The Effect of Land Tenure Institutional Factors on Small Landholders’ Sustainable Land Management Investment: Evidence from the Highlands of Ethiopia
Sustainable Land Management (SLM) is one of the key policy responses being implemented to curb land degradation in the highlands of Ethiopia. However, there is scant evidence to what extent Land Tenure Institutional Factors (LTIFs) influence small landholders’ on-farm investment in SLM. The overall objective of this study is, therefore, to understand the extent to which LTIFs influence on-farm SLM investment in the highlands of Ethiopia through unbundling tenure security (de jure, de facto, and perceived) across a bundle of rights. Survey data were collected between April and May 2021 from 2296 smallholder households and 6692 parcels of 19 highland woredas (districts) in three regional states (Amhara, Oromia, and SNNP) in Ethiopia. A probit regression model was used to estimate the average marginal effects of LTIFs quantitatively and supported by an in-depth qualitative analysis. The results revealed that 10 out of 16 LTIF-related variables have significantly influenced households’ on-farm investment in SLM with average marginal effect ranging from a minimum of 3% (tree tenure security risks) to a maximum of 14% (possession of land certificates), at 95% confidence interval, compared to a mean probability of 45%. The results also revealed that some of the households’ socio-economic and demographic factors and parcel-specific variables have significantly influenced on-farm SLM investment. These imply two policy issues. Firstly, it strengthens the notion that security of tenure may be a necessary condition, but not a sufficient, factor to incentivize smallholders’ on-farm SLM investment. Secondly, an in-depth analysis of the security of tenure categories across a bundle of rights is necessary to help formulate context-specific SLM policy and strategy incentivizing smallholders’ on-farm SLM investment.
The socio-economic impact of land redistribution on the beneficiaries in the Greater Kokstad Municipality of South Africa
PurposeThe Government of South Africa, in 1997, embarked on the land redistribution programme in some communities to address the land ownership injustices suffered by indigenous during the apartheid regime. The objective of this study is to assess the socio-economic experiences of communities that have benefitted from the government's land redistribution programme in the Greater Kokstad Municipality in KwaZulu-Natal, South Africa.Design/methodology/approachThe study employed a qualitative research methodology. The population of interest comprised two communities (Franklin and Makhoba) located within the Greater Kokstad Municipality. A purposefully selected sampling technique was used to select the relevant land beneficiaries to form part of the study's sample. An interview guide made up of both closed-ended and open-ended questions was used to solicit information from the participants.FindingsThe findings revealed that the key social-economic variables, such as the living standards of the beneficiaries, have not yet experienced much improvement. Moreover, it became evident that some socio-economic aspects such as food security, low-cost housing, basic services, wealth (land), transport, infrastructure and training had improved somewhat; although other similar aspects such as total household incomes, unemployment, general community safety and corruption had not improved.Practical implicationsIt can, therefore, be concluded that all socio-economic aspects of beneficiaries' lives had not improved/changed entirely; thus, the experiences of the land redistribution beneficiaries of the Greater Kokstad Municipality represent a mixed bag of major failures and minor successes. The study recommends some policy improvement on the land redistribution programme such as an increase in the combined budgets of the land redistribution and tenure reform programmes and the revision of the proceeds paid to landowners from market value to production value, which if adopted by the government, will help address the deficiencies in socio-economic benefit of the programme to the beneficiaries in the communities.Originality/valueThe findings give an insight into the effectiveness of the government's land redistribution programme to the beneficiaries' socio-economic lives and areas where the government needs to improve to make the project a success. The paper also adds to the literature in terms of knowledge and may serve as a reference for future studies in this area.
“Family-friendly” tenancies in the private rented sector
Purpose This paper aims to analyse the extent to which the government’s recent proposals to end no-fault evictions will result in “family-friendly” tenancies. Design/methodology/approach It applies the theoretical scholarship on the meaning of family and home to the current law relating to private rented tenancies and the government’s proposals to increase security of tenure in the private rented sector. Findings Security of tenure is important to a number of the key aspects of home. However, feelings of home are better protected by security of occupancy, which requires more than de jure security of tenure. For families to feel at home in the private rented sector, they must be permitted to personalise their home and to keep pets. Further legislative changes could achieve these changes. However, for families to really make a home in the private rented sector, they need to exercise some choice over where they live and for low-income families; this will only be possible with broader policy changes. Originality/value This paper contributes to the important scholarship on the meaning of home and applies this to the very current debate on the rights of tenants in the private rented sector.
Realization of the key aspects of the right to adequate housing in affordable housing programs in Egypt
The realization of the right to adequate housing is a critical issue that countries seek to achieve through affordable housing projects. However, there is a discrepancy in fulfilling the right to adequate housing between countries, which has surfaced the dilemma of defining adequate housing. In this respect, scanning relevant literature figured out seven key aspects to meet the right to adequate housing. Using a questionnaire launched to experts in the field, they figured out to what extent the seven aspects have been realized in the affordable housing programs in Egypt. The results showed a significant percentage of realization of the seven key aspects of the right to adequate housing. The findings showed an apparent variation in the completion of the seven key aspects, which decision-makers can improve at different scales with the progression of the programs. Future research can build on this direction to consider aspects like accessibility and cultural adequacy of these programs.
How property relations shape experiences and transformative potential of urban growing spaces: Connecting land, food, and Earth justice perspectives
This study uses both socio-legal and theoretical methods to examine the ambivalent role of property regimes in food system transformation. Combining an Earth justice perspective with a small-scale empirical study of how property and land-use laws affected experiences of growing spaces in an English city that included some element of collective ownership or management, we argue for greater diversity in formal legal structures (e.g., tenancy models), but also in concepts of land relationships. Our discussion diverts attention from individual entitlements to allocation of responsibilities and opportunities for human and interspecies collaboration. Growers’ experiences were shaped by productivist property narratives but provide a material basis to think beyond individual entitlement, reframing issues of security of tenure and public access in terms of responsibility and connection.
Protecting access to land for indigenous and non-indigenous communities: A new page for the World Bank?
The World Bank has reviewed its environmental and social policies at a moment of intense production of international instruments dealing with land tenure, all of which take the form of soft law. This endeavour is motivated by the progressive acknowledgement of the importance of secure and equitable access to land for the realization of human rights and food security. The latest contribution of the World Bank to this debate is of great significance. This article aims to unveil the effects that the new Environmental and Social Framework is likely to generate in this context. It analyses the protection of access to land and security of tenure contained in the World Bank’s Environmental and Social Standards in light of the developments occurring at the international level. To this end, the article reviews the changes to the standards in the context of the social impacts when a lending project affects land holders or users directly or indirectly; addresses the mechanisms for protecting, compensating and improving livelihood opportunities for those affected by the projects; and comments on the safeguarding of indigenous peoples’ lands. The article finds that the World Bank, by incorporating some of these emerging standards, has confirmed the relevance of emerging principles and guidelines on land, even if they are contained in non-binding instruments. On a critical note, the article recognizes the refusal of the World Bank to adopt the underlying discourse and fully embrace human rights achievements in the context of land issues.
The Impact of Forestland Tenure Security on Rural Household Income: Analysis of Mediating Effects Based on Labor Migration
Although collective forest tenure reform (CFTR) has improved the legal tenure security of forestland, its impact on increasing farmers’ income is unsustainable. This study used a multiple linear regression model to empirically analyze data from 505 farmers in Jiangxi Province, examining the impact of legal, actual, and perceived tenure security on rural household income, and incorporating migration into the framework. The findings indicate that both actual and perceived tenure security have a substantial positive impact on the total rural household income and forestry income. However, it is worth noting that legal tenure security only has a positive effect on forestry income. Furthermore, outside-of-county labor migration can serve as a mediator for the income effects of actual and perceived tenure security. However, the mediating effect of intra-county labor migration is not considerable. The study found that the increase in income due to the security of actual tenure security is significant for the group of people who own less than 50 mu of forestland. However, both actual and perceived tenure security have a significant impact on income for the group of people who own more than 50 mu of forestland. The aforementioned findings indicate that, in the ongoing extensive advancement of collective forest right reform, it is crucial to prioritize the execution of forest reform policies at the local level and enhance farmers’ awareness and comprehension of said policies. In addition, the government should enhance the monitoring system for policy implementation and intensify efforts in publicizing these policies, in order to fully utilize the benefits of CFTR.
Indicators of Land Insecurity for Urban Farms: Institutional Affiliation, Investment, and Location
As urban agriculture (UA) continues to expand in the United States, many practitioners question its continuation in cities with high property values and increased economic incentives for development. Frequently, these pressures make urban farmers anxious about investing resources, time, and energy in land suitable for food production if tenure is insecure. Despite these concerns, UA continues to persist in areas experiencing increased property values and rent-seeking. Based on surveys with over 56 urban farm managers in California, we identify possible indicators of land tenure insecurity for urban farms. Our analysis finds that urban farms with greater land security have more financial and institutional support, and are located in census tracts with higher economic opportunity.
Impact of Insecure Land Tenure on Sustainable Agricultural Development: A Case Study of Agricultural Lands in the Republic of Benin, West Africa
This study assesses the impact of insecure land tenure on sustainable agricultural development in Africa to demonstrate how the economic profitability of agriculture strongly depends on land tenure security. The Republic of Benin is used as the case study following the country’s recent enactment of land law 2013-01 that focuses on reorganizing the land sector, which has suffered from inappropriate management since the colonial era. Through an interview survey among landowners and presumed owners combined with standardized observations in designated rural areas, issues related to the use and management of rural lands in the Republic of Benin are highlighted and discussed. The result demonstrates that agricultural economic profitability strongly depends on land tenure security. The outcome reveals land security as a key factor for sustainable agriculture toward poverty reduction and confirms the unbreakable link between land tenure security, agricultural production, and sustainable development.
Managing the perceived impact of K to 12 implementation on academic staff tenure and financial stability: evidence from five higher education institutions in the Philippines
This descriptive survey research utilized a content-validated questionnaire to determine the perceived impact of the implementations of a K to 12 education system in the Philippines. It also determined how teachers plan to manage the possible threats of the new K to 12 education system to their tenure and financial stability. For this study, 77 computing teachers from 5 private higher education institutions in Manila participated and thought that the transition to the new educational structure would have a negative impact on their tenure and retirement. Despite resistance to being transferred to a senior high school position, teachers are getting prepared by attending trainings and taking certification courses to support this change. Government and higher education institutions are offering assistance to help teachers cope with the transition, yet teachers had mixed reactions to this assistance. It was also shown that teachers are affected by the K to 12 system regardless of their academic rank and employment status and concluded that teachers considered different strategies to address the impact of the new system.
