Third party funding : law, economics, and policy
In Third Party Funding, Gian Marco Solas, for the first time, describes third party funding (TPF) as stand-alone practice within the wider litigation and legal markets. The book reports on legal issues related to TPF in both common law and civil law jurisdictions, and in the international context. It then discusses the incentives and economics of TPF transactions in different legal contexts while explaining how the practice emerged and how it is likely to develop. In addition, the book offers practical insights into TPF transactions and analyzes a number of regulatory proposals that could affect its use and desirability. This work should be read by scholars, practitioners, policymakers, and anyone else interested in how TPF is changing the practice of law.

El repartidor de pleitos de la Real Chancillería de Valladolid fue el oficial que, desde fechas tempranas, garantizó la igualdad y equilibrio en la actividad de las escribanías de cámara del Alto Tribunal castellano, al mismo tiempo que el correcto procedimiento de los litigios en su fase inicial. En el presente artículo se estudia la normativa que daría lugar al oficio y al procedimiento del repartimiento, así como se analiza el propio oficio, sus titulares y el mismo procedimiento; remarcándose su influencia en otros altos tribunales hispánicos y americanos, así como en el repartimiento de los asuntos judiciales en la administración de justicia contemporánea.

La responsabilidad de los Estados por daños a extranjeros en un contexto tentativo: el recorrido en España del asunto Cerruti y otras reclamaciones de italianos en Colombia (1886-1904)

Mediante el Protocolo Matéus-Menabrea de 1886, Colombia e Italia acordaron someter al Gobierno de España la decisión de si correspondía indemnizar a Ernesto Cerruti y a otros súbditos italianos radicados en Colombia por los perjuicios que hubieran sufrido por responsabilidad de la administración. Los numerosos aportes existentes hasta el momento en la literatura no han atendido demasiado a las fuentes españolas sobre la cuestión, y se han centrado únicamente en examinar la primera fase de este proceso, el millonario pleito relativo a Cerruti. El presente trabajo pretende ofrecer una visión panorámica de las dos fases del litigio en España, resaltando el carácter peculiar del estatus reservado al mediador –o, mejor dicho, árbitro– y contextualizando la rocambolesca trayectoria del asunto dentro de un escenario general de transformaciones muy profundas en el que el derecho internacional se encontraba en un momento todavía experimental.

0179 Independent Medical Evaluations - Important, neglected, in need of reform: a systematic review

Objectives Independent medical evaluations (IMEs) are a common and influential form of assessment, often influencing whether patients receive compensation for an injury or illness. To inform the evidence-base underlying IMEs, we conducted a systematic review of all primary literature conducted in North America. Method We searched CINAHL, EMBASE, MEDLINE and PsycINFO and other sources for studies published through to Sept. 20, 2011. We included all primary literature on the topic of IMEs from a North American perspective. Assessment for study inclusion, data extraction and risk-of-bias analyses were performed in duplicate. Results We included 52 studies, all of which were observational in design and most of which focussed on determining the rate of malingering among examinees. Estimates of non-credible symptom over-reporting among patients presenting for IMEs ranged from 16% to 55%, with studies at lower risk of bias finding higher estimates. Other studies found that inter-rater reliability among IME assessors for assigning degree of impairment to the same IME report was poor, and that patients presenting for an IME with external incentive (e.g. litigation, disability benefits) perform systematically worse across a range of psychometric tests versus patients presenting with similar illness/injury but without external incentive. Conclusions Symptom exaggeration is common among patients presenting for IMEs, and particularly among those patients with external incentive. IME assessors reviewing the same case demonstrate little agreement regarding the degree of impairment that should be assigned. Standards for IME assessment and reporting are urgently needed to ensure greater reliability and validity of this common form of assessment.
