فهذا بحث يتناول المذهب الظاهري، الذي يعتبر أكثر المذاهب تقيدا بالنصوص الشرعية، لا يتجاوزها إلا إلى الاستصحاب باعتباره امتدادا لها. فصار مذهبا سنيا من مذاهب أهل السنة والجماعة، لا من المذاهب الضالة عقديا. ثم عد ضمن المذاهب الفقهية المتداولة، فصارت خمسة لا أربعة لا غير. وعكس اعترافات المنصفين بمكانة المذهب الظاهري في الفقه خصوصا والفكر الإسلامي عموما، لقي معارضة شديدة سواء في عصور سابقة أو الآن، لدرجة جعلته من أكثر المذاهب معاناة من الخصوم. فاعتبرت مدرسته الأصولية، شاذة أمام مدرستي الجمهور والحنفية الأصوليتين المعروفتين، في حين أن الصواب النظر له بموضوعية بلا اقتصار على نقائصه. والنظر أحسن في ظل المشروع المنشود تحقيقه، بفقه يعتمد على كل المذاهب المعتبرة، لا فقه مذهبي يتقيد بالمذهب الواحد.
