Investigators in the Regina Police Service's Major Crimes Unit and Crown prosecutors do not have all the information they need to make that decision, Sgt. Dave Wyatt said. Police have already charged Robert Lyndon Creswell, 32, Charles Joseph David Dubois, 19, Joseph Michael Hein, 21, Jason Curtis Johner, 20, and Richard Alvin Kaz, 20, with first-degree murder in [Arthur Kohler]'s death. They are in custody, awaiting their preliminary hearing, which starts Nov. 13 and will continue for two to three weeks.

Police allege [Arthur Kohler] and Edna Kohler died in a violent home invasion on Aug. 13. Arthur Kohler had been beaten to death. His critically injured wife was taken to hospital where she remained for nearly a month before dying.

Arthur married the former [Rosalee] Newcomer on April 19, 1976, in Pearisburg, Virginia. Arthur and Rosalee shared 30 years of marriage and commitment to each other. Surviving along with his wife, Rosalee, is one son, Arthur L. Kohler Jr. of Tampa, FL; and two stepchildren, Diane Trackas of Oklahoma and Ron Trackas of South Bend, IN. Arthur is also survived by three sisters, Mary O'Coner of South Bend, Geneva Haskel of South Bend and Betty (Joe) Chamberlin of Mishawaka. Arthur was a member of several organizations and lodges, Eagles Lodge #2083, Moose Lodge #599, V.F.W. Post 360, American Legion Post 0143 and Elks Lodge #1912.

Jason Curtis Johner already pleaded guilty to two counts of second-degree murder and on April 11 was given a mandatory life sentence with no possibility of parole for 10 years. That same day, Robert Lyndon Creswell, who had pleaded guilty to two counts of manslaughter, was sentenced to 11 years in prison. Justice Ian McLellan sentenced both men. After listening to both sides present their sentencing arguments for 45 minutes, McLellan adjourned the matter until next Thursday, June 28, when he will hand down Kaz's sentence. Media will be able to report the length of the sentence, but not any remarks McLellan makes in explaining his decision.

\"We're considering how to try them, jointly or separate,\" Crown prosecutor Al Johnston said after the quintet's brief court appearance in Regina Provincial Court on Wednesday. One after another, Richard Alvin Kaz, Robert Creswell, David Dubois, Jason Curtis Johner, Joseph Hein and their lawyers appeared before provincial court Judge Diane Morris Wednesday. She adjourned their matter to Sept. 13.

Dressed in the white coveralls worn by the inhabitants of Regina police cells, Charles Joseph David Dubois, 19, and Joseph Michael Hein, 21, said nothing during their brief appearance in front of provincial court Judge Eugene Lewchuk. Information from a number of sources led police to Hein and Dubois, who were traced to local residences and arrested without incident, [Dave Wyatt] said. Police believe the Kohlers were attacked in their home at 106 Millar Cres. on Sunday, Aug. 13 -- three days before they were found by their visiting son. \"It was miraculous that this lady survived those days,\" Wyatt said Monday.

[David Bishop]'s client Charles Dubois, 21, and Joshua Hein, 23, have been charged with first-degree murder in the deaths of [Arthur Kohler] and Edna Kohler. \"There were extensive skull fractures and below the fractures there was extensive damage to the brain itself,\" [Edward Alport] said. Richard Alvin Kaz, 22, received six years for manslaughter. Jason Curtis Johner, 22, was sentenced to life in prison with no possibility of parole for 10 years for second-degree murder. Robert Lyndon Creswell, 33, was sentenced to 11 years for manslaughter.
