Although popularly conceived as a relatively recent phenomenon, patterns of immigrant smuggling and undocumented entry across American land borders first emerged in the late nineteenth century. Ingenious smugglers and immigrants, long and remote boundary lines, and strong push-and-pull factors created porous borders then, much as they do now.
Historian Patrick Ettinger offers the first comprehensive historical study of evolving border enforcement efforts on American land borders at the turn of the twentieth century. He traces the origins of widespread immigrant smuggling and illicit entry on the northern and southern United States borders at a time when English, Irish, Chinese, Italian, Russian, Lebanese, Japanese, Greek, and, later, Mexican migrants created various \"backdoors\" into the United States. No other work looks so closely at the sweeping, if often ineffectual, innovations in federal border enforcement practices designed to stem these flows.
From upstate Maine to Puget Sound, from San Diego to the Lower Rio Grande Valley in Texas, federal officials struggled to adapt national immigration policies to challenging local conditions, all the while battling wits with resourceful smugglers and determined immigrants. In effect, the period saw the simultaneous \"drawing\" and \"erasing\" of the official border, and its gradual articulation and elaboration in the midst of consistently successful efforts to undermine it.
Model Immigrants and Undesirable Aliens

During 1995 and 1996, President Bill Clinton signed into law three bills that altered the rights and responsibilities of immigrants: the Antiterrorism and Effective Death Penalty Act, the Personal Responsibility Act, and the Illegal Immigration Reform and Immigrant Responsibility Act.Model Immigrants and Undesirable Aliensexamines the changing debates around immigration that preceded and followed the passage of landmark legislation by the U.S. Congress in the mid-1990s, arguing that it represented a new, neoliberal way of thinking and talking about immigration.
Christina Gerken explores the content and the social implications of the deliberations that surrounded the development and passage of immigration reform, analyzing a wide array of writings from congressional debates and committee reports to articles and human-interest stories in mainstream newspapers. The process, she shows, disguised its underlying racism by creating discursive strategies that shaped and upheld an image of \"desirable\" immigrants-those who could demonstrate \"personal responsibility\" and an ability to contribute to the U.S. economy. Gerken finds that politicians linked immigration to complex issues: poverty, welfare reform, so-called family values, measures designed to combat terrorism, and the spiraling costs of social welfare programs.
Although immigrants were often at the center of congressional debates, politicians constructed an elaborate, abstract terminology that appeared to be unrelated to race or gender. Instead, politicians promoted neoliberal policies as the avenue to a postracist, postsexist world of opportunity for every rational consumer with an entrepreneurial spirit. Still, Gerken concludes that the passage of pathbreaking legislation was characterized by a useful tension between neoliberal assumptions and hidden anxieties about race, class, gender, and sexuality.
Criminalization of Immigration

After the September 11th attacks the United States government sought a response to terrorism. The ensuing \"war on terror\" brought sweeping new federal regulations and changes in immigration policy. Consequent changes in society's reaction to immigration and the degree to which immigrants have become criminalized are apparent. Hauptman reveals the effects of a moral panic toward immigration after 9/11, explaining social control initiatives like the USA PATRIOT Act of 2001, as a direct result of the concern over immigrants in the United States. Hauptman concludes that the response to the attacks resulted in the criminalization of immigrants in post-September 11th society.

In 2014, the arrest and detention of thousands of desperate young migrants at the southwest border of the United States exposed the U.S. government's shadowy juvenile detention system, which had escaped public scrutiny for years. This book tells the story of six Central American and Mexican children who are driven from their homes by violence and deprivation, and who embark alone, risking their lives, on the perilous journey north. They suffer coercive arrests at the U.S. border, then land in detention, only to be caught up in the battle to obtain legal status. Whose Child Am I? looks inside a vast, labyrinthine system by documenting in detail the experiences of these youths, beginning with their arrest by immigration authorities, their subsequent placement in federal detention, followed by their appearance in deportation proceedings and release from custody, and, finally, ending with their struggle to build new lives in the United States. This book shows how the U.S. government got into the business of detaining children and what we can learn from this troubled history.

An extensive history examining how North American nations have tried (and often failed) to police their borders, Border Policing presents diverse scholarly perspectives on attempts to regulate people and goods at borders, as well as on the ways that individuals and communities have navigated, contested, and evaded such regulation. The contributors explore these power dynamics though a series of case studies on subjects ranging from competing allegiances at the northeastern border during the War of 1812 to struggles over Indian sovereignty and from the effects of the Mexican Revolution to the experiences of smugglers along the Rio Grande during Prohibition. Later chapters stretch into the twenty-first century and consider immigration enforcement, drug trafficking, and representations of border policing in reality television. Together, the contributors explore the powerful ways in which federal authorities impose political agendas on borderlands and how local border residents and regions interact with, and push back against, such agendas. Immigration enforcement is carried out by a complex legal and administrative system, operating under frequently changing legislative mandates and policy guidance, with authority and funding spread across several agencies in two executive departments and the courts. The U.S. Department of Homeland Security (DHS) is responsible for conducting immigration enforcement both at the border and in the United States; the U.S. Department of Justice (DOJ) is responsible for conducting immigration removal procedures and criminal trials and for prosecuting people charged with immigration-related crimes. DOJ confronts at least five technical challenges to modeling its resource needs for immigration enforcement that are specific to the immigration enforcement system. Despite the inherent limitations, budgeting for immigration enforcement can be improved by changing the method for budgeting.
Budgeting for Immigration Enforcement addresses how to improve budgeting for the federal immigration enforcement system, specifically focusing on the parts of that system that are operated and funded by the U.S. Department of Justice (DOJ). The report recommends that DOJ establish policy-level procedures to plan and coordinate policy planning and implementation to improve performance of the immigration enforcement system. The report also recommends that DOJ and DHS accelerate their design of an integrated capacity to track cases and project immigration enforcement activity. Policy makers and others who are interested in how the nation's immigration enforcement system is organized and operates also will find it useful.

Handcuffs and Chain Linkenters the immigration debate by addressing one of its most controversial aspects: the criminalization both of extralegal immigration to the United States and of immigrants themselves in popular and political discourse. Looking at the factors that led up to criminalization, Benjamin Gonzalez O'Brien points to the alternative approach of the Immigration Reform and Control Act of 1986 and how its ultimate demise served to negatively reinforce the fictitious association of extralegal immigrants with criminality.
Crucial to Gonzalez O'Brien's account thus is the concept of the critical policy failure-a piece of legislation that attempts a radically different approach to a major issue but has shortcomings that ultimately further entrench the approach it was designed to supplant. The IRCA was just such a piece of legislation. It highlighted the contributions of the undocumented and offered amnesty to some while attempting to stem the flow of extralegal immigration by holding employers accountable for hiring the undocumented. The failure of this effort at decriminalization prompted a return to criminalization with a vengeance, leading to the stalemate on immigration policy that persists to this day.
