Overview
على الرغم من تدعين الاختصاص القضائي لمجلس الدولة المصري، سواء في دستور سنة 1971 م أو في قانونه الحالي، فإن الوضع لم يتغير بالنسبة للمنازعات المتعلقة بالعقود الإدارية، لأن الاختصاص العام للقضاء الإداري بتلك المنازعات، قد تقرر منذ سنة 1955 م. ومن ثم فإن هذا المؤلف سوف يعرض لحصيلة قرابة 35 عاما من اجتهاد مجلس الدولة في مصر، سواء علي صعيد القضاء أو الفتوى. وإذا كانت معظم تلك الأحكام والفتاوى قد صدرت في ظل القانون رقم 236 لسنة 1954 م الملغي، فإن الشريعة الحديثة التي حلت محل التشريعات الملغاة، قد عدلت في التفاصيل الجزئية. أما نظرية العقد الإداري في ذاتها، فإنها مستمرة، ومن هنا تحتفظ أحكام القضاء السابقة بكامل أهميتها.
