Medical errors are among the top 3 causes of patient deaths in the United States, with up to 400,000 preventable deaths occurring in hospitalized patients each year. Although improvements have been made in anesthesia patient safety, adverse outcomes continue to occur. This study used thematic analysis to examine anesthesia closed claims that were associated with preventable morbidity and mortality. Investigators determined that 123 closed malpractice claims files from the American Association of Nurse Anesthetists (AANA) Foundation closed claims database involved events that the involved Certified Registered Nurse Anesthetist could have prevented. Factors that were associated with preventable closed claims included communication failures, violations of the AANA Standards for Nurse Anesthesia Practice, and errors in judgment.

Why do lenient claims handling practices exist in the insurance industry? A survey study of ethical decisions by claims adjusters

Purpose
The purpose of this paper is to investigate which factors will affect the insurance claims adjusters’ attitude and behavior intention toward lenient claims handling practices. These factors include organizational justice, behavioral-based control, significant others, and customer complaints.
Design/methodology/approach
Data are collected with questionnaires from full-time licensed insurance claims adjusters in Taiwan. Partial least squares method is used to test the hypotheses.
Findings
The main results show that significant others and organizational justice have significant effects on the claims adjusters’ attitude toward the lenient claims handling practices. Significant others and attitude have significant effects on the behavioral intention.
Originality/value
The influence of claims management on insurance companies’ operation is quite considerable. Poor claims management may not only harm insurance companies’ finance, but also affect the adjustment of future premiums. Yet, in reality, some claims adjusters are found to make flawed claims decisions. Very few studies discuss this problem. This study provides an initial step toward understanding this issue.

Instead of having to get a totally brand-new license in every state they adjust claims in and have to abide by multiple states' stipulations for exams and continuing education, an adjuster can get a license in a state that they don't live in and then use that to get reciprocal licenses in (other) nonresident states. [...]it's the only state Puerto Rico considers reciprocal for adjuster licensing – Florida-licensed adjusters don't have to re-sit for the Puerto Rico exam. [...]if we had a nickel for how often we hear people lamenting that they got a Florida DHS only to learn their resident state offers the staff or independent adjuster license they need… well, we'd have a noisy pocketful. Because the standard advice for many large agencies and carriers is \"get a Florida DHS,\" some adjusters unquestioningly zone in and get that Florida DHS in complete ignorance of their own state's offerings.

Some Florida Insurers Stop Altering Adjuster Reports, But Many Claims Still Not Paid

Even before the Florida Legislature adopted the Insurer Accountability Act of 2023, requiring insurers to stop altering independent adjusters' damage estimates without providing transparency, a number of Florida property insurers and adjuster firms stopped the practice on their own, said adjusters who had made some bold allegations about the industry. Vinson and two other independent adjusters sparked a controversy in December when they charged at a Florida House of Representatives hearing that several insurers and their hired adjuster firms were making wholesale changes to their damage estimates, slashing repair amounts by as much as two-thirds – but leaving the field adjusters' names on the revised reports. The Florida Department of Financial Services' investigative division, after some initial confusion over whether it would look into the allegations, is now in the midst of a formal examination, adjusters and others said.
