The Lockean Commonwealth reappraises John Locke's contribution to this timely topic. By paying careful attention to the arguments put forward in Locke's famous Two Treatises on Government, Ross J. Corbett advances a new interpretation of Locke's political agenda, one that argues that the interplay between \"prerogative\" and \"legislative supremacy\" formed the axis around which turned the practical component of Locke's political theory. With a firm grasp of Locke's historical context, Corbett is able to show how Locke's attempts to balance these competing interests provides insight, not only into the development of the liberal democratic state, but also into questions that trouble us to this day and into questions of political life more generally.
The limits of Lockean rights in property
This book discusses Locke’s theory of property from both a critical and an interpretative standpoint. The author first develops a comprehensive interpretation of Locke’s argument for the legitimacy of private property, and then examines the extent to which the argument is really serviceable in defense of that institution. He contends that a purified version of Locke’s argument--one that adheres consistently to the logic of Locke’s text while excluding considerations extraneous to his logic--actually does establish the legitimacy of a form of private property. This version, which is both defensible in contemporary, secular terms and is, essentially, egalitarian, should provoke a reassessment of the nature of Locke’s relevance to contemporary discussions of distributive justice.

InNatural Rights and the New Republicanism, Michael Zuckert proposes a new view of the political philosophy that lay behind the founding of the United States. In a book that will interest political scientists, historians, and philosophers, Zuckert looks at the Whig or opposition tradition as it developed in England. He argues that there were, in fact, three opposition traditions: Protestant, Grotian, and Lockean. Before the English Civil War the opposition was inspired by the effort to find the \"one true Protestant politics--an effort that was seen to be a failure by the end of the Interregnum period. The Restoration saw the emergence of the Whigs, who sought a way to ground politics free from the sectarian theological-scriptural conflicts of the previous period.
The Whigs were particularly influenced by the Dutch natural law philosopher Hugo Grotius. However, as Zuckert shows, by the mid-eighteenth century John Locke had replaced Grotius as the philosopher of the Whigs. Zuckert's analysis concludes with a penetrating examination of John Trenchard and Thomas Gordon, the English \"Cato,\" who, he argues, brought together Lockean political philosophy and pre-existing Whig political science into a new and powerful synthesis. Although it has been misleadingly presented as a separate \"classical republican\" tradition in recent scholarly discussions, it is this \"new republicanism\" that served as the philosophical point of departure for the founders of the American republic.

This book outlines and analyzes John Locke's political thought about the oceans with a focus on law and freedom at sea. The book examines the Two Treatises of Government, in which Locke argues that the seas are collectively owned by all humans and are governed by universal natural laws that prohibit piracy. Locke's Two Treatises provides a systematic political theory of the seas that contributes to theories of international law and maritime law, but his text does not answer the practical question of how to enforce law effectively at sea. The book also considers how Locke translated his theoretical ideas into practice when he was involved in policymaking as a member of England's Board of Trade during the 1690s. On the Board, Locke waged a war against pirates by proposing an anti-piracy treaty between Europe's major maritime states, by successfully advocating a new English piracy law, and by supporting the deployment of the English Navy against pirates. Locke's war against pirates was consistent with the natural law theory in the Two Treatises, and helped to build English empire on land and at sea. There is also consistency between Locke's theoretical views about slavery and his work on the Board of Trade. As a Board member, Locke advocated forced migration and forced labor for English convicts, which is consistent with the theory of penal slavery in the Two Treatises and suggests that his theory was intended to justify the enslavement of English convicts. However, there are tensions between Locke's arguments in the Two Treatises and the policies of forced naval service that he supported on the Board. Locke's theories of law and freedom at sea shaped his vision of English national identity, and influenced the English government's policies about slavery and piracy.

Alibis of Empire presents a novel account of the origins, substance, and afterlife of late imperial ideology. Karuna Mantena challenges the idea that Victorian empire was primarily legitimated by liberal notions of progress and civilization. In fact, as the British Empire gained its farthest reach, its ideology was being dramatically transformed by a self-conscious rejection of the liberal model. The collapse of liberal imperialism enabled a new culturalism that stressed the dangers and difficulties of trying to \"civilize\" native peoples. And, hand in hand with this shift in thinking was a shift in practice toward models of indirect rule. As Mantena shows, the work of Victorian legal scholar Henry Maine was at the center of these momentous changes. Alibis of Empire examines how Maine's sociotheoretic model of \"traditional\" society laid the groundwork for the culturalist logic of late empire.
