مسؤلية الطبيب الذى اختاره المريض لعلاجه هى مسؤلية عقيدية والطبيب إن كان لا يلتزم بمقتضى العقد الذى ينعقد بينه وبين مريضه بشفائه أو بنجاح العملية التى يجريها له- لأن إلتزام الطبيب ليس إلتزاما بتحقيق نتيجة وإنما هو إلتزام ببذل عناية إلا أن العناية المطلوبة تقتضى أن يبذل الطبيب لمريضه جهودا صادقة يقظة تتفق- فى غير الظروف الاستثنائية- مع الأصول المستقرة فى علم الطب- فيسأل الطبيب عن كل تقصير فى مسلكه الطبى. وقد ألقى هذا بعبء المسؤلية الجسيمة على الطبيب فى حالة الخطأ فى هذا المجال، لذلك فقد تعرضنا لتلك الجرائم سواء كانت جنح أم جنايات وذلك حتى يكون هذا الكتاب ملما بكل الجرائم التى يستخدم فيه الجنائى الطب سبيلا لإرتكاب الجريمة.
