The man denied raping the child. But he acknowledged he made her shower and then sat beside her, as she lay naked on her bed, and removed her towel and applied the heated knife blade to her torso because he thought it would stop the bleeding. Defence lawyer Darren Winegarden said there was no evidence on the girl's body that intercourse occurred that morning. He argued the victim's blood, found on the accused's underwear, had soaked through the seat of his pants, which had a corresponding stain, after the man sat in her blood on a chair. [Robin Ritter] said the attempted murder charge was proven by the man's repeated statements of intent to kill the girl and his admission he decided not to finish her off after the stabbing because she pleaded for her life and promised to change.

Stepfather guilty of attempted murder in girl's stabbing

Queen's Bench Justice Paul Hrabinsky convicted the 37-year-old man on a charge of break and enter to commit attempted murder, He quashed a charge of simple attempted murder because he had already found the man intended to kill the child when he broke into the house, pulled phones out of the walls so the girl could not call for help and stabbed the girl in the torso, narrowly missing her heart, in the Jan. 20, 2005, attack in inner-city Saskatoon. Hrabinsky, who heard the case without a jury, also convicted the man of assaulting the mother, threatening the child, possession of a knife for a dangerous purpose and fi ve counts of breaching court orders, including no-contact orders. The maximum sentence for attempted murder is life in prison. If Hrabinsky imposes that sentence, the man would be eligible for parole in five years, taking into consideration the two years he has already served awaiting trial, [Robin Ritter] said.

Times don't fit the crimes

Unless Justice John Klebuc makes a special exception when he sentences [Kelly Furi], a life term in Furi's case would mean he would have to serve just five years before he's eligible for parole. In order to do this, [Robin Ritter] had to obtain a psychological assessment of Furi, which in turn required the consent of the deputy minister of justice. Ritter got this done, but the result was inconclusive. Psychologist Roger Holden reported that he's not sure whether Furi can be controlled, and without a definitive ruling, the dangerous offender status cannot be conferred. So if the judge gives Furi life, Ritter wants his parole ineligibility period extended so that it is effective 10 years from now rather than five. Alternatively, he wants Furi declared a long- term offender and given a minimum of 15 years on top of time already served and kept under supervision for 10 years after that.

As owner of Agape Dressage, [Jennifer Parker] spends her day on the cushy grounds of an outdoor riding ring at Milagros Stable and Willow Woods, both in Tucson, doing what she loves: teaching horse and rider to work together. Robin Ritter, on the other hand, is hoping to place well at the third level. That's still a national competition, taking place next weekend at the Pima County Fairgrounds. (See box on Page E1.) She's one of Parker's students and rides Pride, a 10-year-old Oldenburg. Parker competes on her, too. \"Because of Pride's breed and size, it's like sitting on a trampoline,\" said Ritter, wheezing between breaths during a break in her lesson. The white horse with brown speckles is tall. Ritter has to stand on a chair to get her foot into the stirrup.

She drank quickly, unaware what effect it would have, she testified. Each time she finished a beer, the guy across from her in the back seat of the truck handed her a new one. A videotaped statement made by the RCMP at the time of [Jeffrey Chad Kindrat]'s arrest was played for the jury Monday. In it, Kindrat says he was sitting in the rear seat. Kindrat and [Jeffrey Lorne Brown] were originally tried and acquitted together in June 2003 but the Crown appealed a month later and the Court of Appeal ordered new trials. [Trevor Dean Edmondson], who is slated as a witness in Kindrat's trial, has served his time. Kindrat, Brown and Edmondson came out of the bar and the latter saw her and commented, \"I thought Pocahontas was a movie,\" she testified. The men got into a truck and began to drive away, then backed up and asked if the girl wanted a ride. She accepted, hoping to get away from her parents, she said.
