International relations scholarship and the popular media tend to portray China as a great power with hegemonic designs for Southeast Asia. Moreover, studies on Chinese influence in Southeast Asia predominantly focus on the Chinese state. This paper argues that Chinese non-state actors and their daily encounters with local communities in Southeast Asia deserve equal attention as these interactions evidently produce friction at both the society-to-state and state-to-state level. The influence of Chinese non-state actors in Southeast Asia can be illustrated with three examples, namely, Chinese tourism operations in Thailand, Chinese market demand and agricultural transformations in Myanmar, and Chinese gangs within the casino economy in Cambodia. Thailand has recently become a top tourist destination for Chinese nationals. This has cultural implications as those involved in the tourism industry need to have Chinese language skills. The economic implications include increased competition and decreased accountability as Chinese tour companies have set up in Thailand using Thai locals as nominees. Bilateral relations also soured after a boat carrying Chinese tourists capsized in Thailand. As global prices of corn rose in 2011 and 2012, areas in Myanmar close to the Chinese border have increased corn cultivation to meet Chinese demands for that crop. This has led to deforestation in these areas. Chinese gangsters fleeing their government's crackdown in China have settled down to operate in the casino economy in Cambodia. Consequentially, there has been a rise in crime rate involving online scams and deteriorating public security. Despite the Chinese government encouraging the Cambodian government to enforce a ban on online gambling, the actions of non-state actors from China continue to be associated with the Chinese state as a whole and there is rising resentment towards the Chinese in Cambodia. The COVID-19 pandemic has temporarily halted cross-border trade between China and mainland Southeast Asia. This has negatively affected local farmers who are dependent on the Chinese market.

Understanding Security Practices in South Asia

This book explores the ways in which non-state actors (NSAs) in South Asia are involved in securitizing non-traditional security challenges in the region at the sub-state level.
South Asia is the epicentre of some of the most significant international security challenges today. Yet, the complexities of the region’s security dynamics remain under-researched. While traditional security issues, such as inter-state war, border disputes and the threat of nuclear devastation in South Asia, remain high on the agendas of policy-makers and academics both within and beyond the region, scant attention has been paid to non-traditional or ‘new’ security challenges.
Drawing on various case studies, this work offers an innovative analysis of how NSAs in South Asia are shaping security discourses in the region and tackling security challenges at the sub-state level. Through its critique of securitization theory, the book calls for a new approach to studying security practices in South Asia – one which considers NSAs as legitimate security actors.
This book will be of much interest to students of security studies, Asian security, Asian politics, critical security studies, and IR in general.

Building a People-oriented Security Community the ASEAN Way

ASEAN has declared its intention to create a security community in Southeast Asia that is people-orientated. This book evaluates ASEAN's progress, and in doing so examines three matters of concern.
The book firstly looks at the importance of constitutive norms to the workings of security communities, by identifying ASEAN's constitutive norms and the extent to which they act as a help of hindrance in establishing a security community. It then moves on to how ASEAN has interpreted people-orientated as empowering civil society organisations to be community stakeholders. The book discusses the uncertainty between how ASEAN envisages their role, and the role they themselves expect to have. Civil society actors are seeking to influence what sort of community evolves and their ability to interact with the state elite is evaluated to determine what interpretation of people-oriented is likely to emerge. Thirdly, in order to make progress ASEAN has sought to achieve cooperation among its member states in functional areas. The book examines this interest in functional cooperation through case studies on human rights, HIV/AIDS and disaster management.
By discussing the notion of ASEAN being people-orientated, and how it engages with 'the people', the book provides important insights into what type of community ASEAN in building, as well as furthering our understanding on security communities more broadly.
Human Rights Obligations of Non-State Armed Groups

This book is concerned with the international regulation of non-state armed groups. Specifically, it examines the possibility of subjecting armed groups to international human rights law obligations. First addressed is the means by which armed groups may be bound by international law. Of particular interest is the de facto control theory and the possibility that international law may be applied in the absence of direct treaty regulation. Application of this theory is dependent upon an armed group’s establishment of an independent existence, as demonstrated by the displacement of state authority. This means that armed groups are treated as a vertical authority, thereby maintaining the established hierarchy of international regulation. At issue therefore is not a radical approach to the regulation of non-state actors, but rather a modification of the traditional means of application in response to the reality of the situation. The attribution of international human rights law obligations to armed groups is then addressed in light of potential ratione personae restrictions. International human rights law treaties are interpreted in light of the contemporary international context, on the basis that an international instrument has to be applied within the framework of the entire legal system prevailing at the time of interpretation. Armed groups’ status as vertical authorities facilitates the vertical application of international human rights law in a manner consistent with both the object and purpose of the law and its foundation in human dignity. Finally, if international human rights law is to be applied to armed groups, its application must be effective in practice. A context-dependent division of responsibility between the territorial state and the armed group is proposed. The respect, protect, fulfil framework is adapted to facilitate the application of human rights obligations in a manner consistent with the control exerted by both the state and the armed group.
