Redefining doubt in cases of uncertainty: an analysis of the 2023 US DoD Law of War Manual revision to the presumption of civilian status in armed conflict
The third edition of the United States (US) Department of Defense Law of War Manual , updated in December 2016 (2015 DoD Manual) states that “[u]nder customary international law, no legal presumption of civilian status exists for persons or objects”. The 2015 Manual received general support from military circles, but some experts believed that rejecting the customary international law (CIL) status of the presumption of civilian status in instances of doubt was an apparent mistake or important error. The 2023 US DoD Law of War Manual (2023 Manual) has now been promulgated with a revision to the doubt rule. Doubt regarding the character of persons or the nature of dedicated civilian objects results in a “presumption” of civilian status “unless the information available indicates that the persons or objects are military objectives”. The 2023 Manual attracted criticism, with some experts, especially those with military experience, arguing that it is counterproductive to incorporate exponentially legalistic or complex, nuanced judgements about status determinations, presumptions and the sufficiency of rebuttal evidence in practical matters such as targeting decisions. The article evaluates the substance and implications of the revision to the doubt rule in the 2023 Manual. The article further considers whether the doubt rule regarding the civilian character of persons and the nature of certain objects has acquired customary international humanitarian law status. Ultimately, the article concludes that is not realistic to include a presumption for application in targeting decisions due to the complexities of applying legalistic concepts during armed conflict.
Better peacekeepers, better protection? Troop quality of United Nations peace operations and violence against civilians
Why do similarly sized peacekeeping missions vary in their effectiveness to protect civilians in conflicts? We argue that peace operations with a large share of troops from countries with high-quality militaries are better able to deter violence from state and non-state actors and create buffer zones within conflict areas, can better reach remote locations, and have superior capabilities – including diplomatic pressure by troop contributing countries – to monitor the implementation of peace agreements. These operational advantages enable them to better protect civilians. Combining data from military expenditures of troop contributing countries together with monthly data on the composition of peace operations, we create a proxy indicator for the average troop quality of UN PKOs. Statistical evidence from an extended sample of conflicts in Africa and Asia between 1991 and 2010 supports our argument.
UN peace operations and protection of civilians: Cheap talk or norm implementation?
Protection of civilians is now at the forefront of the responsibilities of the international community. There is a strong international norm that civilian populations should be protected from violence. But how committed is the United Nations to acting in line with this norm? I argue that the UN Security Council (UNSC) has an interest in demonstrating that it takes violence against civilians seriously. Through a broadened security agenda including human security, the legitimacy and the credibility of the UNSC hinges on its ability to act as a guarantor of civilian protection. As a consequence, the UN is more likely to deploy peace operations in conflicts where the warring parties target the civilian population. The argument is supported by a statistical examination of all internal armed conflicts in 1989—2006. The results show that the likelihood of a UN peace operation is higher in conflicts with high levels of violence against civilians, but this effect is mainly visible after 1999. This year marked a shift in the global security agenda and it was also when the UNSC first issued an explicit mandate to protect civilians. Conflicts with high levels of violence against civilians are also more likely to get operations with robust mandates. This suggests that the UNSC is not just paying lip service to the protection norm, but that it actually acts to implement it.
Massacres and morality : mass atrocities in an age of civilian immunity
Most cultural and legal codes agree that the intentional killing of civilians, whether in peacetime or war, is prohibited. This is the norm of civilian immunity, widely considered to be a fundamental moral and legal principle. Yet despite this fact, the deliberate killing of large numbers of civilians remains a persistent feature of global political life. What is more, the perpetrators have often avoided criticism and punishment. Examining dozens of episodes of mass killing perpetrated by states since the French Revolution late eighteenth century, this book attempts to explain this paradox. It studies the role that civilian immunity has played in shaping the behaviour of perpetrators and how international society has responded to mass killing. The book argues that although the world has made impressive progress in legislating against the intentional killing of civilians and in constructing institutions to give meaning to that prohibition, the norm's history in practice suggests that the ascendancy of civilian immunity is both more recent and more fragile than might otherwise be thought. In practice, decisions to violate a norm are shaped by factors relating to the norm and the situation at hand, so too is the manner in which international society and individual states respond to norm violations. Responses to norm violations are not simply matters of normative obligation or calculations of self-interest but are instead guided by a combination of these logics as well as perceptions about the situation at hand, existing relations with the actors involved, and power relations between actors holding different accounts of the situation. Thus, whilst civilian immunity has for the time being prevailed over 'anti-civilian ideologies' which seek to justify mass killing, it remains challenged by these ideologies and its implementation shaped by individual circumstances. As a result, whilst it has become much more difficult for states to get away with mass murder, it is still not entirely impossible for them to do so.
Analysis and optimization of fire evacuation safety performance in large urban complexes
Urban large-scale complexes, such as shopping malls, pose significant challenges for fire safety management due to their intricate spatial layouts, high population density, and diverse occupancy characteristics. Efficient fire evacuation strategies are critical for minimizing casualties and economic losses; however, existing approaches often overlook the dynamic interplay between fire propagation and human behavior, resulting in suboptimal safety assessments. This study proposes an integrated simulation framework to optimize evacuation strategies by coupling fire dynamics with pedestrian flow modeling, aiming to enhance both evacuation efficiency and personnel safety. The methodology comprises three key steps: (1) Fire scenario simulation: A Building Information Modeling (BIM)-based digital platform is constructed to simulate fire propagation. Critical fire parameters (e.g., heat release rate, combustion model) are calibrated to quantify temporal variations in smoke temperature, CO concentration, and visibility across different zones. (2) Evacuation dynamics modeling: A pedestrian evacuation model is developed by integrating demographic factors (age structure, movement speed, population density) and fire-induced regional risks, enabling realistic simulation of crowd movement under fire conditions. (3) Safety performance evaluation and strategy optimization: Safety margins at staircases are assessed by comparing Required Safe Egress Time (RSET) and Available Safe Egress Time (ASET), followed by a safety grading system to identify high-risk bottlenecks. Evacuation strategies are then optimized to mitigate these risks. A case study was conducted on a shopping mall in Chengdu to validate the framework. Simulation results indicate an initial evacuation time of 260.4 seconds. Safety performance analysis revealed critical risks at staircases A and C (1st floor) and D (2nd floor) due to insufficient safety margins. After strategy optimization, the total evacuation time was reduced to 245.5 seconds, with safety margins at the three high-risk staircases increased by 130.8 s, 115.2 s, and 72 s, respectively, fully meeting safety requirements. The overall evacuation efficiency was significantly improved. This study demonstrates the effectiveness of the proposed framework in quantifying fire risks and optimizing evacuation strategies for large-scale complexes. The integrated simulation approach provides a scientific basis for evidence-based safety management and evacuation planning, offering valuable insights for urban fire safety engineering and emergency response optimization.
Urban Commons and Collective Action to Address Climate Change
Climate change and the coupled loss of ecosystem services pose major collective action problems in that all individuals would benefit from better cooperation to address these problems but conflicting interests and/or incomplete knowledge discourage joint action. Adopting an inductive and multi‐layered approach, drawing upon the authors’ previous research on urban commons, we here summarize key insights on environmentally oriented urban commons and elaborate on what role they have in instigating climate‐proofing activities in urban areas. We deal with three types of urban commons, i.e., “urban green commons,” “coworking spaces,” and “community climate commons.” We describe how allotment gardens, community gardens, and other types of urban green commons contribute to environmental learning that may boost understanding of environmental issues and which constitute important learning arenas for climate‐change mitigation and adaptation. We also deal with the newly emerging phenomenon of coworking spaces that share many essential institutional attributes of urban commons and which can work for climate‐change mitigation through the benefits provided by a sharing economy and through reduction of domestic transportation and commuting distance. Community climate commons represent commons where local communities can mobilize together to create shared low‐carbon assets and which hold the potential to empower certain segments and civil society groups so that they can have greater influence and ownership of the transformation of reaching net‐zero carbon goals. We conclude this article by identifying some critical determinants for the up‐scaling of environmentally oriented urban commons.
Who is a civilian in Afghanistan?
Despite the existence of a definition of civilian status in international humanitarian law (IHL), differences in the application of this definition – both in theory and in practice – continue to be observed. One of the contexts where these differences remain palpable (and do so for various fighting parties) is Afghanistan, a country where civilian harm has remained high for several years. This article explores the legal concepts of civilian and civilian population, including how they have been formed and interpreted and, ultimately, what protection they afford to persons who belong in these categories. The second part of the article brings these questions into the Afghan context, one that is complex and where cultural and religious implications should not be overlooked. Public statements, reports and codes of fighting parties in the country which touch upon civilian status are presented, followed by the civilian experience in Afghanistan, particularly focusing on the reported harm. Ultimately, it is proposed that despite the factual and contextual confusion, the existing legal rules and interpretations, when applied in good faith, suffice to ensure both that those who are civilians under IHL are protected and that the threats which some civilians’ behaviour might pose can be effectively addressed without a status change.
Assessment of Flood Losses with Household Responses: Agent-Based Simulation in an Urban Catchment Area
Densely populated coastal urban areas are often exposed to multiple hazards, in particular floods and storms. Flood defenses and other engineering measures contribute to the mitigation of flood hazards, but a holistic approach to flood risk management should consider other interventions from the human side, including warning information, adaptive behavior, people/property evacuation, and the multilateral relief in local communities. There are few simulation approaches to consider these factors, and these typically focus on collective human actions. This paper presents an agent-based model that simulates flood response preferences and actions taken within individual households to reduce flood losses. The model implements a human response framework in which agents assess different flood scenarios according to warning information and decide whether and how much they invest in response measures to reduce potential inundation damages. A case study has been carried out in the Ng Tung River basin, an urbanized watershed in northern Hong Kong. Adopting a digital elevation model (DEM) as the modeling environment and a building map of household locations in the case area, the model considers the characteristics of households and the flood response behavior of their occupants. We found that property value, warning information, and storm conditions all influence household losses, with downstream and high density areas being particularly vulnerable. Results further indicate (i) that a flood warning system, which provides timely, accurate, and broad coverage rainstorm warning, can reduce flood losses by 30–40%; and (ii) to reduce losses, it is more effective and cheaper to invest early in response measures than late actions. This dynamic agent-based modeling approach is an innovative attempt to quantify and model the role of human responses in flood loss assessments. The model is demonstrated being useful for analyzing household scale flood losses and responses and it has the potential to contribute to flood emergency planning resource allocation in pluvial flood incidents.
Early conservation benefits of a de facto marine protected area at San Clemente Island, California
De facto marine protected areas (DFMPAs) are regions of the ocean where human activity is restricted for reasons other than conservation. Although DFMPAs are widespread globally, their potential role in the protection of marine habitats, species, and ecosystems has not been well studied. In 2012 and 2013, we conducted remotely operated vehicle (ROV) surveys of marine communities at a military DFMPA closed to all civilian access since 2010 and an adjacent fished reference site at San Clemente Island, the southernmost of California's Channel Islands. We used data extracted from ROV imagery to compare density and biomass of focal species, as well as biodiversity and community composition, between the two sites. Generalized linear modeling indicated that both density and biomass of California sheephead (Semicossyphus pulcher) were significantly higher inside the DFMPA. Biomass of ocean whitefish (Caulolatilus princeps) was also significantly higher inside the DFMPA. However, species richness and Shannon-Weaver diversity were not significantly higher inside the DFMPA, and overall fish community composition did not differ significantly between sites. Demonstrable differences between the DFMPA and fished site for two highly sought-after species hint at early potential benefits of protection, though the lack of differences in the broader community suggests that a longer trajectory of recovery may be required for other species. A more comprehensive understanding of the potential conservation benefits of DFMPAs is important in the context of marine spatial planning and global marine conservation objectives.
A BIM-FDS Based Evacuation Assessment of Complex Rail Transit Stations under Post-Earthquake Fires for Sustainable Buildings
Post-earthquake fire is considered as a catastrophic secondary disaster to personal and property safety, especially in complex rail transit station. This is primarily attributed to intricate infrastructure, densely populated floors, and the unrestricted layout of these areas. The aim of this study is to evaluate the evacuation capacity of complex railway stations under post-earthquake fires, and provide sustainable recommendations for building design. In this article, an evacuation assessment of a complex rail transit station under the post-earthquake fire for sustainable buildings was conducted from the internal environment and external rescue based on Building Information Modeling (BIM) and Fire Dynamic Simulation (FDS). The internal environment evacuation assessment simulation experiments were conducted in six hypothetical high-risk scenarios. In addition, the external rescue assessment was based on investigation of the route and the required rescue time during different periods of holidays and workdays. The results show that (1) The influence caused by different sizes of fire area in the power distribution room is smaller than those in the train at the platform floor. (2) In fire scenarios with the same fire area but different fire locations, the temperature is more affected than the CO concentration in the power distribution room. (3) It shows slight differences between single-floor fire and double-floor fire on evacuation of small area fire in power distribution room. Meanwhile, optimized design recommendations are proposed to reduce the risk of emergency evacuation in both internal and external environments of rail transit stations for sustainable future buildings, which include strategically locating the power distribution room away from public areas, installing fire-resistant doors around the room, increasing the quantity of smoke detectors and alarms with regular maintenance, minimizing the size of the power distribution room, developing specific emergency plans for train fires, and incorporating small fire stations in urban planning near complex public buildings to mitigate post-earthquake road obstruction challenges.
