immigration policy
\"Expelling the Poor examines the origins of immigration restriction in the United States, especially deportation policy. Based on an analysis of immigration policies in major American coastal states, including New York, Massachusetts, Pennsylvania, Maryland, Louisiana, and California, it provides the first sustained study of immigration control conducted by states prior to the introduction of federal immigration law in the late nineteenth century. The influx of impoverished Irish immigrants over the first half of the nineteenth century led nativists in New York and Massachusetts to develop policies for prohibiting the landing of destitute foreigners and deporting those already resident in the states to Europe, Canada, or other American states. No other coastal state engaged in immigration regulation with the same level of legislative effort and success as the two states. By locating the roots of American immigration control in cultural prejudice against the Irish and, more essentially, economic concerns about their poverty in nineteenth-century New York and Massachusetts, this book fundamentally revises the history of American immigration policy, which has largely focused on anti-Asian racism on the West Coast. By investigating state officials' practices of illegal removal, such as the overseas deportation of those who held American citizenship, this book reveals how the state-level treatment of destitute immigrants set precedents for the assertion by American officers of unrestricted power against undesirable aliens, which characterized later federal control, and demonstrates how American deportation policy operated as part of a broader legal culture of excluding non-producing members from societies in the north Atlantic world\"-- Provided by publisher.

2007 Winner of the Merle Curti Intellectual History Award of the Organization of American Historians, 2006 Winner of the History/Social Science Book Award of the Association of Asian American Studies How did thousands of Chinese migrants end up working alongside African Americans in Louisiana after the Civil War? With the stories of these workers, Coolies and Cane advances an interpretation of emancipation that moves beyond U.S. borders and the black-white racial dynamic. Tracing American ideas of Asian labor to the sugar plantations of the Caribbean, Moon-Ho Jung argues that the racial formation of \"coolies\" in American culture and law played a pivotal role in reconstructing concepts of race, nation, and citizenship in the United States. Jung examines how coolies appeared in major U.S. political debates on race, labor, and immigration between the 1830s and 1880s. He finds that racial notions of coolies were articulated in many, often contradictory, ways. They could mark the progress of freedom; they could also symbolize the barbarism of slavery. Welcomed and rejected as neither black nor white, coolies emerged recurrently as both the salvation of the fracturing and reuniting nation and the scourge of American civilization. Based on extensive archival research, this study makes sense of these contradictions to reveal how American impulses to recruit and exclude coolies enabled and justified a series of historical transitions: from slave-trade laws to racially coded immigration laws, from a slaveholding nation to a \"nation of immigrants,\" and from a continental empire of manifest destiny to a liberating empire across the seas. Combining political, cultural, and social history, Coolies and Cane is a compelling study of race, Reconstruction, and Asian American history.
Chinese in the Woods

Though recognized for their work in the mining and railroad industries, the Chinese also played a critical role in the nineteenth-century lumber trade. Sue Fawn Chung continues her acclaimed examination of the impact of Chinese immigrants on the American West by bringing to life the tensions, towns, and lumber camps of the Sierra Nevada during a boom period of economic expansion. Chinese workers labored as woodcutters and flume-herders, lumberjacks and loggers. Exploding the myth of the Chinese as a docile and cheap labor army, Chung shows Chinese laborers earned wages similar to those of non-Asians. Men working as camp cooks, among other jobs, could make even more. At the same time, she draws on archives and archaeology to reconstruct everyday existence, offering evocative portraits of camp living, small town life, personal and work relationships, and the production and technical aspects of a dangerous trade. Chung also explores how Chinese used the legal system to win property and wage rights and how economic and technological change ultimately diminished Chinese participation in the lumber industry. Eye-opening and meticulous, Chinese in the Woods rewrites an important chapter in the history of labor and the American West.
