Many contemporary political thinkers are gripped by the belief that their task is to develop an ideal theory of rights or justice for guiding and judging political actions. But inPhilosophy and Real Politics, Raymond Geuss argues that philosophers should first try to understand why real political actors behave as they actually do. Far from being applied ethics, politics is a skill that allows people to survive and pursue their goals. Citizens, Courts, and Confirmations

In recent years the American public has witnessed several hard-fought battles over nominees to the U.S. Supreme Court. In these heated confirmation fights, candidates' legal and political philosophies have been subject to intense scrutiny and debate.Citizens, Courts, and Confirmationsexamines one such fight--over the nomination of Samuel Alito--to discover how and why people formed opinions about the nominee, and to determine how the confirmation process shaped perceptions of the Supreme Court's legitimacy.
Drawing on a nationally representative survey, James Gibson and Gregory Caldeira use the Alito confirmation fight as a window into public attitudes about the nation's highest court. They find that Americans know far more about the Supreme Court than many realize, that the Court enjoys a great deal of legitimacy among the American people, that attitudes toward the Court as an institution generally do not suffer from partisan or ideological polarization, and that public knowledge enhances the legitimacy accorded the Court. Yet the authors demonstrate that partisan and ideological infighting that treats the Court as just another political institution undermines the considerable public support the institution currently enjoys, and that politicized confirmation battles pose a grave threat to the basic legitimacy of the Supreme Court.
Alibis of empire

Alibis of Empire presents a novel account of the origins, substance, and afterlife of late imperial ideology. Karuna Mantena challenges the idea that Victorian empire was primarily legitimated by liberal notions of progress and civilization. In fact, as the British Empire gained its farthest reach, its ideology was being dramatically transformed by a self-conscious rejection of the liberal model. The collapse of liberal imperialism enabled a new culturalism that stressed the dangers and difficulties of trying to \"civilize\" native peoples. And, hand in hand with this shift in thinking was a shift in practice toward models of indirect rule. As Mantena shows, the work of Victorian legal scholar Henry Maine was at the center of these momentous changes. Alibis of Empire examines how Maine's sociotheoretic model of \"traditional\" society laid the groundwork for the culturalist logic of late empire. In charting the movement from liberal idealism, through culturalist explanation, to retroactive alibi within nineteenth-century British imperial ideology, Alibis of Empire unearths a striking and pervasive dynamic of modern empire.
Constructing Community

Donald Moon takes questions of cultural pluralism and difference more seriously than do many other liberal thinkers of our era: Moon is willing to confront the problem of how community can be created among those who have very different views about the proper ends of human life. Experiencing such profound disagreement, can we live together in a society under norms we all accept? In recent years, traditional ways of looking at this query have come under attack by post-modernists, feminists, and thinkers concerned with pluralism. Respectfully engaging their critiques, Moon proposes a reformulated liberalism that is intended to overcome the problems they have identified.
The state of democratic theory

What should we expect from democracy, and how likely is it that democracies will live up to those expectations? In The State of Democratic Theory, Ian Shapiro offers a critical assessment of contemporary answers to these questions, lays out his distinctive alternative, and explores its implications for policy and political action. Some accounts of democracy’s purposes focus on aggregating preferences; others deal with collective deliberation in search of the common good. Shapiro reveals the shortcomings of both, arguing instead that democracy should be geared toward minimizing domination throughout society. He contends that Joseph Schumpeter’s classic defense of competitive democracy is a useful starting point for achieving this purpose, but that it stands in need of radical supplementation--both with respect to its operation in national political institutions and in its extension to other forms of collective association. Shapiro’s unusually wide-ranging discussion also deals with the conditions that make democracy’s survival more and less likely, with the challenges presented by ethnic differences and claims for group rights, and with the relations between democracy and the distribution of income and wealth.

Deborah Schildkraut shows that people's conceptions of American national identity play an integral role in shaping their views. Using insights from American political thought and intellectual history, she highlights several components of that identity and shows how they are brought to bear on debates about language. Her analysis expands the range of factors typically thought to explain attitudes in such policy areas, emphasizing in particular the role that civic republicanism's call for active and responsible citizenship plays in shaping opinion on language issues.
Using focus groups and survey data, Schildkraut develops a model of public conceptions of what it means to be American and demonstrates the complex ways in which people draw on these conceptions when forming and explaining their views. In so doing she illustrates how focus group methodology can help yield vital new insights into opinion formation.
With the rise in the use of ballot initiatives to implement language policies, understanding opinion formation in this policy area has become imperative. This book enhances our understanding of this increasingly pressing concern, and points the way toward humane, effective, and broadly popular language policies that address the realities of American demographics in the twenty-first century while staying true to the nation's most revered values.
Democratic rights

When the Supreme Court in 2003 struck down a Texas law prohibiting homosexual sodomy, it cited the right to privacy based on the guarantee of \"substantive due process\" embodied by the Constitution. But did the court act undemocratically by overriding the rights of the majority of voters in Texas? Scholars often point to such cases as exposing a fundamental tension between the democratic principle of majority rule and the liberal concern to protect individual rights.Democratic Rightschallenges this view by showing that, in fact, democracy demands many of these rights.
Corey Brettschneider argues that ideal democracy is comprised of three core values--political autonomy, equality of interests, and reciprocity--with both procedural and substantive implications. These values entitle citizens not only to procedural rights of participation (e.g., electing representatives) but also to substantive rights that a \"pure procedural\" democracy might not protect. What are often seen as distinctly liberal substantive rights to privacy, property, and welfare can, then, be understood within what Brettschneider terms a \"value theory of democracy.\" Drawing on the work of John Rawls and deliberative democrats such as Jürgen Habermas, he demonstrates that such rights are essential components of--rather than constraints on--an ideal democracy. Thus, while defenders of the democratic ideal rightly seek the power of all to participate, they should also demand the rights that are the substance of self-government.

The general assumption that social policy should be utilitarian--that society should be organized to yield the greatest level of welfare--leads inexorably to increased government interventions. Gilles Saint-Paul posits that the utilitarian foundations of individual freedom promoted by traditional economics are fundamentally flawed. When combined with developments in social science that view the individual as incapable of making rational and responsible choices, utilitarianism seems to logically call for greater governmental intervention in our lives. Arguing that this cannot be defended on purely instrumental grounds, Saint-Paul calls for individual liberty to be restored as a central value in our society.
