Setting the Agenda
Scholars of the U.S. House disagree over the importance of political parties in organizing the legislative process. On the one hand, non-partisan theories stress how congressional organization serves members' non-partisan goals. On the other hand, partisan theories argue that the House is organized to serve the collective interests of the majority party. This book advances our partisan theory and presents a series of empirical tests of that theory's predictions (pitted against others). It considers why procedural cartels form, arguing that agenda power is naturally subject to cartelization in busy legislatures. It argues that the majority party has cartelized agenda power in the U.S. House since the adoption of Reed's rules in 1890. The evidence demonstrates that the majority party seizes agenda control at nearly every stage of the legislative process in order to prevent bills that the party dislikes from reaching the floor.
Separation of powers and legislative organization : the President, the Senate, and political parties in the making of House rules
\"This book examines how the constitutional requirements of the lawmaking process, combined with the factional divisions within parties, affect U.S. representatives' decisions about how to distribute power among themselves. The incorporation of the presidential, senatorial, and House factions in the analysis of House rule making marks an important departure from previous theories, which analyze the House as an institution that makes laws in isolation. This book argues that, by constitutional design, the success of the House in passing legislation is highly contingent on the actions of the Senate and the president; and therefore, also by constitutional design, House members must anticipate such actions when they design their rules. How did the federal judiciary transcend early limitations to become a powerful institution of American governance? How did the Supreme Court move from political irrelevance to political centrality?Building the Judiciaryuncovers the causes and consequences of judicial institution-building in the United States from the commencement of the new government in 1789 through the close of the twentieth century. Explaining why and how the federal judiciary became an independent, autonomous, and powerful political institution, Justin Crowe moves away from the notion that the judiciary is exceptional in the scheme of American politics, illustrating instead how it is subject to the same architectonic politics as other political institutions. Arguing that judicial institution-building is fundamentally based on a series of contested questions regarding institutional design and delegation, Crowe develops a theory to explain why political actors seek to build the judiciary and the conditions under which they are successful. He both demonstrates how the motivations of institution-builders ranged from substantive policy to partisan and electoral politics to judicial performance, and details how reform was often provoked by substantial changes in the political universe or transformational entrepreneurship by political leaders.
