Introducerea obligativității medierii în cazul litigiilor dintre comercianții din România și Republica Moldova
In Romania and the Republic of Moldova, we believe that the institution of mandatory mediation in disputes between professionals, especially between those with small and medium-sized businesses, could have a chance of success, after recently, on September 3, 2024, in case C-658-23, the Court of Justice of the European Union established that if the Constitutional Court of Romania invalidated a law that stipulates as mandatory the information session regarding the mediation fees, then the court can not to apply the decision of the Constitutional Court. In the current crisis that society is going through due to the political, economic and moral crises, both nationally and globally, as well as the armed conflict in Ukraine, this measure is justified, however, on the condition that the institution of mediation is given a real chance to to manifest, but this time from the position of mandatory mediation carried out by mediators and not by other legal professionals. In our opinion, the obligation of mediation can be instituted in all the categories of disputes listed in the mediation law of both countries, but in order to help the Romanian and Moldovan society through the institution of mediation to overcome these crises, we propose to the legislators to be inspired by the experience the Italian legislator who found a way to penetrate national and European legislation.
World leaders adopt first global pact on migration
First the USA, and more recently Australia, Austria, the Czech Republic, Dominican Republic, Hungary, Latvia, Poland, Slovakia, and Chile indicated their withdrawal from the process, stating that the compact fails to protect their national sovereignty in migration policy. The US delegation to the UN released a new statement attacking the compact on Dec 7, stating that it was an attempt by the UN to advance global governance at the expense of the sovereign right of states, despite UN officials repeatedly emphasising that the compact is not legally binding and expressly ensuring that states will maintain control over their migration policy. UN leaders in Marrakesh struck a rousing tone, with António Guterres, UN Secretary-General, opening the conference of assembled member states, saying “You are here because you recognise the importance of this compact as a roadmap to prevent suffering and chaos, and to provide cooperation strategies that will benefit all”.
An American Example of Islamic Chaplaincy Education for the European Context
Against the background of increasing political and academic interest in imam and chaplaincy training and education in Europe, this article argues that the value and purpose of such education remains situated in an alignment between educational provider, student-participants, and employer–stakeholder expectations. These expectations are primarily about Muslim students’ learning and development, requirements and standards of employers, and contributions to community and society, and only secondly, the educations aim at meeting political expectations. The article explores aspects of Hartford Seminary’s success with its programme and alignment of education content and environment with student expectations and the labour market demand. This is supported theoretically by the input–environment–outcome assessment model. The structural and contextually embedded criteria for excellence are discussed and problematised, pointing both to the marginalisation of other drivers of education development that are not market aligned and to strategies of embedding religious authority with chaplains in institutions rather than with imams in mosques. In conclusion, the article highlights the self-sustaining logics that drive educational development but also points to corroborating social, economic, and welfare reasons for quality imam and chaplaincy education.
On Migration towards Europe. Simple as ABC#3: The Wild Hunt by Thomas Bellinck
Simple as ABC#3: The Wild Hunt, directed by the Belgian director Thomas Bellink, evokes illegal migration to Europe, which has been taking place since the so-called Arab Spring of 2011. The show criticizes the attitude of rejection adopted by European countries toward migrants. It presents an imaginary museum of objects symbolizing the violence against foreigners and provides floor to testimonies of migration.
