Annexation of plaza in Canton more likely

Jul. 18--CANTON -- One of the stumbling blocks to annexation into the village of University Shopping Plaza might have been lifted with another request for annexation from an adjacent business. Sara H. Stretton, Lake Placid, the owner of Ernie's Car Wash on Route 11, has asked to become part of the village. Town officials didn't want to allow annexation of the plaza, which is at routes 310 and 11, and leave the car wash an island surrounded by the village.

Canton, N.Y., Trustees Approve Annexation of Shopping Plaza

May 18--CANTON, N.Y. -- The village Board of Trustees approved the annexation Monday of University Shopping Plaza and scheduled public hearings for subdivision of lands to allow construction of a convenience mart on East Main Street. Subdivision would allow the church to sell the front piece of its parcel to Adirondack Energy of Malone, which would build a convenience mart similar to one it owns in Massena, which features gasoline sales and a Dunkin' Donuts. Additional vendors for the store aren't settled, Director of Economic Development Nicole L. Conrad said. Ms. Conrad also reported that the bus depot for Trailways and Greyhound might move to Canton Video Express in Midtown Plaza. The bus station is at the St. Lawrence Inn, Court Street, which is closing June 19.

Judge Lokuta's attempt to have charges thrown out falls short

[Ann H. Lokuta]'s legal attempt to have the charges thrown out was denied March 19 by the Pennsylvania Court of Judicial Discipline without holding a hearing on the merit of her arguments. The only thing that could prevent Lokuta's case from going to trial would be if the Court of Judicial Discipline grants a request to reconsider Lokuta's motions. [Samuel Stretton] hinted he would formally request that the Pennsylvania Court of Judicial Discipline, an eight-member panel responsible for determining the validity of charges filed by the state Judicial Conduct Board, reconsider Lokuta's motions.

Judge's attorney wants complaint dismissed

In a motion filed Friday, [Ann H. Lokuta]'s attorney Samuel Stretton attacks allegations made in November by the Pennsylvania Judicial Conduct Board. If those allegations are substantiated by the Pennsylvania Court of Judicial Discipline, Lokuta's punishment could include her removal from the bench. Several of the allegations exceed a four-year statute of limitations, while others were the product of attorney/client privilege violations or Lokuta's former secretary stealing documents and correspondence from the judge's chambers, according to Stretton's motion. Stretton also questions the conduct board's accusations stemming from Lokuta's demeanor in the courtroom. Most of the allegations fail to identify the specific case where Lokuta committed wrongdoing, Stretton argues. The Court of Judicial Discipline could deny Stretton's motion or hold a hearing on its merit. The eight-member court of judicial discipline also could dismiss the allegations against Lokuta based on Stretton's motion.

Judge [Ann H. Lokuta]'s attorney Samuel Stretton questions why it took the conduct board three years to investigate the judge. He also disputes that charges alone prove anything. Most of the time the conduct board charges a judge, the judge is cleared, Mr. Stretton said. The conduct board is responsible for overseeing judges in the state court system. It has charged the 15-year jurist with violating the state constitution and judicial code of conduct. Judge Lokuta could be removed from the bench, should the state Court of Judicial Discipline find the charges have been proven.

If [Ann H. Lokuta] is found guilty of any of six counts, she faces penalties ranging from reprimand to unpaid suspension to removal from the bench, said Daniel Reimer, assistant counsel for the conduct board. Lokuta is first entitled to defend herself against the allegations with legal motions. If those motions do not convince the court of judicial discipline to dismiss the case, a hearing will be scheduled at a later date. \"Since taking the bench in 1992, (Lokuta) routinely engages in a pattern of behavior toward attorneys appearing before her characterized as discourteous, rude, impatient, undignified, abusive, unprofessional, shabby, sarcastic, demeaning, unreasonably critical and condescending,\" the conduct board's document outlining charges against Lokuta said. \"(Lokuta) unnecessarily and unreasonably makes it difficult for attorneys to perform their professional duties and services and humiliates and embarrasses attorneys in front of clients, witnesses and jurors, and even directs, or admonishes their physical movements.\" \"Since taking the bench in 1992, (Lokuta) routinely engages in questioning witnesses to determine their level of education and, once she discovers they are lesser educated, uses vocabulary, phraseology or terminology that is archaic or beyond their comprehension. (Lokuta) has been observed purposely talking to witnesses 'way above their head' and has even been observed using foreign language phrases rather than speaking plainly in an understandable format,\" the conduct board's document outlining charges against Lokuta said.
