تعتبر مسؤولية الدولة عن الخطأ القضائي، من أهم المواضيع التي يمكن أن تؤثر تأثيرا بالغا في النظام القضائي للدولة بأكملها، حيث تثير العديد من الإشكالات والمسائل المتشابكة، والتي تتعلق في شق كبير منها بمسألة السيادة، وما يترتب عليها من حصانة لبعض الأعمال الخاصة بالدولة. لا جدال أن الدعوى العمومية من أخطر الدعاوى وأهمها على الإطلاق، ذلك أنها وسيلة المجتمع في الحفاظ على كيانه وبقائه، وله لذلك الحق في عقاب كل فعل من شأنه أن يخل بكيانه، ولا يتحقق ذلك إلا بصدور حكم جنائي صحيح قانونا يعلن الحقيقة الواقعية في الإدعاء المعروض على القضاء، عبر التطبيق الصحيح للقانون الجنائي الذي يعد من مهام الدولة.
