This study opens a critical perspective on the slow death of socialism and the rebirth of capitalism in the world's most dynamic and populous country. Based on remarkable fieldwork and extensive interviews in Chinese textile, apparel, machinery, and household appliance factories, Against the Law finds a rising tide of labor unrest mostly hidden from the world's attention. Providing a broad political and economic analysis of this labor struggle together with fine-grained ethnographic detail, the book portrays the Chinese working class as workers' stories unfold in bankrupt state factories and global sweatshops, in crowded dormitories and remote villages, at street protests as well as in quiet disenchantment with the corrupt officialdom and the fledgling legal system.
THE CHANGING NATURE OF LABOR UNREST IN CHINA

A qualitative shift is underway in the nature of labor protest in China. Contrary to prior literature that characterized strikes as being largely defensive in nature, the authors suggest that since 2008, Chinese workers have been striking offensively for more money, better working conditions, and more respect from employers. They explain these developments using a \"political process\" model that suggests economic and political opportunities are sending \"cognitive cues\" to workers that they have increased leverage, leading them to be more assertive in their demands. Such cues include a growing labor shortage, new labor laws, and new media openness. Their argument is supported by a unique data set of strikes that the authors collected, two case studies of strikes in aerospace factories, and interviews with a variety of employment relations stakeholders.

MOBILIZATION WITHOUT MOVEMENT

Drawing on a qualitative analysis of two recent labor disputes in Guangzhou and Shenzhen, this article asks: Why has a broad-based labor movement failed to emerge in contemporary China? Both pro-labor legislation and the existence of movement-oriented labor NGOs appear to provide opportunities and resources for workers to engage in organized action to expand workers’ rights. Two political mechanisms, however, help explain why a strong labor movement has not developed: 1) legislation and courtroom procedures and 2) official institutions that monopolize the space for representation—specifically the All-China Federation of Trade Unions (ACFTU). We call these two mechanisms “political fixes” and discuss how they interact to engender a feedback between the fragmentation of collective action during labor conflict and the continuous uptick in labor insurgency. This article contributes to labor movement theory: It puts greater emphasis on the institutional mechanisms that constrain labor, as opposed to sheer repression or economic factors.

Why Is There No Labor Party in the United States?

Why is the United States the only advanced capitalist country with no labor party? This question is one of the great enduring puzzles of American political development, and it lies at the heart of a fundamental debate about the nature of American society. Tackling this debate head-on, Robin Archer puts forward a new explanation for why there is no American labor party--an explanation that suggests that much of the conventional wisdom about \"American exceptionalism\" is untenable.
Conventional explanations rely on comparison with Europe. Archer challenges these explanations by comparing the United States with its most similar New World counterpart--Australia. This comparison is particularly revealing, not only because the United States and Australia share many fundamental historical, political, and social characteristics, but also because Australian unions established a labor party in the late nineteenth century, just when American unions, against a common backdrop of industrial defeat and depression, came closest to doing something similar.
Archer examines each of the factors that could help explain the American outcome, and his systematic comparison yields unexpected conclusions. He argues that prosperity, democracy, liberalism, and racial hostility often promoted the very changes they are said to have obstructed. And he shows that it was not these characteristics that left the United States without a labor party, but, rather, the powerful impact of repression, religion, and political sectarianism.
The Anatomy of Impatience: Exploring Factors behind 2020 Labor Unrest in Belarus

The wave of labor unrest that accompanied Belarusian post-election protests had no precedents in the country's independent history or recent post-Soviet political protest mobilizations. These protests challenge the prevalent trend in the current literature on the post-Soviet working class to stress its weakness in terms of organization, as well as structural and material resources. This article relies on a database of workplace-related protest events (August 10–September 30) and a selection of statements, interviews, and social media discussions among participants of the protests, in order to explain this unexpected activation of the seemingly passive Belarusian working class. The author hypothesizes that it was the vagueness of the Belarusian opposition's ideology and workers’ participation in the broader protest movement that helped them overcome the challenges of suppressed voice, bureaucratic despotism, and atomization. These mobilizing factors, however, limit the further development of autonomous labor organizations and their democratizing impact.

Impact of labour unrest and skilled workforce in host country on inflow of foreign direct investment – a case of Taiwan, ROC

PurposeIn this paper, the authors examined the changes in labour unrest and labour quality brought by high labour standards over a considerable period in Taiwan. Then, the authors studied the role of these changes in predicting the inflow of foreign direct investment (IFDI) in the country. To test the role, the authors measured the differences in effects of the two changes on wages, working hours and employment opportunities of skilled female and skilled male workers in FDI-intensive and non-intensive industries.Design/methodology/approachUsing a model built on pooled cross-sectional time-series data from 1999 to 2012, the authors measured the effect of changes in labour unrest and the presence of skilled workers on the net inflow of FDI. Using data from the Manpower Utilisation Survey (MUS), the authors applied differences–in–Differences-in--ddifferences- (DDD) and differences–in–Differences-in-ddifferences-in--differences- (DDDD) estimation methods to test the effect of changes in labour unrest and labour quality on three labour market outcomes, namely wages, working hours and job opportunities of skilled workforce.FindingsIncreasing labour unrest affected the employment opportunities of almost every unemployed person seeking skilled jobs in Taiwan. When the authors compared the adverse effect of high labour standards on employment opportunities and working hours, the authors found women looking for skilled jobs in foreign-owned firms to be the worst affected. Besides, foreign firms paid different wages to skilled educated men than what foreign firms' domestic counterparts paid to skilled educated men employed in Taiwanese firms.Practical implicationsAn in-depth analysis of changes in labour unrest and presence of skilled workers because of high labour standards and the extent to which such changes helped the nation to attract FDI should be useful to policymakers interested in understanding the impact of legislative measures and policy reforms on labour market outcomes across industry types, which matter to foreign investors. If changes in labour unrest and labour quality influenced the inflow of FDI more to firms in one set of industries than the others, the same should have a bearing on revamping of future enactment and enforcement in Taiwan.Originality/valueCurrent study findings would not only provide broad lessons to policymakers in Taiwan but findings of the authors' country case study should be able to guide growing economies that are equally careful whilst raising the labour standards as most fear that high labour standards can deter inflow of FDI because of increasing labour cost.

COLLECTIVE ACTION AND CUSTOMER SERVICE IN RETAIL

This article examines the relationship between workplace collective action at a large retail employer and customers’ perceptions of service. The authors show that increases in workplace collective action, as measured by signed labor organization membership cards, are associated with lower customer ratings of service, as measured by Yelp reviews. Drawing on qualitative interviews with 80 workers, the authors discuss several possible explanations for the negative association between worker organizing and customer service, arguing that this correlation poses an underappreciated obstacle for labor organizing in the service sector.

In 1937, Mexican workers were among the strikers and supporters beaten, arrested, and murdered by Chicago policemen in the now infamous Republic Steel Mill Strike. Using this event as a springboard, Zaragosa Vargas embarks on the first full-scale history of the Mexican-American labor movement in twentieth-century America. Absorbing and meticulously researched,Labor Rights Are Civil Rightspaints a multifaceted portrait of the complexities and contours of the Mexican American struggle for equality from the 1930s to the postwar era.
Drawing on extensive archival research, Vargas focuses on the large Mexican American communities in Texas, Colorado, and California. As he explains, the Great Depression heightened the struggles of Spanish speaking blue-collar workers, and employers began to define citizenship to exclude Mexicans from political rights and erect barriers to resistance. Mexican Americans faced hostility and repatriation.
The mounting strife resulted in strikes by Mexican fruit and vegetable farmers. This collective action, combined with involvement in the Communist party, led Mexican workers to unionize. Vargas carefully illustrates how union mobilization in agriculture, tobacco, garment, and other industries became an important vehicle for achieving Mexican American labor and civil rights.
He details how interracial unionism proved successful in cross-border alliances, in fighting discriminatory hiring practices, in building local unions, in mobilizing against fascism and in fighting brutal racism. No longer willing to accept their inferior status, a rising Mexican American grassroots movement would utilize direct action to achieve equality.
A Tale of Two Cities: the intrinsic spatial logic of courier protests

Protests differ and so do protest outcomes. This is also the case in food delivery gig work, which is characterised by frequent labour unrest. Various cross-country analyses have pointed to the importance of the national context for the strategies and outcomes of courier protests. However, as the article shows, the protests already differ at the level of different cities. To analyse this, the study argues that the heterogeneity of protests in platform-mediated courier work is due to the spatially distinct logic of the respective cities. The research is based on two case studies of food delivery platforms in Germany, which were investigated with a mixed methods research design consisting of interviews, multi-sited ethnography and a survey. The findings show that the intrinsic logic of the two centres of courier protests studied (Cologne and Berlin) played a central role in the composition of the protesting groups, their strategies and subsequently the outcomes. However, it turns out that intrinsic logics are not homogeneous and in fact may exist in various forms, which can be complementary or in conflict with each other and are supported and realised by different social groups. In addition, the size of the cities also proves to be decisive for the dynamics of the protests.

El objetivo del estudio fue describir la experiencia del malestar laboral narrada por psicólogos chilenos en grupos Facebook relacionados con la formación y ejercicio profesional de la psicología. Se realizó un estudio cualitativo aplicado a tres grupos, mediante el software NVivo 11 y orientado por un análisis sociológico de contenido, complementado con datos cuantitativos. Los hallazgos indican que el neoliberalismo produce descolectivización, que se asocia a la crisis de representación del Colegio de Psicólogos de Chile (COLEPSI), por cuanto existe una escasa legitimidad organizacional expresada en la merma de la legitimidad moral. El 25 % de los comentarios señalan que el COLEPSI no se pronuncia sobre la precariedad laboral ni la desregulación de la oferta de pregrado (22 %). Finalmente, frente al declive institucional, los psicólogos deben asumir la tramitación de su malestar laboral, específicamente, mediante la publicación en diversos grupos Facebook que poseen potencialidad de articulación política para generar cambios.
