Loss of habitats or ecosystems arising from development projects (e.g., infrastructure, resource extraction, urban expansion) are frequently addressed through biodiversity offsetting. As currently implemented, offsetting typically requires an outcome of “no net loss” of biodiversity, but only relative to a baseline trajectory of biodiversity decline. This type of “relative” no net loss entrenches ongoing biodiversity loss, and is misaligned with biodiversity targets that require “absolute” no net loss or “net gain.” Here, we review the limitations of biodiversity offsetting, and in response, propose a new framework for compensating for biodiversity losses from development in a way that is aligned explicitly with jurisdictional biodiversity targets. In the framework, targets for particular biodiversity features are achieved via one of three pathways: Net Gain, No Net Loss, or (rarely) Managed Net Loss. We outline how to set the type (“Maintenance” or “Improvement”) and amount of ecological compensation that is appropriate for proportionately contributing to the achievement of different targets. This framework advances ecological compensation beyond a reactive, ad‐hoc response, to ensuring alignment between actions addressing residual biodiversity losses and achievement of overarching targets for biodiversity conservation.

Avoiding impacts on biodiversity through strengthening the first stage of the mitigation hierarchy

The mitigation hierarchy is a decision-making framework designed to address impacts on biodiversity and ecosystem services through first seeking to avoid impacts wherever possible, then minimizing or restoring impacts, and finally by offsetting any unavoidable impacts. Avoiding impacts is seen by many as the most certain and effective way of managing harm to biodiversity, and its position as the first stage of the mitigation hierarchy indicates that it should be prioritized ahead of other stages. However, despite an abundance of legislative and voluntary requirements, there is often a failure to avoid impacts. We discuss reasons for this failure and outline some possible solutions. We highlight the key roles that can be played by conservation organizations in cultivating political will, holding decision makers accountable to the law, improving the processes of impact assessment and avoidance, building capacity, and providing technical knowledge. A renewed focus on impact avoidance as the foundation of the mitigation hierarchy could help to limit the impacts on biodiversity of large-scale developments in energy, infrastructure, agriculture and other sectors.

The ecological outcomes of biodiversity offsets under “no net loss” policies: A global review

No net loss (NNL) biodiversity policies mandating the application of a mitigation hierarchy (avoid, minimize, remediate, offset) to the ecological impacts of built infrastructure are proliferating globally. However, little is known about their effectiveness at achieving NNL outcomes. We reviewed the English‐language peer‐reviewed literature (capturing 15,715 articles), and identified 32 reports that observed ecological outcomes from NNL policies, including >300,000 ha of biodiversity offsets. Approximately one‐third of NNL policies and individual biodiversity offsets reported achieving NNL, primarily in wetlands, although most studies used widely criticized area‐based outcome measures. The most commonly cited reason for success was applying high offset multipliers (large offset area relative to the impacted area). We identified large gaps between the global implementation of offsets and the evidence for their effectiveness: despite two‐thirds of the world's biodiversity offsets being applied in forested ecosystems, we found none of four studies demonstrated successful NNL outcomes for forested habitats or species. We also found no evidence for NNL achievement using avoided loss offsets (impacts offset by protecting existing habitat elsewhere). Additionally, we summarized regional variability in compliance rates with NNL policies. As global infrastructural expansion accelerates, we must urgently improve the evidence‐base around efforts to mitigate development impacts on biodiversity.

Net outcome‐type biodiversity policies are proliferating globally as perceived mechanisms to reconcile economic development and conservation objectives. The UK government's Environment Bill will mandate that most new developments in England demonstrate that they deliver a biodiversity net gain (BNG) to receive planning permission, representing the most wide‐ranging net outcome type policy globally. However, as with many nascent net‐outcome policies, the likely outcomes of mandatory BNG have not been explored empirically. We assemble all BNG assessments (accounting for ∼6% of England's annual housebuilding and other infrastructure) submitted from January 2020 to February 2021 in six early‐adopter councils who are implementing mandatory no net loss or BNG requirements in advance of the national adoption of mandatory BNG, and analyze the aggregate habitat changes proposed. Our sample is associated with a 34% reduction in the area of nonurban habitats, generally compensated by commitments to deliver smaller areas of higher quality habitat years later in the development project cycle. Ninety‐five percent of biodiversity units delivered in our sample come from habitats within or directly‐adjacent to the development footprint managed by the developers. However, we find that these gains fall within a governance gap whereby they risk being unenforceable, a challenge that is shared with other net outcome type policies implemented internationally.

Deep-Sea Mining With No Net Loss of Biodiversity—An Impossible Aim

Deep-sea mining is likely to result in biodiversity loss, and the significance of this to ecosystem function is not known. “Out of kind” biodiversity offsets substituting one ecosystem type (e.g., coral reefs) for another (e.g., abyssal nodule fields) have been proposed to compensate for such loss. Here we consider a goal of no net loss (NNL) of biodiversity and explore the challenges of applying this aim to deep seabed mining, based on the associated mitigation hierarchy (avoid, minimize, remediate). We conclude that the industry cannot at present deliver an outcome of NNL. This results from the vulnerable nature of deep-sea environments to mining impacts, currently limited technological capacity to minimize harm, significant gaps in ecological knowledge, and uncertainties of recovery potential of deep-sea ecosystems. Avoidance and minimization of impacts are therefore the only presently viable means of reducing biodiversity losses from seabed mining. Because of these constraints, when and if deep-sea mining proceeds, it must be approached in a precautionary and step-wise manner to integrate new and developing knowledge. Each step should be subject to explicit environmental management goals, monitoring protocols, and binding standards to avoid serious environmental harm and minimize loss of biodiversity. “Out of kind” measures, an option for compensation currently proposed, cannot replicate biodiversity and ecosystem services lost through mining of the deep seabed and thus cannot be considered true offsets. The ecosystem functions provided by deep-sea biodiversity contribute to a wide range of provisioning services (e.g., the exploitation of fish, energy, pharmaceuticals, and cosmetics), play an essential role in regulatory services (e.g., carbon sequestration) and are important culturally. The level of “acceptable” biodiversity loss in the deep sea requires public, transparent, and well-informed consideration, as well as wide agreement. If accepted, further agreement on how to assess residual losses remaining after the robust implementation of the mitigation hierarchy is also imperative. To ameliorate some of the inter-generational inequity caused by mining-associated biodiversity losses, and only after all NNL measures have been used to the fullest extent, potential compensatory actions would need to be focused on measures to improve the knowledge and protection of the deep sea and to demonstrate benefits that will endure for future generations.

Setting robust biodiversity goals

The new global biodiversity framework (GBF) being developed under the Convention on Biological Diversity must drive action to reverse the ongoing decline of the Earth's biodiversity. Explicit, measurable goals that specify the outcomes we want to achieve are needed to set the course for this action. However, the current draft goals and targets fail to set out these clear outcomes. We argue that distinct outcome goals for species, ecosystems, and genetic diversity are essential and should specify net outcomes required for each. Net outcome goals such as “no net loss” do, however, have a controversial history, and loose specification can lead to perverse outcomes. We outline seven general principles to underpin net outcome goal setting that minimize risk of such perverse outcomes. Finally, we recommend inclusion of statements of impact in action targets that support biodiversity goals, and we illustrate the importance of this with an example from the draft GBF action targets. These modifications would help reveal the specific contribution each action would make to achieving the outcome goals and provide clarity on whether the successful achievement of action targets would be adequate to achieve the outcome goals and, in turn, the 2050 vision: living in harmony with nature.

When is an Offset Not an Offset? A Framework of Necessary Conditions for Biodiversity Offsets

Biodiversity offsets have become a widely accepted means of attempting to compensate for biodiversity loss from development, and are applied in planning and decision-making processes at many levels. Yet their use is contentious, and numerous problems with both the concept and the practice have been identified in the literature. Our starting point is the understanding that offsets are a kind of biodiversity compensation measure through which the goal of no net loss (or net gain) of biodiversity can be at least theoretically achieved. Based on a typology of compensation measures distinguishing between habitat protection, improvement (including restoration, habitat creation and improved management practices) and other compensation, we review the literature to develop a framework of conditions that must be met if habitat protection and improvement initiatives can be truly considered offsets and not merely a lesser form of compensation. It is important that such conceptual clarity is reflected in offset policy and guidance, if offsets are to be appropriately applied and to have any chance of fully compensating for biodiversity loss. Our framework can be used to support the review and ongoing development of biodiversity offset policy and guidance, with the aim of improving clarity, rigour and therefore the chances that good biodiversity outcomes can be achieved.

Seeking convergence on the key concepts in 'no net loss' policy

1. Biodiversity conservation policies incorporating a no net loss (NNL) principle are being implemented in many countries. However, there are linguistic and conceptual inconsistencies in the use of terms underlying these NNL policies. 2. We identify inconsistencies that emerge in the usage of eight key terms and phrases associated with NNL policies: biodiversity, frames of reference (i.e. baselines, counterfactuals), no net loss, mitigation hierarchy, biodiversity offset, in-kind/out-of-kind, direct/indirect and multipliers. 3. For each term, we make recommendations to support conceptual convergence, reduce ambiguity and improve clarity in communication and policy documentation. However, we also warn of the challenges in achieving convergence, especially given the linguistic inconsistencies in several of these key concepts among countries in which NNL policies are employed. 4. Policy implications. The recommendations made in this article, on improving clarity and supporting convergence on key no net loss (NNL) concepts, should help eliminate ambiguity in policy documentation. This is crucial if policymakers are to design robust policies that are (i) transparent, (ii) translatable into practice in a consistent manner and (iii) sufficiently understood and supported by stakeholders to be effective in practice.

The transition from No Net Loss to a Net Gain of biodiversity is far from trivial

The objectives of No Net Loss and Net Gain have emerged as key principles in conservation policy. Both give rise to mechanisms by which certain unavoidable biodiversity losses associated with development are quantified, and compensated with comparable gains (e.g. habitat restoration). The former seeks a neutral outcome for biodiversity after losses and gains are accounted for, and the latter seeks an improved outcome. Policy-makers often assume that the transition from one to the other is straightforward and essentially a question of the amount of compensation provided. Consequently, companies increasingly favour Net Gain type commitments, and financial institutions make lending conditional on either objective, depending on the habitat involved. We contend, however, that achieving Net Gain is fundamentally different to achieving No Net Loss, and moving from one to the other is less trivial than is widely realized. Our contention is based on four arguments: (1) the two principles represent different underlying conservation philosophies; (2) ecological uncertainties make it difficult to know where the threshold between No Net Loss and Net Gain lies; (3) different frames of reference are more or less appropriate in evaluating the ecological outcomes, depending on the principle chosen; and (4) stakeholder expectations differ considerably under the two principles. In exploring these arguments we hope to support policy-makers in choosing the more appropriate of the two objectives. We suggest that financial institutions should provide greater clarity regarding the explicit requirements for each principle. We conclude by highlighting questions of relevance to this topic that would benefit from focused research.

Implementation Gap between the Theory and Practice of Biodiversity Offset Multipliers

Emerging policies worldwide require biodiversity gains as compensation for losses associated with economic development, seeking to achieve “no net loss” (NNL). Multipliers – factors by which gains are larger than associated losses – can be crucial for true NNL. Here, we review the theoretical literature on multipliers. Then, we collate data on multipliers implemented in practice, representing the most complete such assessment to date. Finally, we explore remaining design gaps relating to social, ethical, and governance considerations.
Multiplier values should theoretically be tens or hundreds when considering, for example, ecological uncertainties. We propose even larger multipliers required to satisfy previously ignored considerations – including prospect theory, taboo trades, and power relationships. Conversely, our data analyses show that multipliers are smaller in practice, regularly <10.0, and have not changed significantly in magnitude over time.
We recommend that NNL policymakers provide explicit multiplier guidelines, require larger multipliers where appropriate, and ensure transparent reporting of multipliers used. Further research is necessary to determine reasons for the implementation gap we have identified. At the same time, there is a need to explore when and where the social, ethical, and governance requirements for NNL reviewed here can be met through approaches other than multipliers.
